THE UNDERSIGNED, being first duly sworn, deposes and states that to the best of her
knowledge the following is a true and accurate list of the names and addresses of all mineral owners
and lessees of mineral owners on or under the above described parcel of land as their names
appear in the records of the Weld County Clerk and Recorder based on an examination of the tract
books and computer index of Transnation Title Insurance Company of Greeley current through
November 12, 1997 at 7:45 a.m.:

NOTE: There was an oil and gas lease which covered the above-described lands
which was pooled into a unit comprised of the EY:SW%of said Section 11, and which
was once held by production from the Caesar#4-11 well in the SE%SW% of said
Section 11. This lease was extinguished by the foreclosure of an unsubordinated,
senior deed of trust. The Caesar #4-11 well is currently operated by Summit
Petroleum Corporation, but is owned by various different working interest owners.
Furthermore,the pooled 80-acre unit has been segregated by the working interest
owners into two separate 40-acre units. Therefore,the leasehold owners("lessees")
of the NE%SW%differ from the leasehold owners ("lessees") of the Caesar#4-11
well in the SE'/.SW/. Nevertheless,for purposes of this report(which is based on
an examination of the real property records)there is no valid oil and gas lease which
covers the concerned lands as a result of the f closure of the prior deed of trust.
