Hall, Chairman Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter - EXCUSED Commissioner Constance L. Harbert - EXCUSED Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Todd Hodges The following business was transacted: I hereby certify that pursuant to a notice dated July 12, 1995, and duly published July 13, 1995, in the Windsor Beacon, a public hearing was conducted to consider the request of the Weld County Public Works Department, c/o Don Carroll, for a Site Specific Development Plan and Special Review Permit #1085 for a dry pit gravel mine operation in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Todd Hodges, Planning Department representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Morrison clarified similar permits have been processed as a major facility of a public utility, which does not require Board approval; however, a question has been raised and, according to Section 30-28-110, may be an issue. Therefore, staff has been directed to bring all applications of this type to the Board until a change to the Zoning Ordinance is considered by the Board. Responding to questions from Commissioner Kirkmeyer, Mr. Hodges referred to Condition of Approval #8a and confirmed a dust abatement plan has been forwarded to the Health Department, which has not yet responded. Don Carroll, Weld County Public Works Department, was present and responded that an emissions permit, as well as various other permits, has also been submitted. He stated the County has fifteen gravel pits to date, eight of which have been reclaimed and released. Mr. Carroll noted this site is in the northeast corner of Weld County, and the need for gravel is continual since there are 2,600+ miles of gravel roads in the County. He reviewed the water, sewer, operators, and equipment on site, as well as the hours of operation, noting this is a dry pit and now water is on site. Mr. Carroll stated the original access was on top of a hill and has been changed to provide adequate site distance off State Highway 71 through a State permit. He explained the mining will be done in four or five stages over ten years through a lease with Mr. Tappy. The depth of overburden material on site is fifteen feet and will be removed and reclaimed through direction of the soil conservation service. The grass mixture used for reseeding will be comparable or better than existing. Mr. Carroll stated a 32 -foot wide haul road with adequate drainage and dust abatement will be used, and wildlife will be accommodated. He noted actual operation will be only 60 to 90 days per year. No public testimony was offered concerning this matter. Responding to questions from Commissioner Kirkmeyer, Mr. Carroll stated the lease with Mr. Tappy is standard and Weld County has exclusive use of the pit. Mr. Hodges confirmed Condition of Approval #8b requiring submission of an emissions permit to the State could be deleted since it has been met. Concerning Condition of Approval #8a, Mr. Hodges reiterated the dust abatement plan has been submitted to the Health Department, but no response has yet been received. Commissioner Webster moved to approve the request of the Weld County Public Works Department, c/o Don Carroll, for a Site Specific Development Plan and Special Review Permit #1085 for a dry pit gravel mine operation in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record and the deletion of Condition of Approval #8b.
