RESPONSE TO RESPONDENTS RESPONSE DATED MARCH 11, 1997'
H. KENNETH JOHNSTON II and LINDA J. JOHNSTON,
vs.
WELD COUNTY BOARD OF EQUALIZATION,
Petitioners,
Respondent.
THE PETITIONERS file this Response to the response to the
Respondent's Response To The Boards Order Dated February 26, 1997.
1. The Petitioners strongly object to the information supplied by
the Respondents in their response dated March 11, 1997.
2. Although the Certificate of Mailing states March 11, 1997, the
envelope has a postmark of March 12, 1997, a copy is attached
hereto of the postmarked envelope.
3. The Order of this Board on February 26, 1997 was to re -measurer
the residence of the Petitioners and calculate the square footage
correctly.
4. The Respondents have in essence not done what this Board has
Ordered, i.e., used the measured calculations to compute the square
footage.
S. I, H. Kenneth Johnston II personally watched each measurement
that was taken and there is not one measurement that is on the
exhibit that is correct.
6. The Respondent has either rounded up or down as they saw fit.
Because this property has many angles, to do so is inequitable and
not pursuant to the Order of this Board.
7. The Respondent found even with their new measurement with the
rounding up and down procedure that the house is only 3140 square
feet, according to their calculations in exhibit "A" and not the
3326 square feet set forth in the appeal.
8. The Respondent testified that if a measurement was over 6" they
rounded up and if less they rounded down. At the completion of the

measurement, I requested that I be faxed a copy of the exact
measurements which were being written down by one of the assessors
as I was viewing the readings being taken. I was assured that I
would receive such and was taken back when I received the cited
response not having any measurements that reflect something less
than an even foot.
9. The Respondents even though
