BOX 758 ; • GREELEY, CO 80632 COLORADO November 15, 1999 Mr. Mike Livengood 40501 WCR 113 New Raymer, CO 80742 Re: Access to Property Dear Mr. Livengood: This letter is in response to your letter of November 7, 1999, in which you inquire regarding access to property located in the North Half(N'/2) of Section 7,Township 7 North,Range 59 West of the 6`" P.M., Weld County, Colorado. It is the Board's understanding that you formerly gained'access to the property in question by crossing land now owned by Diversified Operating Corporation("D.O.C."). Apparently, as of the date of your letter, you had not secured an easement from D.O.C.to cross its land. Please be advised that the Board of County Commissioners of Weld County is under no statutory obligation to provide access to landlocked properties in Weld County. Rather,the only obligation the Board is subject to regarding access is to refrain from vacating any roadway so as to leave adjoining land without an established public road or private-access easement connecting said land with another established public road. C.R.S. § 43-2-303(2)(a). In your case, no roadway adjoining your property has been vacated by the Board of County Commissioners. Any loss of access you have experienced appears to be the result of your failure to secure an easement across the D.O.C. property. Box 758 Greeley, CO 80632 Dear Weld County Board of Commissioners: As per the outcome of the November 1, 1999 meeting concerning the vacation of the section line of county road 82 west of county road 113. I am writing in request of how the commission proposes that I get to my property as it is now land locked due to the land purchase that the oil company D.O.C. had made. My family has accessed our property across what D.O.C. now owns for at least over 40 years, as we have leased that land for all that time. Your director/county engineer Frank Hempen stated at that meeting a north access of what is considered county road I 11 is impassable.
