Dear Mr. Adamek:
Thank you for the recent update on the status of your planning for the juvenile
facility in Greeley.
Understanding that you are awaiting input from the State Attorney General's
Office regarding how you might proceed with the site provided by the County, I
wish to make clear the request of the City on this matter.
As you know the Business Park area is presently zoned PUD with various
business and governmental uses permitted under the Concept Plan. While a
County jail has been envisioned for this area and the City Council recently
approved a final PUD for a new County jail, the approved Concept Plan makes
no mention of a State Correctional facility. Consequently, the PUD process
ordinarily would require the owner to make application for a change to the PUD
Concept Plan and at the same time or later request approval of a final plan.
Since the County will be having a vote on the jail and an initiative is pending in
the City to rezone the site back to its previous designation, you know any
decisions by City, County, or State are going to be controversial and in addition
to ballot measures litigation is a possibility.
Consequently, it is the City's request, regardless of whether it is legally required,
for the State to follow the local process and to abide by the decisions made in this
process.

We believe the State would be making a serious mistake to exercise any authority
it has to override local land use policies or procedures. By following local rules,
the State will stand a much better chance of establishing positive community
relations and acceptance of the project.
Many people in the Greeley area believe there is a need for the youth facility and
are interested in its location in the Greeley area. Following a process that
provides for local participation in the final decision would be good for all parties.
City Staff is prepared to work with you to move the project through the review
process as quickly as possible.
