Mr. Webster,
We are writing this letter regarding case number USR-1074. Our property is located
within five hundred feet of a proposed excavation business in the Agricultural zone district.
This proposal has been filed by Larry, Stacy, and Kerri Differ. We were unable to attend
the hearing on 21 February 1995, but we do plan to attend the hearing in April.
We are strongly opposed to this Special Use permit. Our primary reason is a potential
decrease in property value related to business zoning versus residential and agricultural
zoning. This proposed business will contain and store heavy machinery such as earth
movers, trucks, trailers, and backhoes and increase the number of buildings on the
property. We believe this will greatly decrease the aesthetic appeal of the area.
We are first time homeowners as of November 1994 and have made a major financial
investment in our property over a long period of time. After much searching and
researching the real estate market, we made a conscious decision based on the concept of
purchasing our home in an area zoned agriculturally, and an area we believed would
remain agricultural. In no way do we believe this permit should be granted.
It is not fair to any of the thirty-one homeowners in Pinnacle Park for the Differ family to
profit from their business at our expense - not to mention the homeowners in the Seeley
Lake area.
Our secondary reason for objecting to this permit would be concerns over increased traffic
and noise on US Highway 392 and Weld County Road 35. This business would increase
traffic, noise, and dust, while decreasing safety at that intersection. The large equipment
would also cause the roads in this area to deteriorate at a more rapid rate. The large piles
of dirt would seem like an attractive, yet dangerous, playground for neighboorhood
children. We understand that the Differs' business is also based at another location. We
would request that it stay in that area.

As far as we are aware, Pinnacle Park is unique in that the covenants required log homes
and a certain amount of acreage. This makes for a beautiful area outside of the Greeley
city limits. We believe we speak for our community as well as ourselves when we say it
would be extremely disheartening to allow the beginning of the destruction of this area by
granting this permit. Once again, we strongly urge you and your fellow commissioners to
deny this Special Use permit for a business.

EXCAVATION AT COUNTY RD 35 & HWY 392.
I am writing this letter to express mine and my wives
concern about Ditter Excavation proposal for a special use
permit. I live in Pinnacle Park, just north of where
Ditters want to do business.
I moved to Pinnacle Park because it was a rural setting like
I grew up in and that does not include an excavation
business. If the Ditters get this permit and put up shops
to work on equipment or clean out trucks I believe that will
detract from the housing addition. I also believe that the
business will lower my property value and make it
unattractive to potential buyers.
The added traffic that will be created by the trucks and
machinery will make this a hazardous intersection. We have
already had numerous accidents at WCR 35 & HWY 392.
I hope you do not approve this special use permit.

My husband. Carl. and I purchased land in Pinnacle Park sixteen years
ago and built our home with our own hands. because we liked the quiet.
solitude. and clean air of country living.
We are concerned about the ayol icat.ion of a use -by -special review
permit by the Ditt.er family. for property located at the intersection
of County Road 35 and Colorado 392. Such use will cause an increase in
traffic on an already over burdened Colorado 392 as well as a hazard
for the intersection of WCR 35 and Colo. 392 and a hazard for
residents of Pinnacle Park when entering and leaving.
The noise. dust and pollution will increase and our property values
will decrease.
Please. vote against this use -by -special review permit.

Bill and I have been Pinnacle Park homeowners since 1976. We moved
to Weld County for a quality of life that includes clean air, quiet
and open space.
We are very sorry that Mr. Ditter has applied for a variance in
Weld County for excavation and a commercial operation that will
depreciate the estate value of Pinnacle Park, as it will bring
noise , congestion, traffic, dust and lack of esthetics to our
neighborhood.
We are opposed to this short sighted use of agricultural zoning.

We are contesting the request for a special use permit of an
agricultural area to an excavation business.
We question whether this change complies with the long range
comprehensive plan for Weld County and what effect this change will
have on the value of the surrounding properties. This land is between
two subdivisions with the value of homes between $200,000 and $500,000.
The additional traffic of trucks,loaders,backhoes and pickups, leaving
and entering highway 392 present a dangerous access. There would also
be a traffic hazard if access were allowed off of road 35.
The present occupants of this land have established a motor bike
raceway and a firearms shooting range. Are these to be included as
part of the special use permit?
We believe the request for a special use permit should be denied,and the
excavation business be moved to a less dangerous industrial location.

Dear Mr. Hodges,
I recently heard of the proposal request for zoning change from agriculture to
industrial at Weld County Road 35 and Colo, Highway 392, I strictly oppose any change
within the zones. The truck traffic on Hwy. 392 is presently heavy, and very busy on this
narrow, shoulder -less two lane road. The north and south bound traffic is also vigorous and
makes the intersection between Hwy. 392 and WCR 35 unsafe. I strongly oppose increasing
truck traffic at this intersection. Zoning change would complex an already growing problem
in our peaceful area. I strongly urge you to deny the request.

Dear Mr. Hodges,
I have recently learned that a request has been made to rezone the
property on the SW corner of WCR 35 and Hwy. 392 from agricultural
to industrial.
As a resident of this area I strongly oppose any rezoning to industrial
purposes. 1) This location is unsuitable and dangerous for any
increased heavy truck traffic. As a resident of Pinnacle Park, and a
past member of the Eaton Fire Department, I can testify to numerous
accidents and near misses involving trucks, cars, bicyclists, equestrians,
and farm equipment. There is no easy access on or off the property and
any increase in truck traffic would make this busy intersection even
more dangerous for the Hwy. 392 traffic and residents of the area.
2) This location is unsuitable for industrial purposes as it sits in
the immediate area of both residential and agricultural properties. Over
the years this area has evolved into a neighborhood with many fine homes.
We do not want our properties degraded and subjected to the abuses that
could come with industrial zoning. This could adversely affect property
values and in turn property taxes. There are many other fine underutilized
industrial areas in Weld County. Let's not add more industrial zones
by taking land away from more valuable rural residential and agricultural
eG.
As a resident who wants to maintain the quality of our area, I urge you
to deny any request for rezoning to industrial purposes.

To Whom It May Concern:
This letter is written in regards to the Deeter property on the
southwest corner of 35th Avenue and Colorado Highway 392.
I understand that the Deeters requested permission to park
equipment used in their excavating business (backhoes, trucks, etc.) on
their property. It is also my understanding that this permission may be
denied based on the concern of several neighboring property owners.
My husband and I have resided within 1/2 mile of the above -
mentioned property since August 1993. Since the Deeters have
purchased the property this summer, we have seen only improvements in
the appearance and maintenance of the buildings and land, even with the
equipment parked there. Thus far, they have shown more discretion
parking their equipment in an orderly manner than some area property
owners have displayed with their vehicles and recreational equipment.
I do not want an industrial park within 1/2 mile of my house either;
however I find it difficult to believe that the Deeters hope to transform their
homesite into such a place. Instead, I believe that they are entrepreneurs
avoiding extra business costs whenever possible. As long as they
continue to keep the property in its present good condition, I have no
objections to the equipment parked there, and thank them for cleaning up
property that was an eyesore a year ago.
