HomeMy WebLinkAbout980057 RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST CARMEN AND BILLY MATA FOR VIOLATION OF THE WELD COUNTY BUILDING CODE AND ZONING ORDINANCES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Carmen and Billy Mata, VI #9700114, is allegedly in violation of the Weld County Building Code and Zoning Ordinances, and WHEREAS, on the 14th day of October, 1997, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation and determination by staff that said property was dangerous under the Uniform Code for the Abatement of Dangerous Buildings, and WHEREAS, at said hearing, the Board deemed it advisable to continue said matter to January 13, 1998, at 10:00 a.m., during which time said property owner was directed to investigate the abatement of asbestos in the building on said property, and WHEREAS, on the 13th day of January, 1998, a public hearing was held before the Board of County Commissioners, at which Billy Mata, property owner, was present, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until April 1, 1998, to allow adequate time for the property owner to complete the abatement of asbestos in the building on said property and for an inspection of the property by the Department of Planning Services staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County Attorney's Office for legal action against Carmen and Billy Mata to remedy the violation of the Weld County Building Code and Zoning Ordinances, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until April 1, 1998, to allow adequate time for the property owner to bring the subject property into compliance. 980057 PL0824 e :: hG ; O9 ;Ma EA- VI #9700114 - MATA PAGE 2 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 13th day of January, A.D., 1998. The material to be removed is located on the outside of 3807 McAvoy, an abandoned, fire damaged residence. WORK PROCEDURES FOR NON-FRIABLE MATERIALS: Non-friable material will be removed using the following methods. A polyethylene drop cover will be placed along the perimeter of the house as the siding is being removed. The material will be bagged and transported to an approved landfill site. AIR MONITORING: Risk Removal will be responsible for the required OSHA personnels. DISPOSAL: The non-friable asbestos material removed from this project will be transported by Risk Removal, Inc. to the Larimer County Landfill. The address for the landfill is 5887 South County Road 19, Ft. Collins, CO 80526 PERMIT: Risk Removal is responsible for the 14 day notice, application and expense for the permit from the Colorado State Health Department.
