RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST TANYA BOMGARDNER FOR VIOLATION OF THE WELD
COUNTY BUILDING CODE AND ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Tanya Bomgardner, VI #9600283, is allegedly in violation of the Weld
County Building Code and Zoning Ordinances, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of March, 1997, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Tanya Bomgardner, property owner, was present at said hearing, and
WHEREAS, the Board heard all of the testimony and statements of those present,
studied the recommendations of the Department of Planning Services staff and, having been
fully informed, deems it advisable to refer said violation to the Weld County Attorney's Office,
but to delay any action upon such referral for a period of ninety (90) days to allow adequate
time for the property owner to complete the following:
1. Adequately screen or remove the noncommercial junkyard currently located on
subject property.
2. Submit to and have approved by the Department of Planning Services
appropriate permits to complete conversion of the garage on subject property,
and
WHEREAS, the Board further deems it advisable to allow the property owner to reduce
the number of animal units on the subject property to the acceptable number (2.0) for the zone
district in which the property is located, in accordance with the Weld County Zoning Ordinance,
by attrition, without the addition to or replacement of the animals which are currently located on
the subject property, and to delay any action by the County Attorney until such time as it may
be determined by the Department of Planning Services staff that the animals currently located
on the subject property have been added to or replaced.

WHEREAS, the Board deems it advisable to proceed with legal action against the above
named individual without further Board action if the subject property is not brought into
compliance or the conditions violated as hereinabove stated.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that if said violation still exists within the timeframe stated above, or if
the conditions regarding the animal units located on the subject property as stated above are
violated, then the Weld County Attorney be, and hereby is, authorized to proceed with legal
action against Tanya Bomgardner, and any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active concert with the
identified parties, in order to remedy the violation of the Weld County Building Code and Zoning
Ordinance.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 11th day of March, A.D., 1997.

5 ON THE PROPERTY. I OBSERVED APPROXIMATELY 4.6 ANIMAL UNITS
6 AT THE TIME OF INSPECTION, HOWEVER THERE WAS AN AREA THAT
7 I COULD NOT SEE IF THERE WERE MORE ANIMAL UNITS. THERE IS
8 ALSO A NONCOMMERCIAL JUNKYARD LOCATED ON THE PROPERTY
9 CONSISTING OF DEBRIS, USED BUILDING MATERIAL AND OTHER
10 MISCELLANEOUS JUNK. THERE IS ALSO SOMEONE LIVING IN A
11 CAMPER ON THE PROPERTY AND A SECOND RESIDENCE IN THE GARAGE.
12 TO BRING THE PROPERTY INTO COMPLIANCE THE ANIMAL UNITS MUST
13 BE NO MORE THAN 2 ANIMAL UNITS, ALL ITEMS CONSIDERED PART OF
14 A NONCOMMERCIAL JUNKYARD MUST BE REMOVED FROM THE PROPERTY,
15 THE CAMPER MUST NOT BE USED FOR ANY OVERNIGHT OR TEMPORARY
16 HOUSING AND THE BUILDING PERMIT MUST BE PAID FOR AND ISSUED
17 TO ADD THE GARAGE ONTO THE HOUSE. I MET WITH LLOYD AT THE
18 TIME OF INSPECTION. HE TOLD ME HE LIVED IN THE CAMPER SHELL
19 ON THE BACK OF HIS TRUCK AND HAD BEEN FOR AT LEAST 2-3
20 YEARS. A VIDEO WAS TAKEN AT THE TIME OF INSPECTION.

Zone District. All items considered part of a noncommercial junkyard (derelict vehicles) must be
removed from the property or be licensed and in running condition or stored within a screened area
from all adjacent properties and public rights of way.
The Department of Planning Services also recommends that the County Attorney authorize legal
action against any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties.

This letter is in regards to the Weld County Zoning Violation
Notice Number: VI -9600283. As I have already reported to
Julie Chester, Building Inspector; Ed Stoner, Combination
Inspector, Chris Goranson and Kerri Keithley, Current
Planners for the Department of Planning Services, the
violations brought to my attention have been either corrected
or are in the process of being resolved.
I would like to express my gratitude and appreciation for the
patience, understanding and guidance this department has
shown since this process began. Thank you for making this
less difficult than it has already been.
In regards to the animal units, we have found homes for
some of our pets. Others in question are still with us due
to the extreme difficulty in parting with those that remain.
When we purchased our one acre country home in Weld County,
two and a half years ago, we specifically asked about the
zoning to be sure we could have our two horses and some small
livestock. The owner, neighbors, Realtors and title company
all confirmed that we were allowed to have either 2 horses, 2
cows or a combination of the two as long as there were only
two large livestock and that smaller animals such as
chickens, rabbits, lambs and goats were obviously permitted.
We purchased and moved to our new home and brought with us
our two horses, six goats, three bar -be -doe sheep, two pot
bellied pigs, six rabbits and about three dozen poultry.
For the past two and a half years, my mother, 8 yr. daughter
and myself have been planning, investing and building shelter
and pens for our small farm family. Each pet animal has
enough space in their own area that they may enjoy the
healthy pleasure of galloping, running, hopping and flying.
The property is completely fenced, including an 8' wooden
privacy fence which encloses the area from view from the
street or any adjoining neighbors. The less than one acre
bordering the east property line is allowed up to 20 cows.
My neighbors on the south side raise up to 200 sheep.
Throughout the year, some of my neighbors bring their

grandchildren over to see the baby chicks, bunnies and lambs.
They have commented how much they enjoy coming over to see
them. The offspring are sold as soon as they are able. We
raise them for 4-H projects, we donate eggs to the elementary
schools for the children to incubate as well as donate eggs
for Aids research.
I grew up in Denver and spent summers with relatives on farms
in Greeley, and since I was a little girl, I dreamed of being
able to have my own little "MacDonald's Farm". I also have
the tremendous responsibility of raising my eight year old
daughter who thoroughly enjoys, involves and learns from the
many experiences that take place in the field of animal
husbandry. It is has been a wonderful and enriching
experience as well as an additional alternative to sports,
karate, judo, dance, gymnastics, skating, swimming, etc.
My 8 year old daughter, Vanessa, has eagerly anticipated her
8th birthday which is December 19th, six days before
Christmas, so that she may finally be old enough to
participate in 4-H with her paint pony and pigmy goats. We
have two horses which include my daughter's paint pony and my
20 yr. old retired mare of which we ride together and who
are closely bonded and have been constant companions.
We adopted our pot bellied pigs five years ago and do not
foresee finding them a home. For any pets remaining that we
may be forced to part with, we know the only solution is for
them to be sold for butcher. My daughter and I are
devastated at the options remaining.
In this world of increasing high tech, high stress, big city
congestion, people are searching for homes like Greeley that
offer a mixture of country life with a bit of city life. It
will require preservation and promotion of country life or it
will soon become extinct as we can see happening in our
neighboring cities.
I hope that the committee will consider the benefits of
providing a variety of opportunities for children, as well
adults, to become involved with, to learn and enjoy the
activities that directly relate to the wholesome charm and
atmosphere of Weld County.

The uses on the above described property are being considered as a zoning violation of Section 32.2.2,
32.2.2.1, 32.2.3, 32.2.3.6 and 32.7.8 of the Weld County Zoning Ordinance. This is not a use allowed by
right in the R-1 zone district.
The violation can be corrected by bringing the number of animal units to two. There are also two
derelict vehicles located on the property and it appears that the mother of Tanya Bomgardner is living in
the garage. To bring these violations into compliance, the derelict vehicles must be removed from the
property, stored within a screened area or have current license plates and be in running condition. The
residence in the garage must be removed and a building inspector must inspect the garage to determine
compliance.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty)
days from November 4, 1996 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.

AIRSTRIP: Any locality, situated on either water or land which is adapted for the
landing and taking off of aircraft, operated by the owner or lessee of the land USED

31.4.19 CHILD CARE CENTER

31.4.21 USES similar to the USES listed above as Uses by Special Review as long as the
USE complies with the general intent of the A District,
31.5 Bulk Requirements. The following lists the Bulk Requirements for the A District.
31.5.1 Minimum LOT size 80 acres
31.5.2. Minimum SETBACK 20 feet
31.5.2.1 Fences are not required to comply with the minimum SETBACK and may be located
on the property line. Fences located on corner lots abutting public rights -of -way shall

32 Residential Districts
32.1 Intent of the Residential Districts. The R-1, R-2, R-3, R-4 and R-5 Residential
Districts are intended to provide the present and future residents of Weld County with
areas in which to locate and establish residential land USES and land USES that are
compatible with residential areas. The Residential Districts are intended to be
located, designed, and developed in a manner that is compatible with the Weld
County Comprehensive Plan and the adopted MASTER PLANS of affected
municipalities.
32.2 The R-1 (Low Density Residential) District.
32.2.1 Intent of the R-1 District. The purpose of the R-1 District is to provide areas in Weld
county for SINGLE FAMILY residential USE that are located, designed, and
developed in compliance with the Weld County Comprehensive Plan and the adopted
MASTER PLANS of affected municipalities. The R-1 District is also intended to
accommodate non-residential land USES that are both ACCESSORY to and
compatible with residential USES allowed by right in the District. •
32.2.2 Uses Allowed by Right in the R-1 District. No BUILDING, STRUCTURE or land shall
be USED, an no BUILDING or STRUCTURE shall hereafter be erected, structurally
altered, enlarged, or maintained in the R-1 District except for one or more of the
following USES. Land in the R-1 District must be USED in compliance with the Bulk
Requirements contained in Section 32.7. USES within the R-1 District are subject to
the additional requirements contained in Section 40, Suoolementary District
Regulations and Section 50, Overlay Districts.
