Kirkmeyer, Chair Commissioner George E. Baxter, Pro-Tem Commissioner Dale K. Hall Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Chris Goranson The following business was transacted: I hereby certify that pursuant to a notice dated January 31, 1996, and duly published February 8, 1996, in the North Weld Herald, a public hearing was conducted to consider the request of Great Guns (Greg Reeves and Patty Deplazes)for a Site Specific Development Plan and Special Review Permit#1105 for a shooting range (shotgun sports gun club and pro shop) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Chris Goranson, Planning Department representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He responded to questions from the Board regarding Development Standard #17 concerning the review of the Permit every five years. Mr. Morrison clarified staff has developed proposed language to allow this type of Permit to exceed five years; however, said revision has not been considered. Commissioner Hall suggested the Permit be reviewed every five years and revoked if a substantial change occurs. Mr. Morrison confirmed the review is to observe changes in the neighborhood, not for violations by the operators. Patty Deplazes represented the applicant and stated this development will be an asset to the area and requested the initial term of the Permit be for ten years. She referenced Condition of Approval #6 and requested only the materials along Weld County Road 96 and adjacent to the club house be designated on the plat, with the rest of the materials, such as evergreens and deciduous trees, to be planted at random on the remaining 125 acres. Chair Kirkmeyer clarified Condition of Approval #2 does not require trees other than 960226 PL1021 cc : PL. RE: HEARING CERTIFICATION - GREAT GUNS (USR#1105) PAGE 2 on Weld County Road 96. Ms. Deplazes clarified the intent is to plant additional trees, but she does not want to be required to show them on the plat. Responding to further questions from the Board, Ms. Deplazes indicated the locations of the surrounding property owners and stated the subject parcel is in the Conservation Reserve Plan (CRP), but it could be farmed when the CRP expires. She confirmed access along Weld County Road 96 and discussed the topography, noting all neighbors have been contacted and the site location was reviewed extensively. Ms. Deplazes clarified the reasons for requesting the initial term of the Permit be ten years are the substantial investment, the construction of a permanent structure for the clubhouse, and to allow them an opportunity to recover the expense. She then suggested the Permit be issued for ten years and reviewed every ten years thereafter. Mr. Morrison clarified for the Board the intent of the review is not to revoke the Permit unless there is a substantial change in the neighborhood which would create a compatibility issue. He noted if the operation is not in compliance or is in violation of the Permit, it can be revoked. Mr. Goranson referenced Section 45.3.1 of the Weld County Zoning Ordinance and reiterated staff has drafted language to better deal with the five-year review period. Ms. Deplazes stated Renegade Gun Club was issued a Permit by the Board with an initial term of ten years. Mr. Morrison clarified the current language states this type of Permit may be issued for up to five years, and he read the language proposed by staff which includes the consideration of the investment for this type of facility. Said proposed language was entered into the record as Exhibit C. Further discussion concerning said issue ensued between the Board and Ms. Deplazes. Molly Sommerville, Union Pacific Resources Company and Union Pacific Land Resources Corporation (UP Entities) representative, submitted a letter to the Board dated February 21, 1996, as Exhibit D for the record. She explained the UP Entities own all of the minerals underlying the subject property and she has met with the applicants and worked out arrangements to make the situation compatible. She confirmed the UP Entities have no conflicts or objections to the proposal. Mike Guttersen spoke in support of the proposal and agreed it will be a great asset. He noted extending the Permit from five to ten years would also make a big difference in the tree development and reiterated this facility is a great investment. Commissioner Hall moved to approve the request of Great Guns (Greg Reeves and Patty Deplazes) for a Site Specific Development Plan and Special Review Permit#1105 for a shooting range (shotgun sports gun club and pro shop) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record and amending Conditions of Approval#6c to correlate with the intent of Condition of Approval#2 and Development Standard#17 to include the reconsideration of the five- year review period without additional fees. The motion was seconded by Commissioner Harbert, and Commissioner Baxter stated he agrees the issue concerning the five-year review period needs to be addressed; however, until it can be formally approved, revising Development Standard #17 as stated is the best remedy. Commissioner Webster stated the five-year limitation may be placing an undue hardship upon the applicants, but otherwise they may be risking denial of the Permit..
