RE: APPROVE DONATION OF RIGHT-OF-WAY AND AUTHORIZE CHAIR TO SIGN -
STATE HIGHWAY 119 AND I-25
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution #961963 dated November 4, 1996, the Board approved a
Memorandum of Agreement for Temporary Easement at the Interchange of State Highway 119
and 1-25, with the Colorado Department of Transportation, and
WHEREAS, the Board has been presented with a Donation of Right -of -Way between
the County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Department of Public Works, and the Colorado Department of
Transportation, concerning said easement, and
WHEREAS, after review, the Board deems it advisable to approve said donation, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Donation of Right -of -Way between the County of Weld, State
of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of
the Department of Public Works, and Colorado Department of Transportation, be, and hereby
is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said donation.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 10th day of February, A.D., 1997.

DONATION OF RIGHT-OF-WAY
The undersigned, have been advised that we could receive just
compensation for the temporary easement described as Exhibit "TE-1"
that is being acquired by The Colorado Department of Transportation
to construct the extension of culvert pipes into the existing Weld
County gravel pit lake.
We do not wish to receive just compensation but do wish to donate
the area necessary for the construction as described in Exhibit
"TE-1".
It is understood that any changes in the plans, adverse to our
property, will make this agreement null and void.
