RE: APPROVE AGREEMENT FOR TRANSFER OF TAX SALE CERTIFICATE AND
AUTHORIZE CHAIR TO SIGN -ANDERSON METALS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement for Transfer of Tax Sale
Certificate between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Weld County Treasurer, and Anderson Metals,
1543 1st Avenue, Greeley, Colorado 80631, with terms and conditions being as stated in said
agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Agreement for Transfer of Tax Sale Certificate between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Weld County Treasurer, and Anderson Metals be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 4th day of March, A.D., 1998.

AGREEMENT FOR TRANSFER OF TAX SALE CERTIFICATE
THIS AGREEMENT is made and entered into on this ), day of ri,1 e[ ti
1998, by and between Anderson Metals, whose address is 1543 1st Avenue, Greeley, Colorado
80631 ("Anderson"), and the County of Weld, by and through the Board of County
Commissioners of the County of Weld, whose address is 915 10th Street, Greeley, Colorado
80631 ("County").
WITNESSETH:
WHEREAS, County holds Tax Sale Certificate of Purchase No. 92-00911/93 ("Tax
Certificate") for metal structures located on the Union Pacific Railroad Right-of-Way, in the NE4
SE4 of Section 31, T5N, R65W of the 6th P.M., Weld County, Colorado ("metal structures"),
which Certificate was issued November 4, 1993, "stricken off'to County, and then recorded in
the office of the Weld County Clerk and Recorder on July 18, 1994, at Book 1451, Reception
Number 02397973; recorded again on July 19, 1995, at Book 1502, Reception Number 2447155;
and again on August 23, 1995, at Book 1508, Reception Number 2452488, and
WHEREAS, since July, 1993, no one has paid the taxes due on the metal structures
($6,008.82), they have remained unoccupied, and are now in need of demolition, and
WHEREAS, although County has the right to apply for a Treasurer's Deed for the metal
structures, it has not done so as of this date, and
WHEREAS, Anderson Metals desires to obtain ownership of the metal structures by
purchasing the Tax Certificate from County, to apply for a Treasurer's Deed, and to demolish the
metal structures, and
WHEREAS, pursuant to C.R.S. § 39-11-122 and given that the amount of taxes due is
less than $10,000, the County has the authority to transfer ownership of the Tax Certificate
without the necessity of obtaining the approval of the State of Colorado Property Tax
Administrator, and
WHEREAS, the parties hereby enter into this Agreement for the purpose of
accomplishing the transfer of ownership of the Tax Certificate.
NOW, THEREFORE, in consideration that mutual promises and covenants contained
herein, the parties hereto agree as follows:
1. Anderson Metals shall pay to County the sum of$10 as the purchase price for the
transfer of ownership of the Tax Certificate.

2. County shall transfer ownership of the Tax Certificate by assigning its right, title,
and interest to Anderson Metals.
3. Anderson Metals shall apply with the Weld County Treasurer for a Treasurer's
Deed for the metal structures. County shall pay the necessary fee for said
Treasurer's Deed ($225).
4. Anderson Metals shall, prior to October 1, 1998, demolish the metal
structures and remove all debris therefrom at no cost to County.
