HomeMy WebLinkAbout660011.tiffRESOLUTION WHEREAS, the Uniform Building Code, 1964 Edition, was adopted by reference on August 17, 1966, and, WHEREAS, at the time of adoption of the code, the County of Weld was not completely zoned, and, WHEREAS, now that the entire County of Weld is zoned, it is imperative that the scope of the Resolution be enlarged, and, WHEREAS, to enlarge the scope of said resolution requires an amendment of Section IIIA of that resolution passed August 17, 1966, NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO that Section III - Scope of Resolution, Part (A) shall now read as follows: "The provisions of this Resolution shall apply to all the area in the County of Weld now covered by the Weld County Zoning Resolution, as amended, and not embraced within the limits of any incorporated City or Town." Dunbar: It has now reached the hour of 11:00 A. M., August 17, 1966 we will call the hearing for Uniform Building Code to order. Mr. Richardson will you please read the notice as published in the Greeley Booster our legal paper. Mr. Richardson: Notice is hereby given by the County Commissioners of Weld County Colorado, will hold a proper hearing on the adoption of a Uniform Building Code for the area of Weld County, Colorado, that are properly zoned excepting buildings or structures used for the sole purpose of providing shelter for agriculture implements, farm implements, products, livestock or poultry where permitted under the existing zoning regulations, shall be exempt from the provisions of this resolution - a hearing shall be held in the Office of the Board of County Commissioners, Weld County Court House, Greeley, Colorado, on August 17, 1966 at 11:00 A. M., dated this 12th day of July 1966, signed the Board of County Commissioners, Weld County, Colorado, signed by Ann Spomer County Clerk and Recorder and Clerk to the Board, published on July 15th and again on August 15, 1966 in the Greeley Booster. That is the official notice of the meeting. You may procede from there sir. Mr. Dunbar: You have heard the legal notice of the adoption of the Uniform Building Code. We will open the hearing to anyone who wants make a statement at this time. Mr. George Mosier: As a member of the Weld County Planning Commission - we have tossed this around for over a year now and the Commissioners have asked the Planning Commission to draw up plans and specifications for a building code for the County of Weld which the Planning Commission did with the assistance of our County Attorney. Mr. Richardson inquired of several differnt counties not only in Colorado but in other states. We came up with this final code that i.s presented for you here today, which is the uniform building code. It excludes some things that we were worried about and that is agriculture such as farm corrals, cattle yards or anything that pertains to agriculture up to a certain point and as stated in the notice is exempt from the building code. Other than that everything else falls in the county falls under the building code. The Planning Commission is very happy to work with the Commissioners and Mr. Richardson in drawing up the building code and we feel that this will be very beneficial to the welfare of Weld County. Mr. Dunbar: Thank you Mr. Mosier. Mr. Anderson do you wish to make a statement? Mr. Anderson: I believe that has been the thinking of the Board and why we have asked for it. Ns. Shultz: I am very much in favor of the building code I believe this is something we have been in need of for quite some time and if I am in order at this time I will so move that this Board adopt the building code as written. Ns. Anderson: I will second the motion. Mr. Dunbar: I will make it unanimous. It has been moved and seconded by the Board of County Commissioners to adopt the building code as set forth. Mr. Richardson: The only thing that you have to decide on is the effective date of this code. You can make it effective now or you can make it effective after the thirty day publication. You have to publish a resolution in the paper saying you have adopted the building code. (36-15-8) CRS Mr. Mosier: May I ask a question we assume since it will be the duty of the Planning Commission to adopt the building code, I would prefer that as one member of the commission that we be allowed the thirty days in order to set up some machinery provided that we can get forms made up and we can find out where we can get this information and inspections made. If we make it effective today I am afraid we are at a loss to really enforce it and really do a job that would be commensurate to the Commissioners Office. If we have this thirty day period Mr. Richardson, I think it would be more advisable to put the effective date at thirty days. Mr. Dunbar: By this time we will have our legal publication out of the way. Mr. Shultz: Why not make it effective as of October 1st of this year? Mr. Anderson: But along those lines didn't we agree to freeze all this Mr. Richardson: You have frozen all zoning. This is duly recorded in the Council minutes. I hope that this exchange of letters will be sufficient for the six month agreement, if not would you please prepare the necessary contract.
