While this development does not impact the middle, and senior high schools capacity, the elementary is already over capacity. In addition, there are other approved developments in these attendance areas which will, together with this proposal, have a significant cumulative impact on these As the volume of developments increases in the Mead Elementary area with no alleviation of the existing overcrowded conditions, the ability to provide the same quality education for these new students that is provided students in other areas becomes increasingly difficult. Therefore, the District would oppose this development because it adds to the enrollment of an already overcrowded school. Should this proposal be considered for approval, the District would request the cooperation and participation of the developer and County in implementing a separate agreement to help mitigate the impacts on the schools. This agreement would include the calculation of an appropriate cash in-lieu of land dedication fee to address the capacity concerns at these schools (per the attached chart). This application requests only an increase in size of the present 1.07 acre parcel by 10.91 acres to create a total parcel of approximately 11.162 acres. The applicant does not seek any increase in lots, density, residences or increase of present uses beyond that presently allowed or subsequently allowed under the existing Recorded Exemption No. RE-1811. The inclusion of the additional lands will not create any remaining adjacent parcel less than 35 acres. 1. Water supply statement: a. Domestic use. The prior Recorded Exemption No. RE-1811 required that the applicant extend a domestic water line to the right-of-way of Colorado State Highway 66 for use when the public water supply system was in place. The applicant subsequently connected to such public water supply system (Little Thompson Water District), therefore, there is a water supply of sufficient quality,quantity and dependability to serve the entire proposed lot. Applicant has prior submitted a letter from a water district serving the parcel that the connection had been completed. There is no new dwelling requested or permitted in this application. b. Irrigation water. The site has been historically irrigated with waters from the Highland Ditch Company and waters allocated by the Northern Colorado Water Conservancy District. These waters are of a type and quantity to irrigate the site. In the event that this application is approved, the applicant will apportion such waters from the large parcel to the site in a size applicable to the site. To the best of applicants knowledge, no historic waters have been removed from the proposed parcel. 2. This application does not seek any new dwelling units or lots. The prior Recorded Exemption No. RE-1811 required that the applicant provide a septic system that met approval requirements at the time of approval of Recorded Exemption No. RE-1811. The applicant subsequently provided such a system and has previously provided a statement that the site met the requirements of the underlying zone district and the Weld County Health Department, therefore, the site has an adequate means for the disposal of sewage. � • RECORDED EXEMPTION QUESTIONNAIRE Page 2 3. The parcel is presently being used as a single family residence and for agricultural purposes. The applicant intends to continue such use. The parcel is located in the agricultural zone district. The parcel to be included contains approximately 10.091 acres of nonprime farmland, however, the parcel has been used for limited agricultural production. The portion of property to be included in the new lot has been and will continue to be used for limited agricultural purposes. There are presently no livestock or any improvements to the parcel to be included other than the existing right-of-way for the Highland Ditch on the western boundary of the property. The existing parcel as included in Recorded Exemption No. RE-1811 includes the principal residence and outbuildings of the applicants. 4. The applicants desire to expand the present size of Recorded Exemption No. RE- 1811 to provide the applicants with an additional undeveloped land buffer and open space along Colorado State Highway 66. Additionally, due to a death in the family of the prior family owner of the entire larger farm parcel, the remaining heirs desire to provide to the applicant a larger portion of the historical farm. The new larger lot will continue to be used as it has been in the past as a single family residence on the original Recorded Exemption No. RE-1811 and for agricultural purposes on the proposed added parcel. 5. A description of the location, size, and present use of the area of the proposed new lot is contained in the proposed plat for Amended Recorded Exemption No. RE-1811. 6. There are no unique physical characteristics on the site. 7. All presently existing structures meet minimum setback and offset requirements for the zone district (Agricultural) in which the property is located. There are no requests in this application for any new structures or uses on the added parcel. 8. The applicant in not presently willing to place a conservation easement on the property to maintain farm production or open space on the parcel to be added because of the small size of the parcel to be added (10.091 acres) and considering that the parcel to be added is nonprime farmland 9. A building will not be designated on the proposed lot. There is an existing residence that presently meets all Weld County building and zoning requirements and this application does not seek any new building lots or sites. 10. This application to amend the prior Recorded Exemption No. RE-1811 is consistent with the Weld County Comprehensive plan and any adopted municipal plan, and approved intergovernmental agreements as prior approved in the original application. This application seeks only to increase the size and boundary of the existing parcel and does not request any increase in lots, density, residences or increase of present uses beyond that presently allowed or subsequently allowed under the existing Recorded Exemption No. RE-1811. 11. The added parcel will continue to be used for agricultural purposes as it has been in the past. The present single family residence will continue to be used for residential purposes consistent with the present Recorded Exemption No. RE-1811. These uses were considered in the original Recorded Exemption No. RE-1811 and such uses will continue to be compatible with existing surrounding land uses. 12. A minimum fire flow of 1,000 gallons of water per minute, measured at a residual pressure of 20 pounds per square inch (p.s.i.), is required for one- and two-family dwellings not exceeding 3,600 gross square feet. All other buildings (including larger one- and two-family dwellings) require a minimum fire flow of 1,500 gallons of water per minute, measured at a residual pressure of 20 pounds per square inch (p.s.i.) and may require more depending on the building size and type of construction as per Appendix III-A of the Uniform Fire Code. • If a single family residence is planned in the future, two sets of final site plans must be provided to the Fire District for review and approval prior to the issuance of any building permit in order to assure compliance with the above requirements.
