HomeMy WebLinkAbout660246.tifft APPOINTING COMMISSIONER TO CONVEY REAL PROPERTY SOLD AT PUBLIC AUCTION: Commissioner Anderson offered the following resolution and moved its adoption: WHEREAS, Weld County, Colorado, has acquired and is the owner of the following described real estate, duly recorded in the records of the County Clerk and Recorder of the County of Weld, State of Colorado, as follows, to -wit: TREAS DEED DATE RECORDED RECEPTION BOOK NUMBER DESCRIPTION 2644 10/29/65 554 and 1474665 Lot 28, Block 3 Frederick, Colorado WHEREAS, said property has been duly advertised for sale at public auction held on the 16th day of March 1966, at the hour of 2:00 o'clock P. M. in the office of the Board of County Commissioners, excepting therefrom the reservations in favor of the Union Pacific Railroad Company; and excepting therefrom the reservations in the United States Patent and existing reservoir sites and irrigation ditches, if any, existing rights -of -way for public highways and roads, and any and all existing easements of rights -of -way, however evidenced or acquired, and subject to existing leases, and excepting therefrom all oil, gas and other minerals therein or thereunder, together with the right to prospect for and remove the same; and all county owned structures, if any, on said property, and all property used for county purposes; and WHEREAS, at said sale Elvera U. Milavec and Frank Milavec bid $70.00 as the purchase price for said property and being the highest and best bidder, said property was sold. NOW, THEREFORE, BE IT RESOLVED, that Charles 0. Bursiel, County Treasurer be and is hereby constituted and appointed as Commissioner for Weld County, Colorado, and is hereby ordered to convey without covenants of warranty to Elvera U. Milavec and Frank Milavec the property more particularly described as follows; to -wit: Lot 28, Block 3 Frederick, Colorado excepting therefrom the reservations in favor of the Union Pacific Railroad Company; and excepting therefrom the reservations in the United States Patent and existing reservoir sites and irrigation ditches; if any, existing rights -of -way for public highways and roads, and any and all existing easements of rights -of -way, however evidenced or acquired, and subject to existing leases; and excepting therefrom all oil, gas and other minerals therein or thereunder, together with the right to prospect for and remove the same; and all county owned structures, if any on said property, and 660246 IT IS FURTHER RESOLVED, that as to such conveyance, Charles 0. Bursiel is authorized to affix the seal of Weld County and said conveyance, shall have the effect to transfer to said Elvera U. Milavec and Frank Milavec of Box 58, Frederick, Colorado, all right title and interest which Weld County has in and to the above described property subject to the exception and reservations hereinabove mentioned or referred to. Weld County does not warrant title. An assessment of $ 176.82 has been proposed to be levied on: Weld County Lot 28, Block 3, Greeley, Colorado Front feet: 25 Complaints or objections in writing should be filed with the Town Clerk before 5:00 o'clock P„M., August 18, 1966. A Hearing shall be held on the 23rd day of August, 1966, at 7:30 o'clock P.M. at the Town Hall in Frederick, Colorado. Assessments may be payable in 14 equal annual installments as provided in an ordinance to be adopted by the Board of Trustees, or, at the option of the property owner, such assessments may be paid in full within thirty days after the publication of the assessing ordinance.
