HomeMy WebLinkAbout960745 HEARING CERTIFICATION DOCKET NO. 96-17 RE: INTENT HEARING TO CONSIDER CREATING LOCAL IMPROVEMENT DISTRICT#1995-2 - DELWOOD AVENUE A public hearing was conducted on April 24, 1996, at 10:00 a.m., with the following present: Commissioner Barbara J. Kirkmeyer, Chair Commissioner George E. Baxter, Pro-Tern Commissioner Dale K. Hall Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Public Works Department representative, Drew Scheltinga The following business was transacted: I hereby certify that a public hearing was conducted to consider the creation of a local improvement district on Delwood Avenue within Lindale Subdivision. Lee Morrison, Assistant County Attorney, made this a matter of record and noted informal notice was mailed to all property owners and publication will follow if the Board declares the intent to create said district. He also stated, in compliance with Amendment One, this issue was approved on the ballot for the election in November 1995. Drew Scheltinga, Engineer for the Public Works Department, stated 17 of 17 lots, or 100 percent, petitioned in favor of the district. Using overhead displays marked as Exhibit E, Mr. Scheltinga presented a summary of the proposal indicating Delwood Avenue between East 18th Street and U. S. Highway 34 in Lindale Subdivision is to be improved with 2 inches of asphalt pavement, 54-foot wide; and 4 inches of aggregate base course, but no curb and gutter since it was not desired by the district. He said there are severe flooding problems in the area, and he has clarified for the owners at the culdesac where the water usually stands that reshaping to drain toward the ditch on Highway 34 will improve the situation, but the problem will not be eliminated. Mr. Scheltinga stated the total cost estimate is $33,320.00, with assessments of$1,960.00 per lot, and he reviewed the table of estimated payments over ten years at 6.25-percent interest. He clarified one letter supporting the district, Exhibit D, was received. Chair Kirkmeyer noted 15 voted in favor of the district and one voted against. Responding to a question from Commissioner Webster, Mr. Scheltinga stated the drainage problem is physically impossible to eliminate, but it can be mitigated. Jim Hampton, property owner, voiced concern about already high speeds increasing on 18th Street and the safety of the children. Mr. Scheltinga clarified the County does not normally install such signs and questioned whether driving habits will actually change. Commissioner Harbert suggested Mr. Hampton contact the Board after the streets are paved if there are substantial changes. Chair Kirkmeyer noted for the record the speed limit on East 18th Street is 30 mph as indicated by the audience. Mr. Scheltinga requested the Board authorize staff to proceed with the bidding process along with Roth Subdivision to keep costs lower. Commissioner Hall moved to declare the Board's intent to create the district, direct staff to prepare construction plans and cost estimates, authorize the bidding process simultaneously, and set the creation hearing for June 5, 1996, at 10:00 a.m., as set forth in the draft resolution.
