FEBRUARY 17, 1998
A regular meeting of the Weld County Planning Commission was held February 17, 1998, in the County
Commissioners' Hearing Room (Room#101), Weld County Centennial Building, 915 10th Street, Greeley,
Colorado. The meeting was called to order by the Chairman, Glen Vaad at 1:35 p.m.

The summary of the last regularly scheduled meeting of the Weld County Planning Commission held on
February 3, 1998, was approved as read.
CASE NUMBER: USR-1178
APPLICANT: Russell and Patricia Martinson
PLANNER: Todd Hodges
REQUEST: A Site Specific Development Plan and a Special Review permit for a kennel for raising and
training of toy breed dogs(30 maximum) in the A(Agricultural)zone district.
LEGAL DESCRIPTION: Lot A of RE-392, being part of the NW4 SW4 of Section 11, T5N, R65W of
the 6th P.M., Weld County, Colorado.
LOCATION: North of and adjacent to East 18th Street; approximately 1/4 mile west of Weld County Road
45-1/2.
Todd Hodges explained that the property is zoned,agricultural with surrounding agricultural uses. The
property was created through the recorded exemption process and was split off in 1979. This proposal is for
a kennel with a maximum number of 30 small dogs, including offspring. Referrals were sent to the City of
Greeley, the City of Evans, and the Town of Garden City. Greeley was the only referral response with
comments the Department of Planning Services received and their concerns have been addressed in the
conditions of approval and the development standards. Garden City and Evans did not indicate any concerns
with the proposal.
Todd introduced Sheble McConnellogue from the Weld County Health Department. Ms. McConnellogue
explained that she and Todd Hodges conducted a site visit with the intent of measuring noise levels. She
explained that Colorado Revised Statutes suggest these readings be taken 25 (twenty-five) feet from the
property line. Ms. McConnellogue explained that these measures were taken at a closer proximity due to the
fact that 25 feet would place them on the surrounding property owner's land. The first reading was taken from
an elevated fenced area of the property and the reading was acceptable at 55 decibels. The second reading
was taken from a higher elevation with no fencing and the reading was slightly higher. Ms. McConnellogue
submitted comparisons of various types of noises and readings associated with them, to include: an air-
conditioning unit from 20(twenty feet) -60 decibels, living room noise-40 decibels, light vehicle traffic from
100 feet - 55 decibels, vacuum cleaner - 70 decibels, and normal human speech - 60 decibels. While
conducting the noise level readings at the proposed site, she also recorded the surrounding property owner's

rooster crowing and large labador dogs barking and commented that these levels were far above 55 decibels.
Sheble McConnellogue explained that the applicant was willing to have a minimum number(possibly three
dogs) debarked.
Todd Hodges addressed changes that were incorporated into the conditions of approval and development
standards. Mr. Hodges stated that the Department of Planning Services is recommending approval of this
application.
Arlan Marrs expressed concerns regarding enforcement of the conditions of approval and development
standards. Todd Hodges explained that the Planning Department did place a nontransferable clause on the
use and ultimately the violation process would take affect if the applicants were found to be in noncompliance
with the conditions of approval and development standards. Lee Morrison also stated that these noise
standards are established by State Statute. Revocation of the permit would be possible and surrounding
property owners could seek injunctive relief in court. Glen Vaad asked if septic systems were allowed in the
floodplain. Sheble McConnllegue said septic systems were allowed through the I.S.D.S. Flood Policy within
the floodplain but not in the floodway.
The Chairman asked if there was anyone in the audience who wished to speak for or against this application.
No one wished to speak.
Mike Metman, representative for the applicant, explained that he had visited the site personally and noise
levels on the premises were similar to normal agricultural noises. He also explained that the applicant and
he have met twice with surrounding property owners addressing possible concerns.
Glen Vaad asked if the applicants were in agreement with the Department of Planning Service's
recommendation Mr. Metman said yes.
Stephen Mokray moved Case Number USR-1178, Russell and Patricia Martinson, be forwarded to the Board
of County Commissioners with the Planning Commissions recommendation for approval. Cristie Nicklas
seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Arlan

CASE NUMBER: USR-1179
APPLICANT: Left Hand Water District
PLANNER: Todd Hodges
REQUEST: A Site Specific Development Plan and a Special Review permit for a Major Facility of a Public
Utility consisting of two 105 feet in diameter, 24 feet in height, 1.5 million gallon water tanks.
LEGAL DESCRIPTION: Part of the NE4 of Section 33,T2N, R68W of the 6th P.M.,Weld County, Colorado.
LOCATION: West of and adjacent to Weld County Road 7; approximately 1/3 mile south of Weld County
Road 16.
SIZE OF PARCEL: 2 acres, more or less
Todd Hodges explained that the proposed site is zoned agricultural as well as surrounding areas with
residences to the north and east. The proposed site has possible previous strip mining, and is not located
in the geological hazard zone. Mr. Hodges explained the proposed layout on the proposed site and the time
frames involved for completion. It has been determined that the proposal meets the intent of Sections 25.5
and 25.8 of the Weld County Zoning ordinance. A landscape buffering plan will be submitted to the Weld
County Planning Department for review and approval before recording of the plat. The Special Review activity
conceming any utility work,the issuance of any building or electrical permits shall not occur until the Special
Review plat is ready and recorded in the office of the Weld County Clerk and Recorder. (Department of

Arlan Marrs expressed concern that these types of facilities should affect the least number of people as
possible. Discussion followed as to why no other site in this area would compensate for the elevation required
for pressure needed. Mr. Marrs was also concerned that the tanks would be servicing the Del Camino area
that is located seven to eight miles away from the proposed tank site.
Glen Vaad asked about the proposed 2 acres, but was confused that the application stated 6 acres. It was
explained that the remaining 4 acres provided a buffer zone.
Randy Parks, Consulting Engineer for the Left Hand Water District, explained that this site will include a 105
foot, 24 foot high, 1.5 million gallon tank to serve the Del Camino District. The elevation of this site is
mandatory to enhance fire flow capabilities. These tanks are cited to serve a certain pressure zone so
suitable sites become limited. Discussion followed regarding line size verses pressure and elevation.
The Chairman asked if there was anyone in the audience who wished to speak for or against this application.
Howard Cobb, Cecile Barker, and David Markovart, surrounding property owners, expressed concerns about
the effect the proposed site will have on property values, obstruction of existing views, height of the tanks,
landscape buffering, and topographical issues. Technical discussion followed between Howard Cobb,
surrounding property owner and Hank Schmidt, representative from the Left Hand Water District.
Marie Koolstra asked about the color of the proposed tank. Mr. Hodges responded by explaining that the
application referred to"neutral"color tones.
The Chairman asked the applicant's representative if they agreed with the Department of Planning Service's
recommendation, conditions of approval, and development standards. Mr David Markovart replied that they
did.
Jack Epple moved to approve USR-1179, Left Hand Water District. The motion was seconded by Arlan
Marrs.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Arlan
