SUBJECT: West Hill -N -Park Third Filing

Mr. Robert Zoyiopoulos has requested that the Board approve 86 lots originally shown on the
Third filing for West Hill -N -park application submitted and approved in 1984, but were deleted
when the Third Filing was resubdivided in 1989 at the request of the applicant. The area of the
86 lots is shown as a future filing on the vicinity map on the resubdivision plat, but the 86 lots
were not platted as part of the resubdivision of theThird Filing for West Hill -N -Park.
The Subdivision Ordinance requires that a sketch plan, preliminary plan, and Final plat be
submitted and approved for a Fourth Filing before any of the 86 lots could be sold or built
on. The property is currently zoned R-5 (Mobile Home Residential); therefore, no rezoning
would be required.
I am recommending that the Board only require that a Final plat application be submitted
and approved for the platting of the 86 lots if the applicant meets all of the Final Plat submittal
requirements of Section 7 of the Weld County Subdivision Ordinance. This recommendation
is based on my understanding that the area of the 86 lots has not changed from the original
design as proposed in 1984. Requiring the sketch plan and preliminary plan applications
seem unnecessary if no design or construction changes are anticipated. The zoning for
residential development is existing and compliance with the Comprehensive Plan should not
be an issue when the final plat application is considered.

Dear Commissioners:
Hill -N -Park Subdivision Third Filing was approved and recorded by Weld County on May 17,
1990. The final construction for the Third Filing began this past summer based on the
approved plans recorded May 17, 1990.
Upon the complete installation of the utilities, Sue Skaley from U.S. West noticed that the
Third Filing wasn't complete and 86 lots were excluded.
At the present time, all utilities are installed in the Third Filing, including the 86 orphan lots.
The paving of the roads in this area is the only item remaining to complete the project.
We would like to request that the 86 orphan lots be approved with the Third Filing. This
approval would allow the completion of the project as approved by Weld County in May 1990
without the additional time and expense of refiling the subdivision as a Planned Unit
Development.

Dear Mr. Allison:
West Hill N Park, Inc. wishes to re -subdivide West Hill N Park Third Filing.
The Third Filing has been through the entire approval process, but the plat
has not been filed.
The filing has not occurred due to West Hill N Park, Inc. and the County
Commissioners being unable to implement any improvements agreement
satisfactory to both parties. At a work session, May 8, 1989, the staff
suggested a possible solution to be a re -subdivision, which we are now
pursuing.
The Third Filing as originally approved contained 194 lots. The
re -subdivision will reduce the number of lots to 108. The re -subdivision will
not change any of the following:
1. Lot lines
2. Lot sizes
3. Parks
4. Street rights -of -way
5. Easements
6. Drainage
The entire original Third Filing has been graded for streets and overlot, and
drainage consequently, the drainage from the proposed re -subdivision will not
create any problems.
The utility easements and providers remain unchanged and were approved by the
utility coordinating committee August 9, 1984. The utilities, streets, and
gutters in the proposed re -subdivided Third Filing are in place.
The traffic circulation pattern for the re -subdivided Third Filing will remain
interconnected with the previous filings and will not create any dead-end

streets. Lake Mead Drive will not be platted north of the north right-of-way
line of Casa Grande Drive (see attached map), therefore, there will not be a
need for a temporary cul-de-sac.
