The Weld Cou y g iV nt has reviewed this proposal; the following requirements are
recommended to be a part of any approval:
COMMENTS:
The proposed location of the sand and gravel operation is within the Mixed Use Development area so all standards
will apply. WCR 20.5 is designated on the 1-25 Mixed Use Development Area Structural Plan Map 2.2, Structural
Transportation Network, as a four-lane undivided-secondary road (refer to Figure 2.10 of the Mixed Use
Development Standards). This section of road requires 100 feet of right-of-way at full build out, there is presently
60 feet. The applicant is responsible for one half of the total build out. WCR 7.5, the new one half mile road that
is being built to relieve the 1-25 frontage road traffic, is adjacent to the proposed sand and gravel operation. The
applicant is indicating 100 feet of future right-of-way to accommodate this expansion. In referring to the
Development Standards, this section of road is designated as a four-lane arterial with raised median and, as per
Figure 2.10, 110 feet of right-of-way is required. The applicant will be required to proovide one half of this typical
cross section which will be 55 feet on their side of the half section line (WCR 7.5).
WCR 20.5, east of WCR 7 (the Rinn area), is designated on the Weld County Transportation Plan Map as a local
gravel road.
On WCR 20.5, between the Rinn intersection (WCR 7) and the proposed gravel pit operation, there is a restricted
bridge over the rural ditch. This bridge restriction reads 17-27-32. The width of the bridge deck measures between
25 and 26 feet and the decking is wood. The existing road through this location measures 24 feet in width and is
designated as a local county gravel road. I spoke with Dale Elliot, Supervisor of the Weld County Bridge
Department. This restricted bridge is scheduled for replacement in the fall of 1998 or early spring of 1999. The
replacement bridge will be a legal posted bridge with a width of approximately 32 feet which will accommodate the
designated haul route.
REQUIREMENTS:
An additional dedication of 55 feet will be required on the north-south property line at WCR 7.5. There will be a total
of 110 feet of right-of-way for the arterial/four-lane raised median cross section when the adjacent property ,
develops.
WCR 20.5 is designated as a four-lane undivided secondary road requiring 100 feet of right-of-way, there is
presently 60 feet. An additional 20 feet of right-of-way will be dedicated for future widening.

The applicant should enter into a Road Maintenance Improvements Agreement with Weld County Public Works
for upgrading and paving WCR 20.5 due to the heavy hauling. A designated haul route will be established within
the Improvements Agreement. The applicant should agree to work with all the other heavy haulers in the area to
utilize and repair the designated haul routes that will serve the facilities in the Rinn area.
In Item #8 of the Use by Special Review Application, the operator is indicating that, once the mining operation has
been completed and reclaimed, he will apply for a Weld County PUD for residential lots. At that time, WCR 7.5 and
WCR 20.5 will be upgraded to meet the PUD cross section. The applicant will be responsible to build half of the
expansion at both locations.
The applicant should not exceed the legal load limits across the restricted bridge. This section of road will be
identified as a part of the main haul route.

Environmental Protection Services has reviewed this proposal; the following condtions are recommended
to be part of any approval:
1) All liquid and solid wastes shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
2) No permanent disposal of wastes shall be permitted at this site.
3) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
4) Fugitive dust shall be controlled on this site.
5) A dust abatement plan shall be submitted to the W.C. Health Department for approval prior to
operation. The facility shall have sufficient equipment available to implement the dust control
as required by the W.C. Health Department.
6) An Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application must be
submitted to the Air Pollution Control Division, Colorado Department of Health for emissions
of criteria, hazardous or odorous air pollutants. Sources of such emissions include but are not
limited to the following: sandblasting operations,mining, spray paint booths, dry cleaners, haul
road traffic, composting, boiler, and incinerators.
7) The applicant shall remove, handle, and stockpile overburden, soil, sand, and gravel from the
facility area in a manner that will prevent nuisance conditions.
8) The operation shall comply with all applicable rule and regulations of the Colorado Division of
•
Minerals and Geology.
9) The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) as
measured according to 25-12-102, Colorado Revised Statutes.
10) An individual sewage disposal system, is required for the proposed office and shall be installed
according to the Weld County Individual Sewage Disposal Regulations. The septic system is
required to be designed by a Colorado Registered Professional Engineer according to the Weld
County Individual Sewage Disposal Regulations. A vault system would be acceptable.
II) A NPDES Permit shall be obtained from the Water Quality Control Division of the Colorado
Department of Health for any proposed discharge into State Waterways.

12) Drinking water on the site shall be supplied by bottled water.
13) The operation shall comply with the Mine Safety and Health Act (MSHA).
14) The operation shall comply with the Occupational Safety and Health Act(OSHA).

Dear Ms. Ballstadt:
I have reviewed the submitted material pertaining to the Development Plan and Special Use
Permit for the Kobobel property (Case Number: USDR-1194), located north of Weld County
Road 20.5 and east of Weld County Road 7. The proposed gravel operation is within the
boundaries of the Mountain View Fire Protection District and receives service from the District.
The Fire District has no objections to the project if the requirements of the District can be met.
The Fire District has adopted the 1994 Edition of the Uniform Fire Code and the activities of the
gravel operation will be covered by this Code. The principal applications of the Code to a gravel
operation will be for tank installations for flammable or combustible liquids, fueling operations,
vehicle repair, welding, and any use of hazardous materials. Tanks installed for flammable or
combustible liquid storage or dispensing, either temporary or permanent, need to be installed in
accordance with the requirements of the Uniform Fire Code and plans for the installation must be
reviewed and approved by the Fire District prior to installation.

Dear Scott:
Thank you for referring the Kobobel Pit Site Specific Development Plan and Special Review Permit for a Sand and
(;ravel mining operation in the A (Agricultural) zone district to the School District for review. Although there may
future residential uses after reclamation it appears that this application is solely for a mining operation.
Without a residential component there would be no impact to the School District, thus, the School District would not
be in opposition to this proposal. At the time when future plans are submitted for residential lots the District will
review the student impacts and the cash-in-lieu requirements. Students from any future residential unit in this
area would attend Mead Elementary, Mead Middle and Skyline High Schools under the current attendance boundaries.
The capacity and enrollment information for the schools is identified below:

In response to the Referral of the above case, I would like to bring to your attention the
following:
1. Error is found in the application: the trucks will proceed west on C20-1/2 to CR7, not
east as stated.
2. The primary haul route is stated to be "north to State Highway 119". This should be
confirmed, as it adds 2 miles and passage through the congested Del Camino-I25
interchange for any loads destined for the Metro-Denver area.
3. Consideration should be given for the applicant paying for the paving of CR20-1/2 and
maintenance of CR7, given the amount of heavy truck traffic that will be generated by this
project.
4. It is not too early to establish what type of residential development would be permitted,
if any, given the rural nature of the area.
5. Scaling from the "Kobobel Property Floodplain Map", it appears that the subject
property includes the right of way for the future CR7-1/2. It would be logical to require
the applicant to dedicate land for this ROW at this time in order to avoid future
condemnation costs to acquire said ROW.
6. Based on Weld Co.-I25 Mixed Use Development Area Structural Plan Map 2.1, the
100 year flood plain crosses the property, which is not indicated on the Kobobel Property
Flood Plain Map [re: any future residential development].
7. I assume the Rural Ditch Co. has been advised of the applicant's plans and that Referral
letters have been sent to them by the County.
8. I trust the County will monitor the conditions under which this operation is conducted
to protect the health, peace, safety and welfare of the area residents.
I hope the above comments will be of assistance to County government in reviewing this
application. I appreciate Referrals being sent to the St. Vrain Rural Impact Group so area
residents have the opportunity to comment on applications for developments.
