RESOLUTION RE: CONFIRM MOBILE HOME PERMIT, ZPMH #1566 - CLINTON AND JULIA WAREHIME WHEREAS,. the Board of County Commissioners of Weld County, Colorado, pursuant tb Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on October 21, 1988, the Department of Planning Services staff approved Mobile Home Permit, ZPMH #1478, to be used as Temporary Storage, and in 1989 said ZPMH #1478, was replaced with Mobile Home Permit, ZPMH #1566, to be used as an Accessory to Farm. issued to Clinton and Julia Warehime, 22985 Weld County Road 61, Kersey, Colorado 80644, and WHEREAS, said mobile home is occupied in the A (Agricultural) Zone District on a parcel of land being more particularly described as follows: NANE'% and SE'ANEV4 of Section 7, Township 4 North, Range 63 West of the 6th P. The applicant shall utilize WCR 63, which is an existing section line access being extended to WCR 48, for both the existing residence and the temporary mobile home. As directed through the approved non-exclusive license agreement. no new accesses shall be granted on this property. 2. WCR 48 and WCR 63 are designated on the Transportation Plan Map as section line roads. These roads are non-county maintained. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-of-way line. 3. In accordance with Section 43.2.4.3 of the Weld County Zoning Ordinance, all zoning permits for mobile homes for use during a medical hardship are temporary and are subject to review annually on the anniversary of the original permit's issuance. Any permit for a medical hardship use shall automatically expire, and the mobile home shall be removed upon cessation of the medical hardship or at any such time as the mobile home is used for other than the permitted use. 4. The applicant shall submit documentation to the Department of Planning Services by January 1st of each year describing the status of the medical hardship. This permit is temporary and shall terminate once the medical hardship ceases to exist, at which time the applicant shall have thirty (30) days to remove the mobile home from the property. 5. On July 14, 1992, VI-1454, a zoning violation for a noncommercial junkyard, was closed by the direction of Board of County Commissioners. Any additions to the noncommercial junkyard shall be considered a violation. 6. Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Ordinance 169A. 7. Dear Mr. and Mrs. Warehime: I have scheduled a meeting with the Weld County Board of County Commissioners for Monday, April 19, 1999, at 9:00 a.m. This meeting will take place in Room 101, Commissioner's Hearing Room, Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you and/or a representative be in attendance to answer any questions the Commissioners may have. A representative from the Department of Planning Services will be out to the property a minimum of ten days prior to the hearing to post a sign adjacent to and visible from a publicly maintained road right-of-way which identifies the hearing time, date, and location. There was no promise not to pursue vio lation in the future . Basically they had a sob story about tornados (we have pictures of a blown apart shed) and their isolation and health problems and on July 14 1992 the case was closed. I will fax a copy of the closure letter. We ordinarily do not keep violation files this long but did so because of the uniqueness. My recommendation is that no vioation be pursued if it is no worse than 1992 but if they have contiued to add junk it would be approriate to pursue. I am sending to you a copy of the Termination of Easement Agreement and a copy of my letter to Mr. Brent Coen, the attorney fir Mr. & Mrs. Wwhime. Last November, we terminated the easement access to the Warehime property because the Warehimes had violated the terms of the easement agreement. Since 1964, the Warehimes or their predecessor pined access to their house over our property through a recorded easement along what would be an easterly extension of Weld County Road 48. In 1990, Mr. & Mrs. Warehime applied for a county exemption and requested that we sign an amendment to the easement agreement to permit access ibr this new home. We agreed and an amendment was filed in 1990. At that time, the Warehimes agreed that the ma7dmum number of homes to use the easement would be two, the Warehime house and the new county exemption house. Sometime since 1990, the Warehimes without our knowledge constructed the modular home which they are calling a "mobile" home. To my knowledge, this house is neither "mobile" nor"temporary". It is my understanding that the Warehimes are attempting to get this "mobile home temporary" permit so that they can apply for another county exemption. I also am sending to you an advertisement for the parcel for which the Warehimes now want another county exemption. Submit evidence to the Department of Planning Services that any existing septic system(s) meets all requirements of the Weld County Health Department. D. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Public Works Department to determine if a culvert is necessary at any approved access point. G. Lot B shall utilize the existing residential and agricultural access points. No circle drives or additional accesses shall be granted. 6) Weld County roads 48 and 63 are designated on the Weld County Transportation Plan Map as section line roads, therefore these are non-county maintained roads. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. He has continued to use Tyleiol as well as Tagamet. He has been walking with a cane. He states that he has had no significant change in function. For the last three months, however, he has had occasional episodes of severe pain into his left That. This lasts up to 30 seconds. This can occur with standing, sitting, or walking. He also notes the aching at the left thigh, especially with weather changes. Clinton was very sensitive to Tinel's testing over the left tarsal tunnel. His skin is quite sensitive along the plantar aspect to a much greater degree than the dorsal aspect of his left foot. He still has objective sequela from his RSD (trophic skin changes) and his left ankle arthrodesis. Clinton presents with his left lower extremity RSD and may have an element of tarsal tunnel syndrome on the left as well. He is also status post ORIF of the left femur fracture with some residual symptoms, and left arkle fusion. He will have to remain off work for at least another year due to his injuries sustained in his February 2, 1984, work injury. He does not wish to consider surgery as an option currently. He does have shoe inserts. I did give him a sample of topical cream that has lidocaine and indornethacin in an organogel base for Clinton to try.
