Mary Ann Eeuerstein, Recorder / —/ RESOLUTION WHEREAS, a public hearing was held on Thursday, December 11, 1969, at 10:30 a. m. in the Chambers of -the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of -Raymondtarson, 2305 10th Street, Greeley, Colorado, requesting a change of zone from "A" _agricultural District to "E" Estate District, and WHEREAS, petitioner was present, an WHEREAS, there was no one present in opposition to the change of zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements from those present, and WHEREAS, the Board of County Commissioners has studied the request of the petitioner, and studied the recommendation of the Weld County Planning Commission as submitted October 21, 1969, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS that the petition of Raymond Larson, 2305 10th Street, Greeley, Colorado, for a change of zone from "A" Agricultural District to "E" Estate District, s -aid area being more particularly described as follows: A tract of land located in the North Half of the Northeast Quarter (NZNE4), -Section 2, Township 5 North, Range 66 West of the 6th P. Mr. Anderson: We will call this meeting to order Docket Number 26 dated December 11, 1969 at 10:30 A. M. This is a change of zone from "A" Agricultural District to "E" Estate District, at this time Mr. Telep will you make the record? Mr. Telep: Thank you Mr. Chairman, Let the record show that this cause came on for a hearing this day, December 11, 1969, at 10:30 A. M. Let the record further show that the petitioner Raymond Larson of 2305 Tenth Street, Greeley, Colorado, is present petitioning for a change of zone for a parcel of land from "A" Agricultural District to "E" Estate District of a tract of land located in the North Half of the Northeast Quarter of Section 2, Township 5 North, Range 66 West of the 6th P. M., Weld County, Colorado, and more particularly described in metes and bounds as contained in the notice that was duly published as required by law in the Greeley Booster on November 7, and 28, 1969. Let the record further show that the petitioner is present in person. Let the record further show that there is on file a resolution of the Weld County Planning Commission recommending favorably as to this change of zone. For the record the Planning Commission states further that this petition and use meets the zoning regulations and it is merely an approval of a present non -conforming use. Mr. Chairman, let the record further show that there is no person present in the room, consequently we must assume that there is no present here either in favor or against the granting of this petition. I believe we are ready to proceed Mr. Chairman. Mr. Anderson: Mr. Larson do you have anything for the record? (2) Mr. Larson: Mr. Telep: Mr. Larson: Mr. Telep: Mr. Larson: Mr. Telep: I believe not? Would you state your name and address. Raymond F. Larson of 2305 Tenth Street, Greeley, Colorado. You are the petitioner for this change of zone? Yes. In your own words would you like to explain just a little bit further to the Board why you want this change of zone and any facts that are peculiar to the nature of this change. Mr. Larson: This is just the second filing you might say of the preliminary plat that was approved in 1963, I think that is the right year. At that time it was all approved - the preliminary plans and the only reason we didn't take the second half in was on account of taxes - taxes were the reason I didn't do it. We tried it once before but we didn't get all the property owners in the area to sign the petition. So this is why I am back I have all the signatures and I have talked to all of them and they are tn favor of it. Mr. Anderson: This is out on West 5th Street, isnt' it? Mr. Larson: Yes. Mr. Harold Anderson: Fourtieth? Mr. Larson: Yes Fourtit^.,Avenue Mr. Anderson: Extended North? Mr. Larson: To the east. Mr. Anderson: At this time is there anyone in the room opposed to this application? Is there anyone in the room for the application? Let the record show that Mr. Larson is for the application. Is there anymore to come before this hearing? Mr. Billings: Mr. Chairman, since there is no one here against the request to change this from "A" Agriculture to "E" Estate District - there is no objection from the Health Department as to meeting the specifications I hereby move we approve the change of zone from "A" Agriculture to "E" Estate. (3) Mr. Harold Anderson: I will second the motion. Marshall Anderson: I will make it unanimous, with that we will declare the meeting closed.
