HomeMy WebLinkAbout952478.tiffRESOLUTION RE: APPROVE CONTRACT FOR FUNDING OF VICTIM -WITNESS PROGRAM BETWEEN VICTIM ASSISTANCE AND LAW ENFORCEMENT BOARD AND OFFICE OF DISTRICT ATTORNEY AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Contract for funding of the Victim -Witness Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Office of the District Attorney, and the Victim Assistance and Law Enforcement Board, commencing January 1, 1996, and ending December 31, 1996, with further terms and conditions being as stated in said contract, and WHEREAS, after review, the Board deems it advisable to approve said contract, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by theBoard of County Commissioners of Weld County, Colorado, that the Contract for funding of the Victim -Witness Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Office of the District Attorney, and the Victim Assistance and Law Enforcement Board be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said contract. Webster (AYF 952478 DA0012 Victim's Assistance & Law Enforcement Board Nineteenth Judicial District CONTRACT CONTRACT between Victim Assistance and Law Enforcement Board ("Donor") and Office of the District Attorney ("Recipient), P. O. Box 1167, Greeley, CO 80632, for the funding of Victim -Witness Program, referred to as the grant. The parties in consideration of the mutual promises contained herein agree as follows: 1. The Recipient hereby contracts to perform the services outlined in your grant application form, as submitted to the VALE Board and incorporated herein by reference. 2. The parties acknowledge that the grant contemplated herein is made pursuant to Colorado 1-aw and Recipient specifically agrees to use the grant for the purposes specified in C.R.S., 1973, S24-4.2-105, as amended. In addition, Recipient agrees to submit to Donor quarterly reports on "VALE Quarterly Report Form - Nineteenth Judicial -District". Quarterly reports are due not more than fifteen (15) days after the end of each successive three month period of the grant term. Failure to submit quarterly reports may result in withholding of funds. 3. This grant commences on January 7, 1996, and terminates on December 31, 1996. 4. donor hereby grants to Recipient the sum of -$46,277.-00 of which an initial sum of -$11,569.25 will be paid to Recipient on or about January 75, 1995. The grant may be terminated by the Donor if: (a) the Recipient does not submit the required quarterly reports, or if the reports or other information does not show adequate achievement of the grant purpose as stated on the application form and pursuant to C.R.S., 1373 S24 -4.7-1D5, as amended; and, (b) the Donor has insufficient funds to continue the grant. Before termination for in -adequate achievement, the Recipient shall have an opportunity to meet with the Board. The grant may be terminated Joy the Recipient at any time. 6. At the -end of the Contract term, or upon Contract termination, all unspent funds shall be returned to the Donor. 7. The Contract termination date may be extended by written mutual agreement of both parties. -The -services to be provided may also be modified by written mutual agreement of both parties. 8. The signatories certify that we have read the contract and are fully cognizant of our duties and responsibilities for this project. Box 1167 Greeley, CO 80632 SUBJECT: Victim-Witne-ss Program Dear Ms. Haffner: On _November 30, 1995, after careful consideration of your proposed project, Victim -Witness Program, the VALE Board of the Nineteenth Judicial Dtstri_ct approved a grant of $46,277.00. _I have enclosed two copies of a contract concerning the funding of your project-., please sign and keep one copy for your records and return one copy to Gary Rathlce at the _District Attorney's Office, P. O. Box 1167, Greeley, Color -ado 80632. The funding for your project will begin on January 1, 199E. You may -expect quarterly payments of $11,369.25 each (to be made on or about the I fteenth day of the month). Haffner Community Programs A2iruinistrator 19th Judicial District Attorney's Office DATE: December 12, 1995 SUBJECT: 1996 VALE Grant: Contract Agreements As you will recall, I presented the 1996 VALE Grant to the Board of Commissioners on October25, 1995. Since that time, our 1996 VALE Grant has been accepted and approved by -the VALE Board members in the amount of $46,277. I am requesting the -signatures if both Dale Hall and Donald Warden on the two attached originalcopies of the contract agreement. _'lease sign in blue ink if possible. I will -need both copiesireturned. Therefore, if you need afile copy, please feel free -to make one. Don, as you will note, I prepared a contract agreementfor your signatures after I presented the 1996 VALE Grant to the Commissioners. As this was my first time around with this grant, I did not realize that I did not need to prepare thetontractagreement--it would be given -.o me after the VALE Board approved our grant. Therefore, I am -requesting your signatures once again! Please give me a call at ext. 4730 when you have each had an opportunity to sign the two contract agreements and I will come togetthem.
