Enclosed please find the Annexation Petition for the Schneider
Annexation, a map of the proposed Annexation and the Annexation
Impact Report.
Also enclosed is Resolution 1997-103 finding that the
annexation is in substantial compliance with C.R.S. 31-12-107(1)
and setting a hearing on December 3, 1997 at the hour of 7:00 p.m.,
at which time the Board of Trustees will consider whether or not to
annex the described property. The foregoing Resolution and Notice
are being published in The Windsor Beacon.

PETITION FOR ANNEXATION
The undersigned Petitioners, Jack Roy Schneider and Beverly
I. Schneider, with address of 11981 Weld County Road 74, Eaton, CO
80615 (telephone number 970-686-5235) being the sole and only
owners of the hereinafter described property, pursuant to Colorado
Revised Statutes §31-12-107 as amended, do hereby petition the Town
of Severance (the "Town") in the State of Colorado, to annex the
property (the "Property") herein described and to incorporate the
same within the corporate boundaries of the Town as follows:
SECTION ONE
ANNEXATION OF PROPERTY
1. That the Petitioners hereinabove named are the owners of
the following described property located in Weld County, Colorado:
Lot B of Corrected Recorded Exemption No.
0807-1-1 RE 1647, recorded December 20, 1995
in Book 1523 at page 648 as Reception No.
2469460, being a part of the NE/4 of Section
1, Township 6 North, Range 67 West of the 6th
P.M., Weld County, Colorado, containing 150
acres, more or less
2. That the prosperity of the Town and of the Property will
be greatly enhanced by its annexation to the Town; that it is
desirable and necessary that the Property be annexed to the Town
of Severance.
3. That the Property is eligible to be annexed, pursuant to
Colorado Revised Statutes §31-12-104 and all requirements under
said statute have been met.
(a) Not less than 1/6th of the perimeter of the area to
be annexed is contiguous with the annexing Town.
(b) A community of interest exists between the Property
and the Town; that it is presently anticipated that the Property
will be urbanized in the near future; that the Property is
integrated with or is capable of being integrated with the Town.
4. That the limitations, as set forth in Colorado Revised
Statutes §31-12-105 would not have the effect of invalidating the
proposed annexation and all requirements under said statute have
been met.
5. That the Petitioners hereinabove named, Jack Roy Schneider
and Beverly I. Schneider are the sole and only landowners of the
property proposed to be annexed; that a Certificate of Ownership
of the Property shall be submitted to the Planning Commission of
the Town within 30 days of the date of this Petition.
6. That the legal description of the Property owned by the
Petitioners is attached to this Petition as Exhibit "A" and is
incorporated by reference herein; that a copy of the Corrected
Recorded Exemption Plat No. 0807-01-1-RE1647 recorded December 20,
1995 in Book 1423 at page 648 as Reception No. 2468460 of the Weld
County records is attached hereto as Exhibit "B" and incorporated
by reference herein; that Exhibit "C" is a copy of plat map of
Township 6 North, Range 67 West of the 6th P.M., Weld County,
Colorado, and is attached hereto and incorporated by reference
herein; that the west boundary line of the Schneider property
located in the NE/4 of said Section 1, Township 6 North, Range 67
West of the 6th P.M., Weld County, Colorado is adjacent to the East
line of the Doke property located in the NW/4 of said Section 1,
Township 6 North, Range 67 West of the 6th P.M., Weld County,
Colorado, which has heretofore been annexed to the Town of
Severance, Weld County, Colorado.
7. That the name° and addrecoeo of all property ownerc within

8. That the above -named Petitioners request that the Town
approve the annexation of the area proposed to be annexed.
SECTION TWO
MAP OF PROPERTY TO BE ANNEXED
1. The map attached to this Petition is an accurate map of
the Property and contains a written legal description of the
Property, as well as the boundary of the Property, and a drawing
of the contiguous boundary of the annexing Town.
2. A more detailed annexation plat will be submitted at the
request of the Planning Commission.
The above named Petitioners hereby request that the governing
body of the Town of Severance, Weld County, Colorado, approve the
annexation of the Property proposed to be annexed.

SCHNEIDER ANNEXATION IMPACT REPORT
Pursuant to C.R.S. 31-12-108.5(1), the following information
is provided with this report:
A. A map of the municipality and adjacent territory showing
the present and proposed boundary of the municipality and vicinity
of the proposed annexation.
B. No plan for water main sewer interceptors, utility lines
or streets has been developed. This property is immediately
adjacent to a subdivision of the Town of Severance. The streets,
sewer and water lines will be connected to existing facilities.
C. It is anticipated that the area will be developed
primarily as single family residence, on traditional residential
size lots.

D. No copy of the annexation agreement is available at this

subdivision through existing Town sanitary sewer lines and sanitary
sewer treatment services will be provided by the Town of Severance
sanitary sewer treatment plant.
F. The developer will finance all development infrastructure
in the area proposed to be annexed.
G. The districts which exercise control over the area
proposed to be annexed include:
1. Aims Community College
2. School District RE -2 - Eaton
3. Windsor/Severance Fire Protection District
4. North Colorado Water Conservancy District
5. North Weld Co. Water District
6. West Greeley Soil Conservation District
7. Weld Library District
8. 911 Emergency Telephone Service District
H. School District RE -2 - Eaton has been advised that the
annexation has the potential to develop 100-300 residential home
sites. The District did not express any opposition to the proposed
annexation.
I. It is anticipated that a right to farm covenant will be
incorporated into any annexation agreement.
If no objection is received from the Board of County
Commissioners, it is anticipated that the entire width of County
Road 74 as it adjoins the subject property will be annexed along
with the property described in the Schneider Annexation Petition.

RESOLUTION NO. 1997- /Qyi
A RESOLUTION FINDING THAT THE PETITION FOR ANNEXATION OF
PROPERTY COMMONLY KNOWN AS THE SCHNEIDER ANNEXATION IS IN
SUBSTANTIAL COMPLIANCE WITH C.R.S. 31-12-107(1) AND
SETTING A DATE FOR HEARING BEFORE THE BOARD OF TRUSTEES
OF THE TOWN OF SEVERANCE, COLORADO TO CONSIDER THE
ANNEXATION OF THE AREA PROPOSED TO BE ANNEXED
WHEREAS, the owners of 100% of the property commonly known as
the Schneider Annexation have filed a Petition for Annexation of
such property to the Town of Severance, and;
WHEREAS, the Board of Trustees has determined that the
Petition is in substantial compliance with C.R.S. 31-12-107(c) and
that a hearing should be held to determine whether the area
proposed to be annexed meets the applicable requirements of C.R.S.
31-12-104 and C.R.S. 31-12-105 and whether such property should be
annexed to the Town of Severance.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF SEVERANCE, COLORADO AS FOLLOWS:
Section 1,_ The Board of Trustees finds that the petition for
annexation of certain property known as the Schneider Annexation
and more specifically described in the property description
attached hereto as Exhibit "An is in substantial compliance with
C.R.S. 31-12-107(c) and Section 30 of Article II of the Colorado
Constitution.
Section 2. The Board of Trustees hereby sets a public
hearing for the 3rd day of December, 1997 at the hour of 7:00 p.m.
at the Town Hall, Town of Severance, 336 lst Street, Severance,
Weld County, Colorado for the purpose of determining whether the
area proposed to be annexed meets the applicable requirements of
C.R.S. 31-12-104 and 105, and to determine whether or not said area
is eligible for annexation pursuant to Colorado law and to
determine whether the area should be annexed to the Town of
Severance.
Section 3. The Town Clerk is hereby directed to publish
notice of this hearing once each week for four successive weeks in
the Windsor Beacon, the designated newspaper for the Town of
Severance.

NOTICE
Notice is hereby given that on the 3rd day of December, 1997,
at the hour of 7:00 p.m., at the Town Hall, located at 336 let
Street, Severance, Weld County, Colorado, the Board of Trustees of
the Town of Severance will hold a public hearing on the Petition
for Annexation for the area known as the Schneider Annexation as
more particularly described in Exhibit "A" attached to this notice.
The Resolution fixing the foregoing hearing date accompanies
this Notice. The hearing shall be for the purpose of determining
and finding whether the area proposed to be annexed meets the
applicable requirements of C.R.S. 31-12-104 and C.R.S. 31-12-105
and Section 30 of Article II of the Colorado Constitution, to
determine eligibility, and to determine if the area should be
annexed to the Town of Severance.
The Petition for Annexation and accompanying maps of the area
proposed to be annexed are on file with the Town Clerk at the Town
Hall located at 336 1st Street, Severance, Colorado, and may be
inspected during normal business hours which are from 8:30 a.m. to
11:30 a.m., Monday through Friday.
