Thursday, July 6, 1995
A regular meeting of the Weld County Planning Commission was held July 6,1995, in the County
Commissioners' Hearing Room (Room #101), Weld County Centennial Building, 915 10th Street, Greeley,
Colorado. The meeting was called to order by Chairman, Richard Kimmel.

CASE NUMBER: Z-494 (Continued from June 6, 1995, regular scheduled meeting).
APPLICANT: John and James Martin
REQUEST: A Change of Zone from A (Agricultural) to E (Estate).
LEGAL DESCRIPTION: The SE4 NW4 and SW4 of Section 12, Ti N, R66W of the 6th P.M., Weld County,
Colorado.
LOCATION: North of and adjacent to Weld County Road 10; approximately 1/2 mile west of Weld County
Road 37.
Gloria Dunn, Department of Planning Services, requested that the case be continued to August 1, 1995,
meeting to allow referral agencies time to respond to additional information submitted to the Department of
Planning Services and allow the applicants additional time to submit requested information.
The applicant, Bill Childs, asked that the hearing be delayed until the July 18, 1995, meeting, he felt that this
would be adequate time for them to be ready and feels the case has been postponed long enough.
Karen Frock, surrounding property owner, asked that they not give the applicant any more time.
Bud Clemons moved that Case Z-494 be continued to the August 1, 1995, Planning Commission meeting.
Judy Yamaguchi seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Ron
Sommer, yes; Curt Moore, yes; Judy Yamaguchi, yes; Jack Epple, yes; Marie Koolstra, yes; Bud Clemons, yes;
and Richard Kimmel, yes. Motion carried.
CASE NUMBER: S-380 (Continued from June 20, 1995, regular scheduled meeting).
APPLICANT: Tri-City Ventures, L.L.C
REQUEST: Minor Subdivision Final Plat.
LEGAL DESCRIPTION: Lot A of RE -1610, located in part of the NW4 of Section 8, T5N, R67W of the 6th
P.M., Weld County, Colorado.
LOCATION: South of and adjacent to Weld County Road 60; approximately 1/4 mile east of Weld County
Road 15.
Jeff Perryman, applicant, spoke in favor of the application, stating that he was in agreement with staff
recommendations.

Gloria Dunn, Department of Planning Services, gave a brief overview of the application. Existing zoning is E
(Estate), proposed use is for six rural residential lots, and one common open space out lot to be used for a
duck pond, trails for horseback riding, biking and walking. Parcel size is 20 acres. There are two proposed
accesses, each access serving three lots.
The Chairman asked if their was anyone in the audience who wished to speak for or against the application.
No one wished to speak.
Ron Sommer moved that Case S-380 be forwarded to the Board of County Commissioners with Planning
Commissions recommendation for approval. Bud Clemons seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Ron
Sommer, yes; Curt Moore, yes; Judy Yamaguchi, yes; Jack Epple, yes; Marie Koolstra, yes; Bud Clemons, yes;
and Richard Kimmel, yes. Motion carried.
CASE NUMBER: USR-1085 (Continued from June 20, 1995, regular scheduled meeting).
APPLICANT: Weld County Department of Public Works, do Don Carroll
REQUEST: A Site Specific Development Plan and a Special Review permit for a gravel pit in the A
(Agricultural) zone district.
LEGAL DESCRIPTION: Located in Section 19, T10N, R56W of the 6th P.M., Weld County, Colorado.
LOCATION: Approximately 1/2 mile south of Weld County Road 116; east of and adjacent to State
Highway 71.
Don Carroll, applicant, gave an overview of the application explaining what they had planned for the proposed
gravel pit and surrounding the site.
Todd Hodges, Department of Planning Services, recommended approval.
The Chairman asked if their was anyone in the audience who wished to speak for or against the application.
No one wished to speak.
Jack Epple moved that Case USR-1085 be forwarded to the Board of County Commissioners withiPlanning
Commissions recommendation for approval. Judy Yamaguchi seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Ron
Sommer, yes; Curt Moore, yes; Judy Yamaguchi, yes; Jack Epple, yes; Marie Koolstra, yes; Bud Clemons, yes;
and Richard Kimmel, yes. Motion carried.
CASE NUMBER: Amended USR-778
APPLICANT: Public Service Company of Colorado.
REQUEST: A Site Specific Development Plan and a Special Review permit for a Major Facility of a Public
Utility (expansion of an existing blend plant) in the A (Agricultural) zone district.
LEGAL DESCRIPTION: Located in the NW4 of Section 34, T1N, R67W of the 6th P.M., Weld County,
Colorado.
LOCATION: South of and adjacent to Weld County Road 4; east of and adjacent to Weld County Road 19.
Todd Hodges, Department of Planning Services, stated that this was an existing facility, and the application
was for a 1.8 acre addition to the property and expansion of the existing facility. He also stated that a
Subdivision Exemption application would be necessary for the 1.8 acre addition. Mr. Hodges stated that staff
is recommending approval.
Jim McClung, applicant, stated that he was in agreement with staff recommendations. He also has submitted
a subdivision plat. Mr. McClung also stated that they were not adding any new fixtures or flows.

Ron Sommer moved that Condition of Approval #3a be changed to say: The applicant shall demonstrate to
the Weld County Health Department that the existing septic is adequate to handle any additional flow. Jack
Epple seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Ron
Sommer, yes; Curt Moore, yes; Judy Yamaguchi, yes; Jack Epple, yes; Marie Koolstra, yes; Bud Clemons, yes;
and Richard Kimmel, yes. Motion carried.

Planning Commissions recommendation for approval. Bud Clemons seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Ron
