HomeMy WebLinkAbout610090.tiffAPPOINTING COMMISSIONER TO CONVEY REAL PROPERTY SOLD AT PUBLIC AUCTION HELD ON November 20, 1961, 1:30 P.M., Commissioner's Office, Weld County Courthouse, Greeley, Colorado Commissioner Elmer L. Shultz offered the following resolution and moved its adoption: WHEREAS, Weld County, Colorado, has acquired and is the owner of the following described real property, duly recorded in the records of the County Clerk and Recorder of the County of Weld, State of Colorado, as follows, to -wit: Deed Date Recorded Executed Book at Page Description 2617 8/21/56 1458 282 Lots 25, 26, Block 11, Firestone, Colorado 1586 4/8/40 1062 442 Lots 1 to 6, 25, 26 8 30,31,32, Block 17, Firestone, Colorado 1587 4/8/40 1062 441 Lots 1 to 40 (All), Block 18, Firestone, Colorado R 1264 4/8/40 1061 129 Lot 30, Blk 6: Exc beg SE corner Lot 30, Blk 6, N 75' W 2' Sally to SW corner Lot //� 'p 30, E 25' to beg, Firestone, Colorado II'7/CJ/ I..)/ci /U'(?)c r�G1- Ys 3//3 /6 I ( ° ,) v l and WHEREAS, said property, excepting therefrom the reservations in favor of the Union Pacific Railroad Company; and excepting therefrom the reservations in the United States Patent and existing reservoir sites and irrigation ditches, if any, existing rights - of -way for public highways and roads, and any and all existing easements of rights - of -way, however evidenced or acquired, and subject to existing leases; and excepting therefrom all oil, gas and other minerals therein or thereunder, together with the right to prospect for and remove the same; and all county owned structures, if any, on said property, and all property used for county purposes; has been duly advertised for sale at a public auction held on November 20, 1961 at the hour of one -thirty o'clock, P.M., in the office of the Board of County Commissioners, and WHEREAS, at said sale, Town of Firestone bid $ 380.00 as the purchase price for said property and: being the highest and best bidder , said property was sold to said Town of Firestone NOW, BE IT RESOLVED, and it is hereby ordered that Charles 0. Bursiel , who is the County Treasurer of Weld County, Colorado, is hereby constituted and appointed as Commissioner for Weld County, Colorado, to convey, without covenants of warranty, said property as aforesaid, to said Town of Firestone which property is more particularly described as follows, to -wit: Lots 25, 26, Block 11; Lots 1 to 6, 25, 26 & 30, 31,32, Block 17; Lots 1 to 40 (ALL) Block 18; Lot 30, Blk 6: Exc beg SE corner Lot 30, Blk 6, N 75' W 2' Sally to SW corner lot 30, E 25' to beg, all in Firestone, Colorado 610090 excepting therefrom the reservations in favor of the Union Pacific Railroad ComOny; and excepting therefrom the reservations in the United States Patent andexisting sites and irrigation ditches, if any, existing rights-of-wayfor public high- ways and roads, and any and all existing easements or rights -of -way, however evidenced or acquired, and subject to existing leases; and excepting therefrom all oil, gag and other minerals therein or thereunder, together with the right to prospect for and re- move the same; and all county owned structures, if any, :on said property, and all property used for county purposes. IT IS FURTHER ORDERED, that to such conveyance, the said Charles 0. Bursiel as such Commissioner to convey said property, is authorized to affix the seal of said County and said conveyance, when executed according to this order, shall have the ef- fect to transfer to said Town of Firestone all right, title and interest which Weld County has in and to the above described property, except only and subject to the exceptions and res- ervations hereinabove mentioned or referred to. Weld County does not warrant title. The motion was seconded by Commissioner T. V.
