My c ssion expire • =LINE C [SEAL] =LINE Notary Public ' °. 4531309 MyCommlpbn Expires Jan.23,2002 ATTACHMENT B TO THE PETITION TO THE COLORADO STATE BOARD OF ASSESSMENT APPEALS DATED AUGUST 13, 1999, OF PATINA OIL & GAS CORPORATION On January 15, 1999, pursuant to section 39-10-114,1 C.R.S., Petitioner filed a petition for abatement or refund of taxes dated January 15, 1999 (the "Petition"), with the Weld County Board of Commissioners (the "Commissioners"). The Petition sought the refund of taxes paid for property tax year 1997 on oil and gas leaseholds and lands located within Weld County, Colorado. A copy of the Petition with attachments is attached to this Attachment B as exhibit 1. Currently, Petitioner and representatives of the Weld County Assessor's office are discussing a settlement of the issues raised in the Petition. However, in the event a settlement is not reached, Petitioner desires to preserve its rights to seek review of the Petition pursuant to section 39-1.0- 114.5. Accordingly, Petitioner is filing this petition with the Colorado State Board of Assessment Appeals (the "Board"). Petitioner intends to withdraw this petition if and when the parties enter into a final written agreement concerning the issues raised in the Petition. As indicated above, Petitioner filed the Petition on January 15, 1999. Section 39-1- 113(1.7), 11 C.R.S. (1998), provides that every petition for abatement or refund filed pursuant to section 39-10-114 shall be acted upon within six months of the date of filing such petition. As of July 15, 1999 (six months from the date the Petition was filed),the Commissioners had not acted on the Petition. By letter dated July 14, 1999, Petitioner received notice of a hearing to be held by the Commissioners on August 11, 1999 concerning the Petition. On August 9, 1999, Petitioner filed a revised petition for abatement or refund of taxes dated August 6, 1999 (the "Revised Petition") with the Weld County Assessor. The Revised Petition addressed the same issues raised in the F'etition. A copy of the Revised Petition with attachments is attached to this Attachment B as exhibit 2. At the August 11, 1999 hearing, the Weld County Attorney advised the Commissioners that they no longer had jurisdiction to act on the Petition because the six- month period in section 39-1-113(1.7) had expired. Accordingly, Petitioner is treating the Commissioners' lack of action on the Petition as a denial of the Petition. Section 39-10-114.5(1), 11 C.R.S. (1998), provides that if a board of county commissioners denies a petition for abatement or refund, the petitioner may appeal to the Board within 30 days of the entry of the decision. Accordingly, to secure its rights to seek review of the Petition, Petitioner is filing this petition with the Board, pursuant to section 39-10-114.5(1), within 30 days of the running of the six-month period contained in section 39-1-113(1.7). Such hearing is the final hearing at which testimony, exhibits, or any other evidence may be introduced. If the decision of the BAA is further appealed to the Court of Appeals, only the record created at the BAA hearing shall be the basis for the Court's decision. You and the CBOE select an arbitrator from the official list of qualified people. This hearing will be held at the Weld County Centennial Center, 915 10th Street, Greeley, Colorado, in the First Floor Hearing Room. You have a right to attend this hearing and present evidence in support of your petition. The Weld County Assessor will be present before the Board. The Board will make its decision on the basis of the record made at the aforementioned hearing, as well as your petition, so it would be in your interest to have a representative present. If you plan to be represented by an agent or an attorney at your hearing, prior to the hearing you shall provide, in writing to the Clerk to the Board's Office, an authorization for the agent or attorney to represent you. If you do not choose to attend this hearing, a decision will still be made by the Board by the close of business on August 5, 1999, and mailed to you on or before August 10, 1999. Because of the volume of cases before the Board of Equalization, all cases shall be limited to 15 minutes. Also due to volume, cases cannot be rescheduled. It is imperative that you provide evidence to support your position. This may include evidence that similar homes in your area are valued less than yours or you are being assessed on improvements you do not have. Please note: The fact that your valuation has increased cannot be your sole basis of appeal. Without documented evidence as indicated above, the Board will have no choice but to deny your appeal.
