COLORADO CASE NO.: USR-1224 NAME: Nelson, Ray T. Environmental Protection Services has reviewed this proposal for a roping arena. We have several recommended development standards and one recommended condition of approval. They are as follows: We recommend the following to be a condition of approval: 1) The applicant shall submit a manure management plan to the Weld County Health Department for review and approval. The plan should describe how manure generated on site will be stored, managed, removed, land applied, etc. We recommend the following to be development standards: / 1) The applicant shall remove,handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exit or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The surface beneath any manure storage area shall be constructed to minimize seepage or percolation of manure contaminated water. In no event shall the facility impact or degrade waters of the State in violation of the Confined Animal Feeding Operation Control Regulations(5CCR 1002-19). 2) The facility shall maintain compliance with the Confined Animal Feeding Operation Control Regulations and the Weld County Zoning Ordinance. 3) All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,30-20- 101, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. J 4) No permanent disposal of wastes shall be permitted at this site. 5) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 6) Fugitive dust shall be controlled on this site. v 7) The maximum permissible noise level shall not exceed the residential limit of 55 db(A) as measured according to 25-12-102, Colorado Revised Statutes. 8) Adequate toilet and hand washing facilities shall be provided for the public. An individual sewage disposal system is required for the proposed announcer stand and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system shall be designed by a Colorado Registered Professional according to the Weld County Individual Sewage Disposal Regulations. The restrooms shall be available for patron usage. Health Department SUBJECT: USR-1224, Amended Referral As you are aware, our Department recently received a complaint concerning the property under consideration in USR-1224. Our staff verified that the facility has issues that need to be addressed. These issues were described in a letter dated April 14, 1999. Your Department was provided a copy of this letter. As a result of the complaint and field investigations, we believe that it is appropriate to amend our previous referral, dated March 5, 1999, to address these issues. In our referral, we recommended one Condition of Approval. We suggest that this condition to be amended to state the following: The applicant shall submit a manure and wastewater management plan to the Weld County Health Department for review and approval. The plan should include drawings and a written text that describes how manure and wastewater generated on site will be stored, managed, removed, land applied, etc. The plan should also specifically describe how the facility will prevent any discharge of wastewater from the facility in excess of what is allowed by the Confined Animal Feeding Operation Control Regulations (5 CCR 1002-19). Nelson COLORADO The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the purview of the Use By Special Review. Our requirements are as follows: 1. WCR 53: WCR 53 is designated on the Transportation Plan Map as a collector status road which requires 80 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-of- way line. 2. Access: The proposed access shall be at the existing double gate. This access shall contain a minimum 30-foot wide,15-inch CMP culvert with adequate cover. The sight distance is adequate in both directions at this location. This access point shall be recessed off WCR 53 approximately the length of a pickup and horse trailer combination to avoid any parking or staging on WCR 53 until the facility is unlocked. The existing residential access is from WCR 48 which is designated as a local gravel road. 3. Off-Street Parking: There appears to be adequate parking and circulation for the proposed use. I would recommend that the proposed parking areas be placed in pasture grass or should be disced on a regular basis to avoid erosion or soil blowing. 4. Noxious Weed: Pursuant to Ordinance 169A, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. 5. Storm Water Drainage: The site consists of mostly sandy soil conditions with a slight drainage grade to the east toward WCR 53. It appears that any storm water generated from the site would be collected in the west borrow pit of WCR 53 and dispersed to the south. This site does not appear to create a storm water drainage problem. 6. Plat Information: The applicant shall place, on the plat, a scale reflecting the plat drawing and the proposed recessed access and 15-inch culvert location. cc: USR-1224 plan6 Weld County Planning Dept.
