RE: APPROVE PURCHASE OF SERVICE AGREEMENT FOR ADULT FOSTER CARE
INSPECTIONS AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Purchase of Service Agreement for
Adult Foster Care Inspections for the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, between the Department of Human Services
Area Agency on Aging, and the Weld County Health Department, commencing November 1,
1997, and ending April 1, 1998, with further terms and conditions being as stated in said
agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Purchase of Service Agreement for Adult Foster Care
Inspections for the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, between the Department of Human Services Area Agency on
Aging, and the Weld County Health Department be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 1st day of December, A.D., 1997.

Purchase of Service Agreement
THIS AGREEMENT, made and entered into this I day of Ur: , 1997 by and between Weld County
Division of Human Services' Area Agency on Aging, hereinafter referred to as "AAA" and the Weld County Health
Department, hereinafter referred to as "WCHD".
WITNESSETH:
WHEREAS, AAA administers the Options for Long Term Care program for clients that reside in Weld
County, and
WHEREAS, AAA desires to promote quality of care within Adult Foster Care facilities through
appropriate case management services and yearly certifications and,
WHEREAS, WCHD is a Weld County Governmental organization exiting for the purpose of providing
consumer protection services including inspection, enforcement and education, and,
WHEREAS, AAA desires to purchase Adult Foster Care Survey/Inspection services from WCHD for two
Adult Foster Care Facilities located within Weld County.
NOW THEREFORE, it is mutually agreed:
1. The AAA hereby agrees to purchase the service of a surveyor to inspect two Adult Foster Care Facilities
(The Stanek House, 1513 9th Street, Greeley and the Frontier House 1103 5th Street, Greeley) under the
current State of Colorado Volume 8 regulations by December 31, 1997.
2. The AAA agrees to reimburse Surveyor services at the rate of $150.00 per facility. Reimbursement will
occur once the survey process has been completed.
3. The AAA agrees to provide technical assistance to WCHD staff regarding Adult Foster Care regulations,
procedures, and forms.
4. The AAA agrees to provide the Adult Foster Care Facilities with necessary certification and recertification
packets prior to the actual surveys. AAA will be responsible for obtaining the necessary forms from the
facilities and will inform WCHD regarding the status of the forms.
5. WCHD agrees that the services to be provided under this agreement will begin ten (10) days of the signing
of this agreement.
6. WCHD understands and agrees that the following provisions are part of the official application and as such
become binding upon commencement of the agreement:
a. Agrees to keep records and make reports on the forms required by the AAA in accordance with
guidelines issued by the State of Colorado, specifically,
* To submit the final Inspection for Adult Foster Care Certification/Recertification forms
to the AAA prior to December 31, 1997. If resurvey or additional provisional licenses
are necessary the time frames will be extended appropriately.
To submit all plans of corrections and facility responses within appropriate time frames.
7. No portion of the Agreement shall be deemed to constitute a waiver of any immunities the parties or their
officers or employees may possess, nor shall any portion of this Agreement be deemed to have created a
duty of care with respect to any persons not a party of the Agreement.

8. No portion of the Agreement shall be deemed to create an obligation on the part of the County of Weld,
State of Colorado, to expand funds not otherwise appropriated in each succeeding year.
9. If any section, subsection paragraph, sentence, clause, or phrase of this Agreement is for any reason held or
decided to be unconstitutional, such decisions shall not affect the validity of the remaining portions. The
parties hereto declare that they would have entered into this Agreement and each and every section,
subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more
sections, subsections, or paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional
or invalid.
10. The term of this Agreement shall be from November 1, 1997 through April 1, 1998
11. This Agreement may be terminated upon thirty (30) days written by either party. This Agreement shall be
terminated immediately in the event of loss of funding to the Area Agency on Aging.
IN WITNESS WHEREOF, the parties hereto have executed the Agreement on the day first written above.

Enclosed for Board approval is a Purchase of Service Agreement between the Weld County
Division of Human Services' Area Agency on Aging and the Weld County Health Department.
The agreement allows the Area Agency on Aging to purchase Adult Foster Care inspection
services from the Weld County Health Department.
The two homes that will be inspected are: The Frontier House and The Stanick House. These
inspections are required under the Options for Long Term Care contract.
The rate of reimbursement will be $150.00 per inspection. The term of the agreement will be
from November 1, 1997 through April 1, 1998.
