Environmental Protection Services has reviewed this proposal for a concrete batch plant. The following
conditions are recommended to be part of any approval:
1) A NPDES Permit shall be obtained from the Water Quality Control Division of the Colorado
Department of Health for any proposed discharge into State Waterways.
2) An Air Pollution Emission Notice(A.P.E.N.)and Emissions Permit application must be submitted to
the Air Pollution Control Division,Colorado Department of Health for emissions of criteria, hazardous
or odorous air pollutants. Sources of such emissions include but are not limited to the following:
sandblasting operations,mining, spray paint booths,dry cleaners,haul road traffic,composting,boilers
and incinerators.
3) No permanent disposal of wastes shall be permitted at this site.
4) Waste materials shall be handled, stored,and disposed in a manner that controls fugitive dust, blowing
debris, and other potential nuisance conditions.
5) All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects
against surface and groundwater contamination.
6) Adequate toilet facilities shall be provided for the employees and drivers.
7) The maximum permissible noise level shall not exceed the industrial limit of 80 db(A) as measured
according to 25-12-102, Colorado Revised Statutes.
8) A dust abatement plan shall be submitted to the W.C. Health Department for approval prior to
operation. The facility shall have sufficient equipment available to implement the dust control as
required by the W. C. Health Department.
9) The applicant shall remove, handle, and stockpile overburden , soil, sand and gravel from the facility
area in a manner that will prevent nuisance conditions.
10) The facility shall utilize the existing water supply(Little Thompson Water District).
11) An individual sewage disposal system is required for the proposed residence and shall be installed
according to the Weld County Individual Sewage Disposal Regulations.

12) An individual sewage disposal system is required for the proposed control dispatch office and shall
be installed according to the Weld County Individual Sewage Disposal Regulations. The septic
system shall be designed to accomodate the proposed hydraulic load for the employees including the
mechanics and drivers (35 people). The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
13) The applicant proposes to use the existing residence as an office. The septic system has been been
evaluated by our office and is adequate to handle up to five office workers.
14) In accordance with the Above Ground Storage Tank Regulations(7 CCR 1 101-14)a spillage retention
berm shall be constructed around the tank battery. The volume retained by the spillage berm should
be greater than the volume of the largest tank inside the berm. Alternative protective measures may
be allowed provided they comply with the Above Ground Storage Tank Regulations.
15) All fly ash shall be contained inside the batch plant while on site.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of Use by Special Review Permit for a Batch Plant located in the MUD. Our requirements are as follows:
1. I-25 Frontage Access: The applicant has submitted a State Highway Access Permit Application.
Verification of approval shall be provided prior to recording the plat.
2. Internal Circulation: Due to the proposed Waterside PUD projecting 600-800 residential and
commercial uses, the applicant shall be required to hard surface (asphalt or concrete)the circulation
pattern throughout the concrete batch area. Adjacent parking areas shall be controlled with dust
suppressant.
3. Storm Water Retention: The applicant is indicating that a detention pond will be constructed at the
southeast corner of the proposed batch plant area. All storm water detention facilities shall be
designed to contain the storm water runoff from the fully developed site from a 100-year storm and
release the detained water at a quantity and rate not to exceed the quantity and rate of a five-year
storm falling on an undeveloped site. The applicant shall submit a storm water drainage report to
verify the proper sizing of the detention pond. This report shall be prepared and signed by a
registered professional engineer in the State of Colorado.
4. Parking The applicant is indicating that there will be 25-35 employees. Additional parking
shall be identified to accommodate the maximum number of employees.
5. WCR 9.5 Realignment: Would the applicant be willing to reserve 40 feet of future right-of-way
adjacent to the property line to accommodate the realignment of WCR 9.5? The Waterside PUD
has proposed a collector status road that would run parallel to your property line. Future
development of the 115 acres could utilize this new road to relieve additional traffic on the 1-25
frontage road.

Eric, I have reviewed this proposal and have talked with Francisco Martinez on several occasions. Based upon
those conversations and the submittal, I offer the following comments:
RIGHT-OF-WAY CDOT advised Mr. Martinez that we would need additional right-of-way for the proposed
widening of 1-25. The projected need for that widening would be approximately 90 additional feet. He
advised me that he would not set any permanent structures within that area. Any projected need should be
protected by reservation or preferably, dedication as permitted by County regulations.
ACCESS We had a few problems with the accesses for this proposal. Initially two permits were issued, one was
to the house(an existing access proposed for widening) and the other for a new access to the batch plant.
Mr. Martinez constructed the hatch plant access at an unauthorized location and was reluctant to relocate it
to the agreed upon location. I advised him that I would allow the batch plant access to remain provided he
remove the access to the house. He agreed to those terms and I believe that he has removed the access to
the house.
My concerns with this proposal revolve around the volumes of traffic that Mr. Martinez is proposing under
the special use review. He states in the narrative the possibility of 25-35 employees. Total traffic
authorized by our access permit is 21. I think Mr. Martinez needs to be aware that given the volumes he's
proposing to the County and the vehicle types used at a batch plant, it is very likely that he will be
responsible for improvements to the frontage road. The 90 feet of ROW that we are asking, for includes
width for auxiliary lanes.
If possible, the County may want to put their own cap on the amount of traffic using the access without any
improvements. Our access permit will allow 18 cars and light trucks,2 multi-unit vehicles and 5 pieces of
construction equipment before we will require re-evaluation and most likely, auxiliary lanes. I think it is
very important that Mr. Martinez know what he will be responsible for should his business grow the way
he thinks it may.

Dear Mr. Patton:
I have reviewed the submitted material pertaining to the special use request for the construction
of a batch plant to be located east of I-25 and south of Weld County Road 28 (Case Number:
USR-1220, Case Name: Ademar Construction). The property named is within the boundaries of
the Mountain View Fire Protection District and receives service from the District. The Fire
District does not object to this request if the requirements of the District can be met. Based on
my review,I have the following comments and stipulations:
Construction shall be in accordance with the provisions of the 1994 Edition of the Uniform Fire
Code, as ratified by the Weld County Commissioners, and the 1994 Edition of the Uniform
Building Code, as enforced by Weld County.
In accordance with Section 903.2 of the Uniform Fire Code, an approved water supply capable of
supplying the required fire flow for fire protection shall be provided to all premises upon which
facilities, buildings or portions of buildings are hereafter constructed or moved into or within the
jurisdiction. The batch plant is considered a facility and will also have buildings on the site. A
minimum fire flow of 1,500 gallons of water per minute, measured at a residual pre:ssure of 20
pounds per square inch (p.s.i.), will be required. Water supply must be provided by a hydrant
located within 450 feet of the facility as measured along the fire apparatus access road and
around the exterior of the facility. A letter must be provided to the Fire District from the water
supplier that the required fire flow is available.
Before contraction may begin, fire department apparatus access must be provided for all
structures in excess of 150 feet from a public access road. Fire apparatus roads shall be
extended so fire apparatus may reach to within 150 feet of all portions of buildings or facilities.
Apparatus access roads shall be a minimum of 20 feet in width and be designed and maintained
to support the imposed loads of fire apparatus (60,000 pounds). Roads must have a surface that
provides all-weather driving capabilities. Roads in excess of 150 feet in length must be provided
with approved provisions for the turning around of fire apparatus. The minimum turning radii for
all turns shall be thirty-five (35) feet inside turning radius and forty-eight (48) feel: outside
turning radius.

Approved address numbers shall be placed on the building or at the entrance to the site in such a
position to be plainly visible and legible from the street fronting the property. Address numbers
or letters shall contrast with their background.
A final site plan showing the location of existing fire hydrants or proposed fire hydrants,
waterline sizes, and available fire flows must be submitted to the Fire District for review and
approval.
A final inspection of the facility will be required by a member of the Fire District before
operations commence.
The Fire District reserves the right to make further comments as the project proceeds.
Nothing in this review is intended to authorize or approve of any aspect of this project that does
not comply with all applicable codes and standards. We appreciate being involved in the
