HomeMy WebLinkAbout970454.tiffRESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST TANYA BOMGARDNER FOR VIOLATION OF THE WELD COUNTY BUILDING CODE AND ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Tanya Bomgardner, VI #9600283, is allegedly in violation of the Weld County Building Code and Zoning Ordinances, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of March, 1997, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Tanya Bomgardner, property owner, was present at said hearing, and WHEREAS, the Board heard all of the testimony and statements of those present, studied the recommendations of the Department of Planning Services staff and, having been fully informed, deems it advisable to refer said violation to the Weld County Attorney's Office, but to delay any action upon such referral for a period of ninety (90) days to allow adequate time for the property owner to complete the following: 1. Adequately screen or remove the noncommercial junkyard currently located on subject property. 2. Submit to and have approved by the Department of Planning Services appropriate permits to complete conversion of the garage on subject property, and WHEREAS, the Board further deems it advisable to allow the property owner to reduce the number of animal units on the subject property to the acceptable number (2.0) for the zone district in which the property is located, in accordance with the Weld County Zoning Ordinance, by attrition, without the addition to or replacement of the animals which are currently located on the subject property, and to delay any action by the County Attorney until such time as it may be determined by the Department of Planning Services staff that the animals currently located on the subject property have been added to or replaced. 970454 CC ; %oG c/9i byngaidner PL0824 VIOLATIONS - VI #9600283 - TANYA BOMGARDNER PAGE 2 WHEREAS, the Board deems it advisable to proceed with legal action against the above named individual without further Board action if the subject property is not brought into compliance or the conditions violated as hereinabove stated. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that if said violation still exists within the timeframe stated above, or if the conditions regarding the animal units located on the subject property as stated above are violated, then the Weld County Attorney be, and hereby is, authorized to proceed with legal action against Tanya Bomgardner, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, in order to remedy the violation of the Weld County Building Code and Zoning Ordinance. As I have already reported to Julie Chester, Building Inspector; Ed Stoner, Combination Inspector, Chris Goranson and Kerri Keithley, Current Planners for the Department of Planning Services, the violations brought to my attention have been either corrected or are in the process of being resolved. I would like to express my gratitude and appreciation for the patience, understanding and guidance this department has shown since this process began. Thank you for making this less difficult than it has already been. In regards to the animal units, we have found homes for some of our pets. Others in question are still with us due to the extreme difficulty in parting with those that remain. When we purchased our one acre country home in Weld County, two and a half years ago, we specifically asked about the zoning to be sure we could have our two horses and some small livestock. The owner, neighbors, Realtors and title company all confirmed that we were allowed to have either 2 horses, 2 cows or a combination of the two as long as there were only two large livestock and that smaller animals such as chickens, rabbits, lambs and goats were obviously permitted. We purchased and moved to our new home and brought with us our two horses, six goats, three bar -be -doe sheep, two pot bellied pigs, six rabbits and about three dozen poultry. For the past two and a half years, my mother, 8 yr. daughter and myself have been planning, investing and building shelter and pens for our small farm family. Each pet animal has enough space in their own area that they may enjoy the healthy pleasure of galloping, running, hopping and flying. The property is completely fenced, including an 8' wooden privacy fence which encloses the area from view from the street or any adjoining neighbors. The less than one acre bordering the east property line is allowed up to 20 cows. My neighbors on the south side raise up to 200 sheep. Throughout the year, some of my neighbors bring their 970454 grandchildren over to see the baby chicks, bunnies and lambs. They have commented how much they enjoy coming over to see them. The offspring are sold as soon as they are able. We raise them for 4-H projects, we donate eggs to the elementary schools for the children to incubate as well as donate eggs for Aids research. I grew up in Denver and spent summers with relatives on farms in Greeley, and since I was a little girl, I dreamed of being able to have my own little "MacDonald's Farm". I also have the tremendous responsibility of raising my eight year old daughter who thoroughly enjoys, involves and learns from the many experiences that take place in the field of animal husbandry. It is has been a wonderful and enriching experience as well as an additional alternative to sports, karate, judo, dance, gymnastics, skating, swimming, etc. My 8 year old daughter, Vanessa, has eagerly anticipated her 8th birthday which is December 19th, six days before Christmas, so that she may finally be old enough to participate in 4-H with her paint pony and pigmy goats. We have two horses which include my daughter's paint pony and my 20 yr. old retired mare of which we ride together and who are closely bonded and have been constant companions. We adopted our pot bellied pigs five years ago and do not foresee finding them a home. For any pets remaining that we may be forced to part with, we know the only solution is for them to be sold for butcher. My daughter and I are devastated at the options remaining. In this world of increasing high tech, high stress, big city congestion, people are searching for homes like Greeley that offer a mixture of country life with a bit of city life. It will require preservation and promotion of country life or it will soon become extinct as we can see happening in our neighboring cities. I hope that the committee will consider the benefits of providing a variety of opportunities for children, as well adults, to become involved with, to learn and enjoy the activities that directly relate to the wholesome charm and atmosphere of Weld County.
