MARTIN A public hearing was conducted on September 4, 1996, at 10:00 a.m., with the following present: Commissioner Barbara J. Kirkmeyer, Chair Commissioner George E. Baxter, Pro-Tem Commissioner Dale K. Hall Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Gloria Dunn The following business was transacted: I hereby certify that pursuant to a notice dated August 14, 1996, and duly published August 22, 1996, in the North Weld Herald, a public hearing was conducted to consider the request of John T. and James I. Martin for a Major Subdivision Preliminary Plan. Lee Morrison, Assistant County Attorney, made this a matter of record. Gloria Dunn, Planning Department representative, presented a brief summary of the proposal and noted the plats have been revised to include all utility easements. She explained this Preliminary Plan is the third of four steps and has been reviewed in accordance with the revised Subdivision Ordinance. Ms. Dunn further explained the 195-acre site will consist of 52, 3-acre residential lots to be developed in 7 phases; Tract A is for open space, and Tract B is an easement for maintenance of the Speer Canal. Ms. Dunn also reviewed the irrigation, fire protection, and water and sewer proposals and clarified the public access will be from Weld County Roads 35 and 10. She stated a road maintenance agreement is required prior to final approval of the plan and staff recommends paving of the internal streets. Ms. Dunn also noted horseback riding is proposed and recommended an improvement plan and equestrian trails/easements be included. She then entered the favorable recommendation of the Planning Commission into the record as written, and noted staff received two letters of opposition; however, staff feels the Conditions of Approval will provide adequate protection. Ms. Dunn stated Condition of Approval#1.a. has been met by the applicants; therefore, it should be deleted and the remaining conditions adjusted accordingly. John Martin, applicant, stated the original plan was to build and maintain dirt roads; however, since staff recommends paving, he stated the cost of the lots will increase. He asked if the paved streets could be turned over to the County for maintenance. Responding to the Board, Ms. Dunn explained the road maintenance agreement concerns upgrading the external roads and the subdivision agreement concerns internal roads. 961546 CC. ; OL SUBD RE: HEARING CERTIFICATION - MARTIN (S #401) PAGE 2 Don Carroll, Public Works Department, explained the applicant will be requested to build the roads to Weld County standards, then they will be reinspected after one year with the applicant to make any necessary repairs before Weld County accepts maintenance. Mr. Carroll and Ms. Dunn confirmed Road 35 is not yet developed into the subdivision and Road 10 stops at Speer Canal. Mr. Martin stated he understands Roads 10 and 35 will be paved with the County's participation. Mr. Carroll suggested Mr. Martin work with Drew Scheltinga, Engineer for Public Works Department, regarding that issue. After further discussion concerning the roads and access, Mr. Martin confirmed agreement with the Conditions of Approval. No public testimony was offered concerning this matter. Ms. Dunn recommended the open-space lot be developed in a certain manner for maintenance of the ground. She suggested a development plan for improvements to the lot and equestrian trails/easements be provided for Tract A, which is to be developed in Phase One. Commissioner Harbert suggested the covenants include the requirement of maintenance on said tract. Ms. Dunn clarified the proposal should include the arena, fencing, and a safe access if used for horse riding and referenced Condition of Approval #2.m., which includes questions to be answered. She further stated an area where horse riding occurs may be difficult to maintain and keep soil from blowing. After further discussion, Commissioner Harbert moved to approve the request of John T. and James I. Martin for a Major Subdivision Preliminary Plan, based on and including the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Baxter, and it carried unanimously.
