Grable of Greeley has requested that we-write to you relative to the establishment of a- public road, .part of which is on the Northeast Quarter - (NB ) and the Southeast Quarter (SF;-) of the Northwest Quarter (NW*) , Section Nine (9 ) , Township Six _(6) , Range Sixty- ' three (63) , -Weld County, which said land is owned by you. This road was regularly petitioned for, viewers appointed by the Board of County Commiseioners,- public notices, - posted along the line of road to be viewed, report made by the viewers to the Board of County Commissioners, and . on the 6th day of-_May, 1916, the Board did regularly grant - the road as prayed for, and public notices were posted as required by law. - - • This road is of considerable importance, as it . furnishes a direct route along the Union, Pacific Railroad • between Cornish and Barnesville, and, as a matter of fact, - will be the main traveled road from the eastern part of . - the county to -Greeley. Owners of land- in the outlying ' - Districts usually are eager to aid fh the development of ' - good roads for the purpose of establishing direct conned- - - tion with the more settled Districts. This road, no doubt, will at least in an indirect way be of some benefit - to you and others owning land adjoining thereto .'' The - • Board of County Commissioners have directed me to say to - you that they do not think that the road has damaged you, but has -to a certain degree been, ;and is now, beneficial _ to residents -of that immediate neighborhood. COUNTY OF WELD. ))) IN THE MATTER OF THE D. E. CARPENTER ROAD, NO. TO THE HONORABLE BOARD OF COUNTY COMMISSIONERS, OF WELD COUNTY, COLORADO: GENTLEMEN: The undersigned, Paul F. Steinkraus, Herman A. Stein- kraus, and Emil B. Steinkraus, respectfully protest against the establishment of a public road through their land and along the south boundary of the Union Pacific Railroad right of way through the El of Section 17, Townkhip 6 North, Range 63 West. As grounds of this protest, we respectfully show Your Honors that we are the owners of the El of Section 17. Said land which would be traversed by said proposed road is irri- gated, agricultural land, partly now in alfalfa and assessed at $40.00 per acre. The viewer' s report of said road on file fails to assess the damages to us for the taking of said land. The line of said proposed road through said land would tra- verse our ditches in several places, would require several ditch crossings, would require new fence, would be through sandy soil expensive for road construction and maintenance, and its establishment would take valuable land of petitioners and would damage and not benefit us. There is already estab- lished between the points said road would serve and along the south side of said Section 17 a good public road, well graded and on a line much more practical and economical than said proposed road. -1- / ��`/ 2 Gf We therefore respectfully protest against the said pro- posed new road and petition that it be not opened through our said land, and that if said new road be allowed along the railroad through petitioners' land, that we be allowed damages therefor of $60.00 an acre, that the county put all ditches traversed in as good condition as at present and build the necessary fence on the south side of said new line of road, and that our damages be assessed by a jury.
