RESOLUTION NO. 1995 - 8
BEING A RESOLUTION MAKING CERTAIN FINDINGS OF FACT AND
ESTABLISHING THE TOWN OF WINDSOR'S INTENT TO ANNEX CERTAIN REAL
PROPERTY KNOWN AS THE WELD COUNTY SCHOOL DISTRICT RE -4 NORTH
ANNEXATION AND A DETERMINATION OF SUBSTANTIAL COMPLIANCE WITH
THE MUNICIPAL ANNEXATION ACT OF 1965.
WHEREAS, a petition has been filed by the RE -4 School District, to annex to the
Town certain real property known as the Weld County School District RE -4 North
Annexation, more particularly described within the petition which is attached hereto and
incorporated herein by this reference; and
WHEREAS, pursuant to the Municipal Annexation Act of 1965, the Town is required
to establish a date, time, and place for a public hearing on said annexation; and
WHEREAS, the Town is further required to determine that the petition for annexation
is in substantial compliance with the Municipal Annexation Act of 1965.
NOW, THEREFORE, IT IS HEREBY FOUND AND RESOLVED BY THE BOARD
OF TRUSTEES OF THE TOWN OF WINDSOR, COLORADO, AS FOLLOWS:
1. The petition for annexation has been signed by more than 50 percent of the land
owners in the proposed annexation, said land owners owning more than 50
percent of the land in the area to be annexed.
2. At least 1/6 of the boundaries of the proposed annexation are contiguous to the
boundaries of the Town of Windsor, pursuant to Section 31-12-104(1)(a),
Colorado Revised Statutes, as amended.
3. A community of interest exists between the area proposed to be annexed and the
Town of Windsor.
4. A public hearing shall be held at 7:00 P.M. on March 10, 1997, at the Town
Hall, 301 Walnut Street, Windsor, Colorado.
Upon motion duly made, seconded and carried, the foregoing Resolution was adopted
this 10th day of February, 1997.

PROPERTY DESCRIPTION
A parcel of land being part of the Southeast Quarter (SEI/4) of Section Seventeen (17),
Township Six North (T.6N.). Range Sixty-seven West (R.67W.) of the Sixth Principal Meridian
(6th P.M.). County of \Veld. State of Colorado and being more particularly described as follows:
BEGINNING at the Southeast Corner of said Section 17 and assuming the Southerly line of said
SE1/4 to bear South 37°16'46" West with all other bearings contained herein relative thereto:
THENCE South 87°16'46" West along said South line a distance of 525.12 feet;
THENCE North 00°25'26" \Vest a distance of 249.91 feet to the Southwest Corner of the
Giorgione Annexation;
THENCE along the Westerly line of said Giorgione Annexation by the following Three (3)
courses and distances:

CHARM Point `'WINDSOR 2" bears South 62°22'45" West (Grid bearing) a distance of 661.36

THENCE North 00°35'37" West a distance of 803.77 feet to a Point On a Curve (POC) and
being the Southerly Right -Of -Way (RO\V) line of the Burlington Northern Railroad. The
aforesaid line being non -tangent to said curve;
THENCE along the Arc of a curve which is concave to the Northeast a distance of 984.56 feet.
whose Radius is 11.509.16 feet. whose Delta is 04°54'05", and whose Long Chord bears South
55°46'30" East a distance of 984.26 feet to the West line of said Giorgione Annexation;
THENCE South 00°40'40" East along said West line a distance of 540.61 feet to the TRUE
POINT OF BEGINNING.
Said described parcel of land contains 14.885 Acres, more or less (_) and is subject to any rights -
of -way or other easements as granted or reserved by instruments of record or as now existing on
said described parcel of land.
ANNEXATION PETITION
We, the undersigned, being the landowner(s), of more than 50% of the territory, excluding public streets and
alleys, described as (see attached legal description), containing 14.885 acres more or less, allege the
following to be true and correct:
The perimeter of the proposed annexation has a distance of 3.451.34 feet, of which 2 635.91 feet are contiguous
to the existing TOWN limits of the TOWN OF WINDSOR. A minimum of 1/6 of the perimeter of the proposed
annexation is contiguous to the TOWN OF WINDSOR.
We further allege:
1. It is desirable and necessary that said territory be annexed to the TOWN OF WINDSOR.
2. A community of interest exists between the said territory and the TOWN OF WINDSOR.
3. Said territory is urban or will be urbanized in the near future.
4. Said territory is integrated or capable of being integrated with the TOWN OF WINDSOR.
5. No land held in identical ownership is divided into separate parcels unless the owner of said tract has
consented in writing or joins in this Petition.
6. No land held in identical ownership comprises 20 acres and together with improvements had an assessed
valuation in excess of $200,000.00 in the year preceding the filing of this Petition.
7. No proceedings annexation of the territory have been commenced for annexation to another municipality.
8. The signers hereof comprise the landowners of more than 50% of the territory proposed to be annexed
exclusive of streets and alleys, and are in fact owners of 100% of the hereinafter described property.
Therefore, the undersigned hereby requests that the TOWN OF WINDSOR approve the annexation of the area described
above and do herewith pay the required fees.
In addition to the annexation, the undersigned request the zoning of RECREATION AND OPFN SPACF for the above
described property.

STATEMENT OF COMMUNITY NEED

The proposed annexation will enable the Town of Windsor to enter into an
intergovernmental agreement with the Re -4 School District for the joint
construction of maintenance facilities.
The District and Town have previously shown a cooperative spirit in the
construction of a joint fuel facility. Such cooperation is a benefit to taxpayers of
the community due to consolidation of building needs. We find that the community
may be better served and more efficiently served through this annexation by
allowing the Town of Windsor to join maintenance facilities with the school district.

WELD COUNTY SCHOOL DISTRICT RE 4 NORTH ANNEXATION
The 14.885 acre parcel involved in this annexation is located north of State
Highway 392, South of the Burlington Northern Railroad and west of Calabria
Subdivision and is further described as being a Part of the Southeast Quarter of
Section 17, Township 6 North, Range 67 West of the 6th P.M., County of Weld,
State of Colorado. The annexation petition has been signed by one -hundred
percent (100%) of the property owners and will be a joint effort between the
Town and School District for a shared maintenance facility.

independent contractor selected by both the Town and the School District.

• The Master Plan submitted with the Annexation Petition shows access to the
property from Ash Street. No direct access is planned from State Highway
392.
• A copy of the affected districts is attached.
All development proposals will be required to comply with the zoning and
subdivision ordinances of the Town of Windsor.

IMPACT STATEMENT - WINDSOR SCHOOL ANNEXATION
The Windsor School District sees benefit to this annexation. In order for the
district to construct additional school facilities, the current maintenance facility
must be relocated on district property. This annexation in part deals with the
location of the maintenance facility. We see no adverse effect of this annexation
to the school district.

Water use on property

The historic water use of the property proposed for annexation
has been and is surface gravity flow flood irrigation of
agricultural crops.
This area is provided water from an irrigation well that serves
only the agricultural use of the proposed annexation property.
The State well number is 28540F, location number M0592618, GASP
number 03-050-0, WC number 82 CW 426, 1995/96 and GASP 96/97
applied for. This well has a pump rate of 350 gallons per minute
and has watered approximately 13 - 15 acres.
In 1995, we placed a soccer field on a portion of this property,
approximately 2.5 acres, that is watered via the Middle School
underground sprinkling system and is not served by the above
listed well. That 2.5 acres is served by well number 28514F or
13136F, location number 83112427, GASP number 03-050-0, WC number
W6411.
