RE: ACTION OF BOARD AT PROBABLE CAUSE HEARING CONCERNING SPECIAL
REVIEW PERMIT#650 -JOEL AND GLORIA KUGLER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on the 23rd day of February, 1998, a Probable Cause Hearing was held
before the Board to consider setting a Show Cause Hearing to determine whether or not Joel
and Gloria Kugler, 9158 Weld County Road 49, Hudson, Colorado 80642, were in compliance
with certain Conditions of Approval and Development Standards contained in Special Review
Permit#650 for a Greyhouond Kennel, and
WHEREAS, the alleged violations were said to be occurring on property described as
part of the N'/ S'% SW% of Section 18, Township 2 North, Range 64 West of the 6th P.M.,
Weld County, Colorado, and
WHEREAS, Joel Kugler was present at said Probable Cause Hearing, and
WHEREAS, Mr. Kugler stated that it is his desire to request to the Board that Special
Review Permit #650 be revoked and he intends to send a letter to the Board to that effect, and
WHEREAS, after hearing testimony from the Planning Department and Mr. Kugler, the
Board finds that pursuant to the procedure as set forth in the Weld County Administrative
Manual there is sufficient probable cause to schedule a Show Cause Hearing to consider
whether or not said Special Review Permit should be revoked for failure to comply with certain
Conditions of Approval and Development Standards, and
WHEREAS, the Board shall hear evidence and testimony from all interested parties at
said Show Cause Hearing.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that a Show Cause Hearing be scheduled to determine whether or not
Special Review Permit#650 issued to Joel and Gloria Kugler, should be revoked; however, at
the request of the Kuglers, the Board may consider the revocation of said Special Review
Permit at an earlier date, provided the Kuglers make such request in writing and said request is
received by the Clerk to the Board prior to notice of the Show Cause Hearing being mailed.
BE IT FURTHER RESOLVED by the Board that the date for the Show Cause Hearing
shall be April 27, 1998, at or about 9:00 a.m., in the First Floor Hearing Room of the Weld
County Centennial Center, 915 10th Street, Greeley, Colorado.
BE IT FURTHER RESOLVED by the Board that the issue to be considered at said
Show Cause Hearing is whether or not the permit holder is in compliance with the following
Conditions of Approval and Development Standards:

3. The applicant shall implement the approved revegetation and soil erosion control
plan prior to starting the greyhound kennel operation.
6. The applicant shall comply with the Operation Standards for Uses by Special
Review, Section 24.6 et seq., of the Weld County Zoning Ordinance.
8. The Use by Special Review area shall be limited to the plans shown hereon and
governed by the Standards as stated above and all applicable Weld County
Regulations. Any material deviations from the plans and/or Standards as shown
or stated above shall require the approval of an amendment of the Permit by the
Weld County Planning Commission and the Board of County Commissioners
before such changes from the plans and/or Standards are permitted. Any other
changes shall be filed in the office of the Department of Planning Services,
9. The property owner and/or operator of this operation shall be responsible for
complying with all of the above stated Standards. Noncompliance with any of
the above stated Standards may be reason for revocation of the Permit by the
Board of County Commissioners.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 23rd day of February, A.D., 1998.
