RE: ACTION OF BOARD AT SHOW CAUSE HEARING TO DETERMINE WHETHER TO
RENEW TAVERN LIQUOR LICENSE FOR J. MONTES, INC., DBA EL RODEO NIGHT
CLUB - EXPIRES OCTOBER 9, 1999
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, as the local liquor licensing authority for
Weld County, Colorado, pursuant to Section 12-47-302, C.R.S., and Weld County
Ordinance #102-A, may cause a hearing to be held on the application for renewal of any liquor
license previously issued by it, and
WHEREAS, J. Montes, Inc., dba El Rodeo Night Club, holds a Tavern Liquor License to sell
malt, vinous, and spirituous liquors, by the drink for consumption on the premises only, said license
being previously approved by the Board and expiring on October 8, 1998, and an application for
the renewal for said license being received on October 27, 1998, and
WHEREAS, at a probable cause hearing on December 21, 1998, the Board considered
evidence in the form of testimony and written reports which gave it probable cause to believe that
the following factors exist with respect to the El Rodeo Night Club in accordance with the
procedures of Ordinance #102-A:
1. Violations in the last one-year period by the licensee or any of the agents, servants,
or employees of the licensee, of the provisions of the Colorado Liquor Code, or any
of the rules or regulations authorized pursuant to the Colorado Liquor Code, or any
of the terms, conditions, or provisions under which the license was issued.
2. Excessive noise, rowdiness, or disturbances on a continuous basis in the immediate
area of the El Rodeo which has been substantially a result of the operation of the
El Rodeo.
a. Evidence of the existence of these factors include the information from the
reports of the Weld County Sheriff's Office #WC9800184, #WC9800274,
#WC9800402, #WC9800993, #WC9801002, #WC9801097,
#WC9801099, #WC9801407, #WC9801422.
3. A person or person(s) convicted under Section 42-4-1301, C.R.S., of driving under
the influence of alcohol or driving while ability impaired did become intoxicated at
the El Rodeo.

WHEREAS, by Resolution, the Board deemed it advisable to set a show cause hearing
concerning the renewal of the Tavern Liquor License issued to J. Montes, Inc., dba El Rodeo Night
Club, on January 13, 1999, at 9:00 a.m., pursuant to the procedures set forth in Ordinance #102-A
and Section 12-47-302, C.R.S., to allow the Board to consider evidence for the determination of
whether or not either or all of the above listed factors exist, and, if so, if there is sufficient evidence
of the existence of any of the factors listed in the "Phase II" portion of Ordinance #102-A which may
exacerbate or ameliorate the situation, and
WHEREAS, at said hearing on January 13, 1999, the Board deemed it advisable to
continue said matter to January 27, 1999, at 9:00 a.m., to allow the applicant's attorney to be
present, and
WHEREAS, at said hearing on January 27, 1999, Ms. Montes, the applicant, and her
attorney, Daniel Carr, were present, and the Board heard all of the testimony and statements of
those present, heard the recommendations of the Weld County Attorney's Office and the Weld
County Sheriff's Office, and studied all of the exhibits and evidence presented in this matter and,
having been fully informed, found that there was sufficient evidence presented to show that
factor #3., above, exists, but determined that the renewal of said Tavern Liquor License shall be
approved with the conditions as set forth below, because of the Licensee's efforts in the past to
alleviate said factor and promises to continue such efforts in the future.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, having examined said application and the other qualifications of the applicant,
does hereby grant License Number 99-03, to said applicant to sell malt, vinous and spirituous
liquors for consumption by the drink on the premises only, only at retail at said location; and the
Board does hereby authorize and direct the issuance of said license by the Chair of the Board of
County Commissioners, attested to by the Clerk to the Board of Weld County, Colorado, which
license shall be in effect until October 9, 1999, providing that said place where the licensee is
authorized to sell malt, vinous, and spirituous liquors for consumption by the drink on the premises
only, shall be conducted in strict conformity to all of the laws of the State of Colorado and the rules
and regulations relating thereto, heretofore passed by the Board of County Commissioners of Weld
County, Colorado, and any violations thereof shall be cause for revocation of the license, subject
to the following conditions:
That only those patrons who are twenty-one years of age or older shall be allowed
inside the premises during regular business hours, with the exception of employees.
All persons who appear to be thirty years of age or younger shall be required to
carry on their persons, adequate, currently valid identification of age, those
documents set forth in Colorado Liquor Code Regulation 47-128.3, while inside the
premises.
B. That at least two security guards shall be present inside the premises at all times
when alcoholic beverages are being sold or served. At least one security guard
shall be posted in the parking lot of the premises between the hours of 10:00 p.m.
and 2:30 a.m. on those nights when the Tavern is open for the sale of alcoholic
beverages. The applicant shall provide to the Weld County Sheriff's Office and the
Clerk to the Board's Office, on an ongoing basis, within thirty (30) days after hire or

employment, copies of certificates of training for all such security guards and copies
of certificates permitting all armed security guards to carry weapons.
C. That adequate lighting to provide for the safety of all patrons and employees shall
be installed and operated in the parking lot of the premises at all times.
D. That all bartenders and wait staff, present and future, shall attend the T.I.P.S.
program or similar training to learn when to stop serving alcoholic beverages to
intoxicated patrons. The applicant shall provide to the Weld County Sheriff's Office
and the Clerk to the Board's Office, on an ongoing basis, within thirty (30) days after
hire or employment, copies of certificates showing the successful completion of said
training by the present bartenders and wait staff.
E. That the tavern shall only sell alcoholic beverages during those times as
allowed by statute and/or regulation, Thursday through Sunday.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said Liquor License Renewal Application.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 27th day of January, A.D., 1999.
