RE: APPROVE GRANT OF EASEMENT AND AUTHORIZE CHAIR TO SIGN -WAYNE
AND KRIS HOWARD
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Grant of Easement between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Pubic Works Department, and Wayne and Kris Howard, 22577
Weld County Road 64.5, Greeley, Colorado 80631, with terms and conditions being as stated in
said grant of easement for property located in the NE'/. of Section 26, Township 6 North,
Range 65 West of 6th P.M., Weld County, Colorado, and
WHEREAS, after review, the Board deems it advisable to approve said grant of
easement, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Grant of Easement between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Pubic Works Department, and Wayne and Kris Howard be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said grant of easement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 21st day of April, A.D., 1999.

�7 GRANT OF EASEMENT
g37/ THIS EASEMENT, granted this,/Sfday of April, 1999, between Wayne A. Howard
and Kris A. Howard, whose legal address is 22577 WCR 64/, Greeley, Colorado 80631 of the
County of Weld , State of Colorado, the Grantors, and, the County of Weld, a body corporate and
politic of the State of Colorado, whose legal address is 915 10th Street, Greeley, Colorado 80631
of the County of Weld , and State of Colorado, the Grantee.
WITNESSETH, that the Grantors, for and in consideration of the sum of$1.00 dollar
and other good and valuable consideration, paid to the Grantors by the Grantee, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant, bargain, sell, and convey to the
Grantee an easement for the purposes of a permanent, non-exclusive county road, to be used by
and open to the public, over and across the following described parcel of real property situate in
the County of Weld, and State of Colorado, to wit:
All of the real property described in the attached Exhibit "A," and shown on the attached
Exhibit"B."
This Easement is considered to be an "easement in gross" for the benefit of the public and
is permanent.
The Grantee agrees to repair and maintain the easement granted herein at the cost and
expense of the Grantee.

DESCRIPTION OF NON-EXCLUSIVE ROAD EASEMENT IN
WELD COUNTY, COLORADO
Two Parcels of land; Being in the Northeast Quarter(NE1/4) of Section Twenty-six (26),
Township Six North (6N), Range Sixty-five West (65W) of the Sixth Principal Meridian,
County of Weld, State of Colorado; and said parcels contain a combined area of 1174
acres more or less, and being more particularly and separately described as follows:
PARCEL ONE
A strip of land 60.00 feet wide; lying 30.00 feet either side of the following described
line:
Beginning at the East Quarter corner of Section 26 from which the East boundary of the
NEI/4 Section 26 bears N 00°09'32"E, and being the True Point of Beginning;
Thence N 89°45'33" W along the South line of the Northeast Quarter of Section 26 a
distance of 224.46 feet;
Thence leaving said boundary N 79°05'15" W 241,32 feet;
Thence N 83°09'18" W 108.89 feet;
Thence N 89°35'45" W 335.90 feet;
Thence S 89°06'10" W 481.79 feet;
Thence N 89°18'23" W 735.62 feet;
Thence S 88°10'58" W 65.72 feet to a point;
Said point being the end of Parcel One, and N 68°57'36" E 43.88 feet from a location
known as Runway 16/34 Sta. 27+57.06, 972.43 feet left of the Greeley-Weld County
Airport; and said location being the center of a Cul-de-sac.
The sideline boundaries of said strip of land adjacent to the True Point of Beginning are
lengthened or shortened as the case may be so as to end on the East boundary and. South
