Health Department COLORADO CASE NO.: USR-1206 NAME: Andesite Rock Company Environmental Protection Services has reviewed this proposal; the following conditions are recommended to be part of any approval: 1) All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2) The existing Emission Permit must be modified for the increased operation if the Colorado Department of Health determines that such a modification represents a significant change in emissions or production. 3) No permanent disposal of wastes shall be permitted at this site. 4) Waste materials shall be handled,stored,and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 5) The maximum permissible noise level shall not exceed the industrial limit of 80 db(A)as measured according to 25-12-102, Colorado Revised Statutes. 6) Adequate toilet facilities shall be provided for the employees. 7) The existing NPDES Permit must be amended for the increased operation if the Water Quality Control Division of the Colorado Department of Public Health & Environment determines that such a modification represents a significant change in the discharge. 8) A dust abatement plan shall be submitted to the W.C. Health Department for approval prior to operation. The facility shall have sufficient equipment available to implement the dust control as required by the W. C. Health Department. 9) The applicant shall remove,handle,and stockpile overburden , soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 10) The facility shall utilize bottled water for employees. This project falls primarily under purview of the Weld County Mixed Use Development Area (MUD) and the Use by Special Review Standards. Our requirements are as follows: 1. WCR 7.5 extended: The MUD Structural Transportation Network Map 2.2 identifies this roadway as a two-lane Collector Status road. The review is based on an equivalent two-lane with painted median. A. Currently there is no right-of-way. We require 80 feet of right-of-way be dedicated to accommodate full build out. B. This road shall be realigned to match WCR 7.5 south of State Highway 119. Any offset intersections should be avoided. C. The applicant should designate the 80 feet of right-of-way across the proposed mining property on the plat. 2. WCR 24.5: The MUD Structural Transportation Network Map 2.2 identifies this road as a two-lane Collector with painted median. A. Current right-of-way is 60 feet. The developer shall dedicate an additional 10 feet which will represent one half of the ultimate width requirement. 3. Setbacks: All mining setbacks shall be based on future rights-of-way. A. All rights-of-way, future dedicated rights-of-way, and setbacks shall be placed on the plat. 5. Long-Term Road Maintenance and Improvements Agreement: The applicant shall enter into a Road Maintenance Agreement with Weld County Public Works Department for this USR location. A. All sand and gravel operators shall utilize the designated haul routes within the MUD area. Access: The applicant is indicating that the main access will be onto State Highway 119. The State of Colorado has jurisdiction over all accesses to the State Highway System. The Fire District has no objections to the project if the requirements of the District can be met. The Fire District has adopted the 1994 Edition of the Uniform Fire Code and the activities of the gravel operation will be covered by this Code. The principal applications of the Code to a gravel operation will be for tank installations for flammable or combustible liquids, fueling operations, vehicle repair, welding, and any use of hazardous materials. Tanks installed for flammable or combustible liquid storage or dispensing, either temporary or permanent, need to be installed in accordance with the requirements of the Uniform Fire Code and plans for the installation must be reviewed and approved by the Fire District prior to installation.
