RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST MONTY AND CONNIE WINTER FOR VIOLATION OF THE
WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Monty and Connie Winter, #VI-9700185, are allegedly in violation of the
Weld County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of August, 1998, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Monty Winter, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until February 11, 1999, to allow adequate time for the property owners
to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that said violation be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Monty and Connie Winter to remedy the violation of the Weld
County Zoning Ordinance, and any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert with the identified
parties, with an instruction for delay of action upon such referral until February 11, 1999, to allow
adequate time for the property owners to bring the subject property into compliance.

CASE SUMMARY
10/20/97 Initial complaint received about a noncommercial junkyard consisting of derelict
vehicles, a mobile home without the appropriate permits, and a large tent being used
for storage.
10/21/97 Site inspection conducted by Julie Chester,Zoning Compliance Officer. A camper,two
mobile homes and miscellaneous derelict vehicles were observed.
10/21/97 Sierra check determined that mobile home permit (PR-9630084) was issued for the
mobile home used as a principal dwelling.
10/21/97 Five day contact letter sent as well as a building permit application and a certificate of
compliance for a mobile home to be used for storage.
11/13/97 Facsimile correspondence from Mr. and Mrs. Winter stating they had some medical
emergencies and will come into the Department of Planning Services by 11/22/98, and
apply for the appropriate permits.
11/14/97 Progress inspection conducted. The property is still in violation.
11/24/97 Building permit application and certificate of compliance received by the Department
of Planning Services (PR-9730326 and COC-970026).
11/24/97 Progress inspection. Most of the derelict vehicles have been towed away. The tent is
being used to store miscellaneous garage items and appliances. Mr. Winter stated they
will apply for the building permit for a garage in the spring.
1/19/98 Thirty day letter sent. A detailed screening plan must be submitted to the Department
of Planning Services and the accessory structure cannot be used for any overnight or
temporary housing. The violation was placed on a "hold" status pending the issuance
of the second mobile home permit.
7/27/98 Two complaint letters were received via the Board of County Commissioners office
from surrounding property owners.

7/28/98 Progress inspection conducted. There is adequate fencing in place screening the
noncommercial junkyard, no derelict vehicles were observed on site. I spoke with
Monty Winter at the property and after determining that the mobile home for storage
permit was not issued by the Department of Planning Services, I faxed a letter
scheduling him to appear at the violation hearings scheduled for 8/11/98.
7/31/98 Telephone call between Connie Winter and Sharyn Frazer, Zoning Compliance Officer.
I explained that the Department of Planning Services could not extend the time frame
for the issuance of the appropriate permits any longer. We discussed the existing
screening and the fact that compliance has been achieved by the removal of the derelict
vehicles from the site. However, I did reiterate that the tent does not constitute
adequate screening of storage materials on site. I explained to Ms. Winter that they
would need to pay for the mobile home permit to be used as a storage facility and
apply to the building permit for the garage in lieu of the tent. I also explained they
would need to appear at the violation hearings and would have the opportunity to
address the Board.
The Department of Planning also recommends that the County Attorney be authorized to proceed with legal
action against any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties.

Attorneys Office.

Dear Mr. and Mrs. Trukenbolz and Mr. Winter:
The property referenced above remains in violation of the Weld County Zoning Ordinance. I have scheduled a
meeting with the Board of County Commissioners on August 11, 1998, at 10:00 a.m. to consider the violations
occurring on the property. This meeting will take place in the County Commissioners' Hearing Room, first floor,
Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners might have about
the violations.
The mobile home permit and certificate of compliance that you applied for to permit an accessory structure have
not been paid for or issued. The permit for the principal dwelling meets the requirements set forth by the county,
however, the permit for the accessory structure has not been paid for or issued. The original complaint was filed
with our office on October 20, 1997. No follow-up was conducted based on the fact that you applied for the
accessory structure permit. The tent you are using to keep storage materials out of the weather is not an allowed
use and you have failed to obtain a building permit for a permanent structure.
After speaking with you yesterday, you explained that finances have not been available to you, however, the
Department of Planning Services cannot extend these permits any further.
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation,the action necessary to correct the violation, and that you
were given sufficient time to remedy the violation. If you have any questions concerning this matter, please call
me.

Dear County Commissioner,
I am writing this letter to express a problem I see with the property on
Highway 52, 4 miles east of Fort Lupton on the North side of the road. My
neighbors and myself have been talking and don't know what else to do
besides make our concern heard.
The people there are not very friendly and so talking to them is pretty
much out of the question. Also, letting them know who is writing this
letter is out of the question, because they would not do anything about it
except be mad and maybe get even. Their place is a dump. There is
trash and junk cars and old garage sale stuff laying all over the place.
They do not plant anything, so it is dusty and dirty. Their birds get out
onto the highway. Their mobile homes are falling apart, and they have a
junk car business that they do in a big tent out back behind the place.
The value of our property has gone down instead of up (like we were
hoping it would with the new golf course). I don't think people who are
driving to the new golf course to see if they want to belong feel like it is a
very upscale place with neighbors like this. It is unsafe, unfit, unsightly
and I believe not following proper guidelines for residential/farm
properties.
I would really appreciate it if someone could look into this mess and
require that some clean up and adherence to guidelines to followed.

A Concerned Fort Lupton Tax Payer
To Whom It May Concern:
We live East of Fort Lupton, on Highway 52. We, and almost all of our
neighbors have a very strong concern about the people that moved onto the
land just West of Road 37. This is the property on the South side of the
Highway, right across from the Circle J Cattle Ranch.
I am writing this letter without signing it because we do not need the problems
that seem like they could arise from the people that live there, if they knew
who was complaining. Many of the other neighbors have expressed that they
also would like to have their concerns heard, but are afraid that the people
may not be too friendly about the concerns.
I have driven by that pasture for many years now, every single day. The
people across the highway have planted a nice garden, have flowers, children,
a nice place. The places nearby have tried to make their property nice and
have done some real clean up in the last few years. We felt like things were
going well and we had a farm community to be proud of.
The above mentioned property is a disaster and an eye sore. There are two
trailers parked right next to each other (neither one of them looks like
something people should be living in. There is a trashy, unpainted bunch of
plywood stuck up as a partial fence, and now someone is painting little
pictures on it. There is a big army looking circus tent back behind the place,
and there is trash and junk and old tires and a mess everywhere. The things I
have just mentioned are very unattractive to have to look at every day. But
there are other things that seem like they should be illegal. The people seem
to be using the property for a junk car lot. There are as many as 10-20 old junk
cars parked out there nearly every day. There are no trees or nice fences or
anything of the sort to cover the mess. There is always trash blowing all over,
getting in the ditch and blowing all over the highway.
One of the worse problems that have come up for some of us because of this
mess is that the value of our properties have suffered. Many people were
trying to refinance their homes at this time because of the low interest rates,
and could not qualify because their property value did not appraise at high
enough. An appraiser told me that nearby property such as this one is a main
cause for low appraisals to neighboring properties. Mier spending most of a
life time and saving on property and houses, it is totally unfair that the value of
our homes has gone down because someone has decided to turn our
neighborhood into a dump and a junk car lot.
We know that other people have shared their concerns, but this problem has
been going on for well over a year now, and it is getting worse and worse
instead of getting better and better. Please do something about it.

The uses on the above described property are being considered as a zoning violation of Sections 31.2, 31.2.1,
31.2.16, 31.3, 31.3.9 and 43 of the Weld County Zoning Ordinance and Section 70 of the Weld County
Building Code Ordinance. This is not a use allowed by right in the Agricultural zone district.
The violation can be corrected by removing the noncommercial junkyard from the property or screening it
from all adjacent properties and public rights of way. If screening is to be used to conceal the noncommercial
junkyard, a detailed screening plan must be submitted to and approved by the Department of Planning
Services Staff prior to installation. The Building permit (PR-9730326) cannot be released until the zoning
violation has been taken care of. The second mobile home (the accessory structure) cannot be used for any
overnight or temporary housing. The Department of Planning Services staff has observed people coming in
and out of the mobile home and it does appear to be lived in. This is not an allowed use.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,
we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty) days from
January 19, 1998 to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the County
Attorney's office for legal action.
Any information you have that may help to resolve this matter will be helpful. This office is ready to be of
any assistance in clarifying or answering questions concerning this matter. Please call or write the
Department of Planning Services' office.

1. Only one zoning permit for a manufactured home or mobile home used as an accessory structure may be issued
per legal lot at any one time by the Department of Planning Services.
Further, 1, the undersigned, meet the following conditions which are required to be eligible for this permit.
2. The applicant must obtain a building permit for the manufactured home or mobile home and must comply with
all installation standards of the Weld County Building Code applicable to manufactured homes or mobile homes.
Electricity is the only utility which is permitted to be connected to the manufactured home or mobile home.
3. The manufactured home or mobile home may not be used on any basis as a dwelling or as overnight or
temporary housing for any person.
4. The applicant must demonstrate that no reasonable alternative exists to using the manufactured home or mobile
home as an accessory structure.
