RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST HOWARD AND ELAINE BINDER FOR VIOLATION OF THE WELD
COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Howard and Elaine Binder, VI #2227, are allegedly in violation of the Weld
County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of November, 1995, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Howard and Elaine Binder, property owners, were not present or represented
at said hearing, although all parties were notified of said hearing by Department of Planning
Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals as
hereinabove named to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Howard and Elaine Binder to remedy the violation of the Weld County Zoning
Ordinance, and any other persons occupying_theproperties, any persons claiming an interest in
the properties, and any persons acting in active concert with the identified parties.

Letter sent to property owner indicating that the violation case was
scheduled before the Board of County Commissioners.
Talked to Bruce Barker concerning the easement. The matter is between
the two property owners.
A mobile home without a Zoning permit is a violation of Section 31.2, 31.2.16 and Section 43 of
the Weld County Ordinance. To correct the violation the mobile home needs to be removed or

the proper zoning permit needs to be obtained from the Department of Planning Services.
The Department of Planning Services also recommends that the County Attorney be authorized
to proceed with legal action against any other persons occupying the properties, any person
claiming an interest in the properties, and any persons acting in active concert with the
identified parties.

Dear Howard and Elaine Binder,
The property referenced above remains in violation of the Weld County Zoning Ordinance. I
have scheduled a meeting with the Board of County Commissioners on November 14, 1995 at
10:00 a.m. to consider the Zoning Violation occurring on your property. This meeting will take
place in the County Commissioners' Hearing Room, first floor, Weld County Centennial Center,
915 Tenth Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the
violation.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation, the
action necessary to correct the violation, and that you were given sufficient time to remedy the
violation. The property will be reinspected November 13, 1995.

A mobile home without permits is not a use allowed by right in the Agricultural zone district. If the
mobile home is no longer being used as an accessory to the farming operation the original permit is
vacated.
The violation can be corrected by removing the mobile home or by applying for and getting approval of a
mobile home zoning permit.
It is the intention of this office to assist and cooperate with you without imposing undue hardships:
however, we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty)
days from September 7, 1995 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the

I represent Donna J. Hanes, who resides at 17151
Weld County Road 22. Her property is adjacent to a
138 -acre dairy from which her property was partitioned in
1984. The partition was done by Subdivision Exemption
227 (dividing the dairy into Parcels 1 and 2, Parcel 1
being the dairy), and Recorded Exemption 712 (dividing
Parcel 1 into Lots A and B, Lot B being the dairy; Donna
purchased Lot A). Both exemptions were approved by
Resolution of the County Commissioners.
Her legal access is via a 30 -foot access easement
along the west side of Lot B, the dairy. That easement
was also recorded in RE712 and clearly shown on the
recorded maps. Unfortunately, the Lot B owners have
erected two semi -permanent structures in the middle of
the easement and refuse to remove them. This was
apparently done without any permit or permission and
disregarding the deeded easement. Ms. Hanes has been
forced to file a lawsuit to enforce her easement. It has
not yet been set for trial.
Since Lot B is subject to SE 227 and RE 712, can the
County require the owners (by order or injunction or
other penalty) to remove the obstructions from the
subdivision easement? Should the owners have obtained
permits, since Lot B is subject to RE 712? Is there any
documentation or other assistance which we could provide
you? Also, it has been suggested that the parties could
simply agree to move the easement: Is that possible
under these facts without going through the Recorded
Exemption procedure and obtaining and filing a new
exemption?

Lot B, known as 17171 Weld County Road 22, is
currently owned by Howard and Elaine Binder but is not
being operated. Its farmhouse is rented out. A
doublewide mobile home is empty. The pasture land is
apparently leased. The doublewide has been empty since
January 1995 and in any case there is reason to believe
there was no temporary use permit obtained. Even had
there been a permit, the doublewide has been unused for
over six montns. Ms. Hanes has therefore asked me to
request that you have this doublewide removed under
ordinance 46.2.3.4.

As we discussed on Tuesday, June 20, 1995, on the telephone, I am enclosing the
procedure Ms. Hanes should follow in order to disinfect her drinking water well.
I would recommend that Ms. Hanes have her well water analyzed for bacteria prior
to disinfection. Our Department can run that test for $6.50. If that test
indicates bacteria in her well, then she should disinfect and then resample to
assure that it has been properly disinfected.
In regard to the manure on the Binder Dairy, you have indicated that the owner
is currently attempting to remove the manure. As we discussed, agricultural
wastes are not currently regulated in Colorado. Therefore, given that the manure
is being removed and lack of authority to regulate, our Department will not
pursue this issue.
Julie Chester of the Weld County Planning Office has observed the site and is
researching applicable building permits, etc. I would recommend you contact her
regarding the issue of buildings on the property and whether any of these
buildings have been condemned are uninhabitable or need permits. She can be

DISINFECTION OF WATER WELLS
Your water supply is unsuitable for human consumption. The water contains coliform bacteri,
which is an indicator organism used to detect fecal pollution. Before this water can be use
for human consumption the following steps should be taken and the water retested to ensur
potability.
1. The water supply should be thoroughly inspected to determine any sources of contamination
Your pump installer or a health department representative can assist you. Any deficiencie
should be corrected.
2. After every possible contamination source has been eliminated, the water supply should b
disinfected as follows:
a. Add 1 gallon of 5% available chlorine household bleach. (Purex, Clorox, etc.) to 1(
gallons of water and introduce into the well, between the well casing and pump dro;
line.
). Start the pump and open all faucets on the system. Pump until the chlorine odor is
detected at the faucets, then close the faucets and stop the pump. Allow the chlorin(
solution to remain in the well, storage tank, and distribution system for 24 hours.
c. After opening the system again, pump the well until the odor and taste of chlorine ha:
disappeared. Repeat Bacteriological Analysis for potability. Excessive amounts of
contamination in the well or water supply system may require repeating thi
disinfection process.
3. Repeat disinfection process as follows:
a. Add 2 to 3 gallons of 5% available chlorine household bleach to 10 gallons of wate:
and introduce into the well between the well casing and pump drop line. Pump wate:
through the system as per steps 2b and 2c above.
4. If the above methods do not eliminate the bacteria, the water supply may be disinfected ac
follows: CALCIUM HYPOCHLORITE TABLETS ARE HIGHLY CORROSIVE AND DANGEROUS
a. Add one (1) one (1) inch HTH chlorine . tablet per every 80 feet of water in you:
casing. (Depth of well) - (Depth to top of water) = total Feet H20.
b. Drop tablet(s) into casing allowing 4-6 hours for tablets to dissolve before pumpinf
water through system as per steps 2b and 2c above.
After disinfection, the water supply can be tested by the Weld County Health Department. Call
353-0635 to arrange for a water test.
TEMPORARY DISINFECTION
The following temporary measures can be used to treat water for drinking and cooking purposes,
until the well can be returned to service:
1. Boil water. After the water first starts to boil, boil briskly for 10 minutes.
AND
2. Disinfect water with household bleach (5%).
All water to be treated should be relatively clear. After adding household bleach, cover,
shake well and allow to stand 20-30 minutes before use. Boiled and chlorinated water must be
stored in a clean covered container.

liability regarding health and safety hazards on the
property. I am writing to determine whether there are
any steps which Ms. Hanes should be taking.
Ms. Hanes' health and safety is being compromised by
the health hazard remaining on the adjacent dairy
property subsequent to the disappearance of the prior
resident. That property currently has an old farmhouse
which is rented, as well as a double -wide trailer
(presumably there under an accessory use temporary
permit), and a rather rickety garage which has a second
floor apartment. Neither house has a foundation. There
is probably no uncontaminated water and possibly no
electricity to the residential units. There are
substantial manure piles everywhere, including on the
wellheads.
Even if there had been the proper accessory use
permit and fertilizer storage permit, they have probably
expired, and in any case were not adhered to. In
addition, there is what is presumably a non-commercial
junk yard on the property, no doubt also without a
permit. Also, if the double -wide has a permit, would it
expire by July 20, 1995?

Ms. Hanes is concerned that without monitoring these
houses will be inhabited by a large number of people, as
occurred last year, which will clearly affect the value,
safety, water and related health issues of her own
property. She has asked me to determine whether the
property is in compliance and will remain so. I have
also contacted the County Health Department because of
the huge manure piles left and because Ms. Hanes was told
that the dairy well was contaminated last year and there
is concern whether the contamination has stopped or
whether the manure is increasing the contamination and
possibly affecting her well also.

health and safety concerns about the current state of the
dairy, I am writing to ask whether your department has
recently inspected the property and if so, what is being
done to take care of current contamination and/or
hazards.
1. Well: Ms. Hanes' well is physically located on
the dairy property. The dairy, however, has its own
well, presumably permitted for the dairy. Ms. Hanes'
well is permitted for domestic use only. The dairy well,
we understand, has been contaminated within the past
year. Ms. Hanes is concerned that this contamination has
leaked into her well also. Has the dairy passed recent
testing or does Ms. Hanes have cause for concern
regarding her own well? There is particular concern that
the huge piles of manure left rotting out in the open may
be further contaminating the local water supply.
2. Manure: The prior operator of the dairy left
huge piles of manure everywhere around the dairy homes
and well and in close proximity to Ms. Hanes' home and
her well. Although the current owner has removed a lot
of that manure, there is a lot of the manure still
present. Nor was it being stored; simply left. If there
was a fertilizer storage permit for that location, has it
expired? Even if there was a permit, the fertilizer
apparently was not handled or treated or stored in any

way but simply dumped in huge piles wherever it was
convenient and left there. There is considerable rank
odor, flies and an open livestock cesspool, which has
been created near one of the piles. This is cause for
concern, both from the standpoint of contaminating
groundwater and wells and as a health and safety hazard
in general.
3. Housing: The dairy has a double -wide mobile
home on the property, an old farmhouse, and an old garage
with an apartment above. All of these dwellings have
been inhabited within the past year by the previous
tenant and various workers. The old farmhouse is
apparently now rented. Have any of these buildings been
condemned as uninhabitable? Is this zoned for
multiperson use? The garage looks unsafe and neither of
the houses are on foundations. There is also concern as
to whether there is water or electricity.
I would appreciate your response to these various
concerns and your suggestions as to what steps Ms. Hanes
should take in order to protect her own home, real
property, water supply, health and safety. I look
