RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION #1750 - NUSBAUM
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1750, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1750 was submitted by Robert and
Rhanda Nusbaum, 38445 Weld County Road 29, Eaton, Colorado 80615, for property which is
located in Lot B of RE #1227, in the NE% and SE% of Section 20, Township 7 North, Range 66
West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which
shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
65 acres and 1 acre.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1750 submitted by
Robert and Rhanda Nusbaum be, and hereby is, approved conditional upon the following:
1. Prior to recording the plat, any existing septic system(s) which is not currently
permitted through the Weld County Health Department shall require an Individual
Sewage Disposal System (ISDS) evaluation prior to the issuance of the required
septic permit(s). In the event the system(s) is found to be inadequate, the
system(s) must be brought into compliance with current ISDS regulations.
2. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.

Dear Commissioners:
This application for a recorded exemption in the A (Agricultural) zone district was submitted by
Robert and Rhanda Nusbaum. The parcel of land is described as Lot B of RE -1227, located in the
NE4 and SE4 of Section 20, T7N, R66W of the 6th P.M., Weld County, Colorado. The property is
located west of and adjacent to Weld County Road 29 and approximately 1/4 mile north of Weld
County Road 78. The request is to dived a 66 acre parcel into parcels of 65 acres and 1 acre.
RE -1227 was approved by the Department of Planning Services' staff on December 19, 1989. The
applicants are now requesting to further subdivide Lot B of RE -1227 into two lots of 65 acres and
1 acres. The applicants have stated in their application that the reason for the recorded exemption
is to separate off existing farm improvements for the hired help to buy the property. Currently both
proposed lots have an existing dwelling unit located on the property. The applicant is not requesting
any changes to the existing property. No new building sites will be created with this request.
North Weld County Water District is the current water source for both lots A and B. Septic systems
sewage disposal on both proposed lots. Access to both proposed lots is existing onto Weld County
Road 29. The property is located in the Urban Growth Boundary Area of the Towns of Severence
and Ault. Both Towns have reviewed this request and find no conflict of interest. The Weld County
Health Department and Public Works Department have both reviewed this request and have no
conflict of interest.

The Department of Planning Services' staff recommends conditional approval of this request based
upon the following:
this proposal is in conformance with the Weld County Comprehensive Plan and the Town of
Severence and Ault's Comprehensive Plan;
- this proposal is consistent with the existing surrounding land uses;
- this proposal is consistent with the intent of the A (Agricultural) zone district;
this proposal is consistent with efficient and orderly development;
provides for adequate provision for the protection of the health, safety, and welfare of the
inhabitants of the neighborhood and County are insured by the conditionsof approval;
this proposal is compliance with the recorded exemption standards set forth in Section 11.8 of
the Weld County Subdivision Ordinance.
