This letter is in regard to our telephone conversation that we had the other day. We purchased our 2OOac.
at 11778 HWY 52 in June of 1991. Mr. Buxbaum had been farming this property for the past ten years
and had never had-any problem with the use of the land. At the time that we had purchased the property,
John Colburn was residing at 11772 HWY 52 that is adjacent to our property. After we had started to
do our own farming on our property, John had decided to put up a horse pen-and pig pens on his little
pie shape property that is adjacent to ours.
I had contacted my Attorney Vincent Phelps, who is now an Adams County Judge. And he was
not in accord with how the property was surveyed and said it would be a problem from now on. The
survey copies of the property show the piece in question. In March 1994 John Colburn decided to sell
his property, I then approached him about purchasing that piece of ground. We agreed to a purchase and
proceeded in a Quit Claim Deed which was recorded. The realtor was aware of it and discussed it with
with his buyer and his realtor said it would not hinder the purchase. When the bank contacted Weld
County about the exemption,Weld County denied it. Then I had to file a new Quit Claim Deed to rectify
the situation. The new buyer, Emmett Jordon is not very -happy with me using this access into my
property. Any assistance you can give me will be greatly appreciated.
