HEARING CERTIFICATION DOCKET NO. 96-02 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT#1100 FOR A COMMERCIAL BUSINESS (AUTO AND FARM MACHINERY REPAIR) IN THE A (AGRICULTURAL) ZONE DISTRICT - JOE R. GAONA A public hearing was conducted on February 12, 1996, at 10:00 a.m., with the following present: Commissioner Barbara J. Kirkmeyer, Chair Commissioner George E. Baxter, Pro-Tem Commissioner Dale K. Hall Commissioner Constance L. Harbert - EXCUSED Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller County Attorney, Lee Morrison Planning Department representative, Gloria Dunn The following business was transacted: I hereby certify that pursuant to an amended notice dated December 27, 1995, and duly published January 4, 1996, in the North Weld Herald, a public hearing was conducted on January 17, 1996, at 10:00 a.m., to consider the request of Joe R. Gaona for a Site Specific Development Plan and Special Review Permit for a commercial business (auto and farm machinery repair) in the A (Agricultural) Zone District. At said hearing on January 17, 1996, said matter was continued to January 31, 1996, at which time said matter was again continued to February 12, 1996, at 10:00 a.m. At said hearing on February 12, 1996, Lee Morrison, Assistant County Attorney, made this a matter of record. Gloria Dunn, Planning Department representative, presented a brief summary of the proposal, entered the favorable recommendation of the Planning Commission into the record as written, and suggested the addition of Development Standard #17 requiring compliance with the Aboveground Storage Tank Regulations for any aboveground storage tanks greater than 660 gallons and Condition of Approval #5 requiring the applicant to submit a waste handling plan to the Environmental Protection Services Division of the Weld County Health Department. Responding to questions from the Board, Ms. Dunn confirmed staff has reviewed the applicant's screening plan, which includes the work area, shop, and storage area, and will consist of trees and/or fencing. She also confirmed Condition of Approval #3 of the Planning Commission Resolution, regarding said screening plan, may be deleted; therefore, the additional Condition of Approval previously referred to as #5 would actually be #4. Jeff Stoll, Health Department, responded to questions from the Board concerning a letter from the applicant, Exhibit I for the record, regarding the manner in which oil, antifreeze, and gasoline will be stored and disposed of and confirmed the additional Condition of Approval should also require approval of the waste handling plan. Joe Gaona, applicant, was present and confirmed no air conditioning work will occur 960145 de. PL PL1016 RE: HEARING CERTIFICATION - GAONA (USR #1100) PAGE 2 on site. Discussion was then held concerning Development Standard #8 regarding the septic system for the shop. Mr. Gaona requested additional time to pay for the septic system, and Ms. Dunn noted the house is approximately 60 to 100 feet from the shop. Marvin Bay spoke in support of this proposal and also requested the applicant be allowed one or two years to install the septic system. Mr. Gaona confirmed he has read and understands all Conditions of Approval and Development Standards, and further discussion ensued concerning the septic system. Mr. Stoll suggested the possibility of the Habitat for Humanity house being built and approved with the home septic system engineer-designed to also meet commercial business use. Mr. Morrison suggested Development Standard #8 be amended to reflect the septic system for the business will be combined with the house. After further discussion and Mr. Gaona's consent to said changes, Commissioner Webster moved to approve the request of Joe R. Gaona for a Site Specific Development Plan and Special Review Permit for a commercial business (auto and farm machinery repair) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Baxter. Chair Kirkmeyer clarified the addition of Condition of Approval #4 and Development Standard #17 and the amendment to Development Standard #8 should also be included in the motion. Commissioners Webster and Baxter agreed, and the motion carried unanimously. This Certification was approved on the 26th day of February, 1996.
