Dear Mr. and Mrs. Day:
This letter is in response to your e-mail that was received on August 13, 1998. All the lots in the
subdivision are Included within the Special Use Permit (SUP-264) and therefore would not be
eligible for building permits at this time. The Special Use Permit would need to be amended to
change the boundary and possibly the usc,s occurring on the property. The property owner and the
mineral owners would both be responsible for the amendment to the current permit. Mineral owners
may have a vested right to continue with the Special Use Permit currently occurring on the property.
