TO: Board of County Commissioners July 19, 1999 COLORADO FROM: Sheri Lockman, Planner SUBJECT: Board review of a building envelope as a condition of approval to RE-2498 On June 17, 1999, the Department of Planning Services' staff approved Recorded Exemption 2498, with conditions. Condition of approval 2.A. required the applicant to propose a building envelope on Lot B to the Department of Planning Services for approval. The applicant, Mr. Robert Walker is requesting this condition be removed. Planning staff has concluded that this Recorded Exemption is a prime example of when a building envelope is appropriate. Lot B is irrigated and designated as "Prime" by the USDA Soil Conservation Service. Planning staff is proposing a moderately sized building envelope to preserve the prime farm ground. Also staff suggests that the placement take into account adequate access and the effect on the irrigation system. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Prior to recording the plat: A. Due to the prime agricultural soils on Lot B, the applicant shall submit a proposed building envelope to the Department of Planning Services for review. Upon approval by the Department of Planning Services, the building enveope shall be delineated on the plat. B. Submit evidence to the Department of Planning Services that any existing septic system(s) meets all requirements of the Weld County Health Department. The Environmental Protection Services Division of the Weld County Health Department was unable to locate a septic permit for the septic system located at 33530 Weld County Road 25. Any existing septic system(s)which is not currently permitted through the Weld County Health Department will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). In the event the system(s) is found to be inadequate, the system(s) must be brought into compliance witi current I.S.D.S. regulations. C. The septic connected to the older home to be used for storage shall be abandoned according to the Weld County I.S.D.S, Regulations. Evidence of Weld County Health Department approval shall be submitted to the Weld County Planning Department. D. Lot A shall utilize the existing residential/agricultural access points. Lot B shall utilize the existing residential /agricultural/oil and gas/ditch road access points. No circle drives or additional accesses shall be granted. E. All approved accesses shall be clearly shown on the plat. F. WCR 25 is designated on the Transportation Plan Map as a local gravel road, which requires 60 feet of right-of-way at Full build out. There is presently 60 feet of right-of-way. A total of 30 feet from the centerline of Weld County Road 25 shall be delineated on the plat as right-of-way. G. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-of-way line. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) The existing old home to be used as an accessory building shall remain consistent with the definition of Accessory Building in the Weld County Zoning Ordinance and maintain compliance with the following conditions: a) Electricity is the only utility which will be connected to the structure. b) The structure shall not be used on any basis as a dwelling or as overnight or temporary housing for any person. 4) Staff supports this application for Recorded Exemption however subsequent Recorded Exemptions on adjacent properties will raise the issue of compliance with the intent of the Recorded Exemption process,.Approval of this Recorded Exemption does not guarantee approval of future applications on adjacent properties. 5) Prior to the release of building permits on Lot B the applicant shall submit evidence to the Department of Planning Services that the lot has an adequate water supply of sufficient quality, quantity and dependability. 6) RIGHT TO FARM COVENANT Weld County is one of the most productive agricultural counties in the United States. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved Aout of the way@ of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed,will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 7) Prior tc the release of building permits on Lot A or B, the applicant will be required to submit a recorded deed describing the lot upon which the building permit is requested with the building permit application. The legal description on such deed shall include the lot and recorded exemption number. 8) Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Ordinance 169A. 3. The applicant shall su:Jmit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. Only approximately 5 acres of this parcel have been irrigated in the past. Water will not flow to this property by gravity, it has to be pumped from a holding pond. 2.) The present home is currently serviced by a septic system. 3.) The proposed parcel(A)consists of approximately 15 acres and it contains my residence along with some.outbuildings and three small fields(approximately 10 acres total). Two of those fields are pastures and one is seeded with grass that is baled twice a year. The other parcel(B)consists of approx imately 65 acres of farmland that is suitable for most of the crops grown in the area There are dirt and cement irrigation ditches located on this parcel. There are no buildings or oil producticn facilities located on this parcel. 4.) l have quit farming as my principal occupation Parcel(A)will continue to be my home. Parcel (B)will probably become a small irrigated farm with a homesite. 5.) See attached map. Proposed parcel(A)(15 acres)is located in the southwest corner of the farm and is my homesite. Proposed parcel(B)(65 acres)is located in the northwest part of the farm and is currently irrigated farmland. 6.) The proposed boundary line is a low point in the farm that divides the two areas of the farm that can be irrigated by gravity and those that can't. 7.) There is a trend in the area toward development of small farms/homesites. Subdivisions in the area include Antelope Hill,Willow Springs and Windsor Estates. One additional dwelling unit in this area Mould have minimal impact on the area as compared with the surrounding subdivisions. 11.) Same as above 12.) The property is currently zoned agriculture. Both of these parcels will continue to be used for agriculture purposes. Both parcels are located on an improved gravel road of adequate size with water,telephone and electricity available. School buses already provide service in the area and a minimal;iumber of school age children will occupy the anticipated single family residence at any given tine. 13.) Through the division of this property,the properties can be utilized to their maximum potential. The smaller parcel,which is mostly pasture ground,will probably be utilized as feed for 4-H projects. This use will allow for a more intense agricultural use of this property. At the present time it is not being utilized at all. The larger parcel will continue to be farmed as irrigated ground, which at the present time is the highest and best use for this property at this time. The City of Greeley Planning staff has reviewed the application for a recorded exemption from Robert Walker, located northeast of the intersection of WCR 70 and WCR 25 and wish to forward the following comments. Resolution 7, 1985 by the City of Greeley Planning Commission gave administrative review authority to the Gre ley Planning staff for review of recorded exemptions(RE). The resolution indicates we cannot recommend approval on any application where the overall gross density exceeds one dwelling unit per 20 acres outside of the 2010 growth ring. Since this application creates two lots through the exemption process on a 81.7 acre parcel, we can recommend approval of the request based on Resolution 7. The Greeley Public Works Department noted a reservation of a minimum of 50' of right-of-way from the centerline of WCR 70 and WCR 25 would be appropriate to facilitate future development of this area if the proposal is approved. Also, the appropriate setbacks under the applicable zone should also be maintained within the subdivision. The criteria staff indicated it would use to locate the building envelopes in this case were: (1) preserving the prime farm ground, (2) the effect on the irrigation system, and (3) adequate access. We have the following concerns: You designated the first building envelope to be located in the northwest corner of the property. At the Board of County Commissioners Hearing you indicated this site to be the most prime on the parcel. Also staff has concerns as to how the property south of this area will be irrigated since the ditch lies to the north of the proposed site. The second proposed site raises concerns about adequate access and irrigation. Please let us know how this area will be accessed and what effect the access road and building will have on the irrigation of the land opposite the irrigation ditch. If you will submit to Planning Staff how these sites do meet the criteria for the building envelope, Staff will be very happy to reconsider your choices. Otherwise staff suggests the building envelopes be relocated to the southwest adjacent to Lot A where they will not affect the irrigation of the lot. Another possibility ,if it is accessible, is in the most southerly area where you indicated is the least productive. Wiatrowski. The existing individual septic disposal system is not of sufficient size and capacity to adequately handle the proposed load. This evaluation is based on a final treatment capacity for a 3 bedroom residence. The lech field is undersized by more than 50%. This Department recommends that the system be brought into compliance with current regulations. A repair permit must be obtained and a site evaluation be conducted prior to any alterations to the system. Be advised, neither the County of Weld nor any of its agents or employees undertake or assume any liability to the owner of the above property, to any purchaser of the above property or to any lending agency making a loan on the above property or in the report. This inspection was conducted for the purpose of determining compliance with current regulations and for detecting health hazards observable at the time of inspection. This does not constitute a warranty that the system is without flaw or that it will continue to function in the future. Inspections requested during periods of snow cover and high soil saturation may be of questionable value to potential buyers due to adverse conditions. Evaluations based on Statements of Existing (S.O.E.) relies on information the property owner provides, under oath, indicating current status of the system and representing to the best of his/her knowledge the system is not failing to function properly. Condition of approval 2.A. required the applicant to propose a building envelope on Lot B to the Department of Planning Services for approval. The applicant, Mr. Robert Walker is requesting this condition be removed. Planning staff has concluded that this Recorded Exemption is a prime example of when a building envelope is appropriate. Lot B is irrigated and designated as "Prime" by the USDA Soil Conservation Service. Planning staff is proposing a moderately sized building envelope to preserve the prime farm ground. Also staff suggests that the placement take into account adequate access and the effect on the irrigation system. Thank you for your consideration in this matter. Mr Robert Walker has applied for a Recorded Exemption to divide his property into two separate legal parcels. This Recorded Exemption was conditionally approved by Weld County Planning Staff on June 17, 1999.Today, Mr.Walker and Planning Staff are asking the Board to consider Condition of approval 2.a. This Condition requires the applicant to propose a building envelope on Lot B to the Department of Planning Services for approval. The Proposed Recorded Exemption is located on 81.7 acres. Lot B is approximately 66 acres without any existing improvements. Lot A is approximately 15 acres, containing the existing residence and outbuildings.The parcel is approximately 1 1/2 miles south of Severance and 1 1/2 miles northeast of Windsor at the intersection of Weld County Roads 70 and 25. MAP Proposed Lot B is irrigated farm ground, designated as "Prime" by the United States Department of Agriculture.The parcel slopes downhill from north to south,with the irrigation ditch being on the northeast side of the property. Section 1.3.1 of the Weld County Subdivision Ordinance Proposes to Assist orderly and integrated development. Section 1.3.10 Proposes to Preserve agricultural land and promote its most productive agrarian use. Section 11.4.3 of this Ordinance allows the Weld County Planning Staff to condition Recorded ti Exemptions with Building Envelopes to carry out the intent of Section 1.3. The Weld County Planning Staff recommends denial of the request to remove Condition of Approval 2.A. Current Planning Staff consistently asks for building 4 envelopes on lots of this size located on Prime farm ground. Staff is proposing a moderately sized building envelope to preserve the prime farm ground.Also staff suggest that the placement take into account adequate access and the effect on the irrigation system. Planning Staff agrees that this Recorded Exemption is a prime example of when a building envelope is appropriate.
