RE: SITE SPECIFIC DEVELOPMENT PLAN AND RESUBDIVISION, S #407, FOR PURPOSE
OF REDESIGN OF LOTS 1 THROUGH 8 OF LUPTON MEADOWS SUBDIVISION -
BEARSON, EDMUNDSON, INC., AND HEIN
A public hearing was conducted on October 30, 1996, at 10:00 a.m., with the following present:

Commissioner Constance L. Harbert
Commissioner W. H. Webster
Also present:

Assistant County Attorney, Lee Morrison
Planning Department representative, Todd Hodges
The following business was transacted:
I hereby certify that pursuant to a notice dated October 9, 1996, and duly published October 17,
1996, in the North Weld Herald, a public hearing was conducted to consider the request of Darrell
and Nelva Bearson, Edmundson, Inc., Richard L. Hein, and Marvin C. Hein for a Site Specific
Development Plan and Resubdivision for purpose of redesign of Lots 1 through 8 of Lupton
Meadows Subdivision. Lee Morrison, Assistant County Attorney, made this a matter of record.
Todd Hodges, Planning Department representative, presented a brief summary of the proposal and
submitted Amended Conditions of Approval to the Board for review and entered the favorable
recommendation of the Planning staff into the record. He then explained the original plat dates
back to 1909, and this request will redesign Lots 1 through 8 to correct an illegal land split by
vacating portions of lots east of the river, which will then be joined with a recorded exemption lot.
Mr. Hodges clarified Lot 8 runs north and south along the west side of the river, and this request
will not create additional lots; therefore, the applicants are not required to meet today's zoning
standards concerning sewer and water. He confirmed all referral agencies' concerns have been
addressed in the Conditions of Approval and noted Condition of Approval #1.D. was added in the
Amended Conditions of Approval. Ted Carlson, representing Darrell and Nelva Bearson, reiterated
approval of the resubdivision will clean up this situation including lot lines, accesses, and
boundaries. He stated the land east of the river will be sold to the neighbors. Mr. Carlson agreed
to accept all Conditions of Approval, and no public testimony was offered. Commissioner Hall
moved to approve the request of Darrell and Nelva Bearson, Edmundson, Inc., Richard L. Hein,
and Marvin C. Hein for a Site Specific Development Plan and Resubdivision for purpose of
redesign of Lots 1 through 8 of Lupton Meadows Subdivision, based on the recommendation of the
Planning staff, with the Amended Conditions of Approval as entered into the record. The motion
was seconded by Commissioner Webster, and it carried unanimously.
