RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST LOUISE L. KELLEY AND MR. AND MRS. YOCUBETS,
TENANTS, FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Louise L. Kelley and Mr. and Mrs. Yocubets, tenants, VI #9600251, are
allegedly in violation of the Weld County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 7th day of January, 1997, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Louise L. Kelley, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to delay referral of
said violation to the Weld County Attorney's Office for a period of thirty (30) days to allow
adequate time for the property owner and tenant to bring the subject property into compliance
and for an inspection of the property by the Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to proceed with legal action against the above
named individuals without further Board action if the subject property is not brought into
compliance within thirty (30) days.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that if said violation still exists on February 10,1997, the Weld County
Attorney be, and hereby is, authorized to proceed with legal action against Louise L. Kelley and
Mr. and Mrs. Yocubets, tenants, to remedy the violation of the Weld County Zoning Ordinance,
and any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties.

December 19, 1996 Letter sent to the property owner indicating that the violation case was
scheduled before the Board of County Commissioners.
The derelict vehicle and three horses are still located on the property, therefore is a violation of
Sections 31.2, 31.3.9 and 31.5.4, of the Weld County Zoning Ordinance. To bring the property
into compliance the derelict vehicle and one horse must be removed from the property. As an
alternative, the derelict vehicle could be licensed and in running condition or stored within a
structure or screened from all adjacent properties and public rights of way.
The Department of Planning Services also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties.

The uses on the above described property are being considered as a zoning violation of Section 31.2 and
31.3.9 of the Weld County Zoning Ordinance. This is not a use allowed by right in the Agricultural zone
district.
To bring the property into compliance the number of animal units must be brought to two and the
noncommercial junkyard must be removed from the property or be screened from all adjacent properties
and public rights of way. If screening is to be used, a detailed screening plan must be submitted to and
approved by the Department of Planning Service's staff prior to installation.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty)
days from October 17, 1996 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners'to consider whether to refer the
violation to the County Attorney's office for legal action.

Dear Ms. Kelley:
It has come to the attention of the Department of Planning Services' staff that the uses on your
property (1.705 Railroad Diagonal Street, Evans) may not be in compliance with the Weld
County Zoning Ordinance. The potential noncompliance with the zoning ordinance is a
noncommercial junkyard consisting of derelict vehicles, car parts (part of engine, front seat),
used building materials on north side and other trash and debris on the property. The number of

neighborhood. We currently have several cases pending and are receiving an increase in the number
of citizen complaints. The need to have a safe place for our families is one in which we all try to

As you are aware the City of Evans borders an area of unincorporated Weld County southwest of
the intersection of 17th Avenue and 37th Street in the vicinity of the Valley View Subdivision.
Over the past few years City staff has received numerous complaints regarding activities being
conducted in this general area related to zoning and building issues. A majority of these
complaints were related to the storage of junk vehicles, questionable building practices, unsafe
structures and general trash and debris being allowed to exist on the properties. As the land which
surrounds this area is being developed these complaints have intensified in number and frequency.
On July 9, 1996 a number of residents from this area attended the City of Evans Planning &
Zoning Commission meeting and requested the City's assistance in regard to addressing these
issues. These residents reiterated there concerns with junk vehicles, dilapidated buildings, trash &
debris and illegal business, activities such as repair shops being operated in this area.
Realizing that County staff has already begun abatement proceedings on at least two properties in
this area, those being the Parker and Downing parcels, City staff is, requesting your assistance in
addressing violations of the County planning and building codes throughout the area. City staff
does appreciate the fact that there are a number of properties in this area that are well maintained
and would not be impacted by stricter enforcement of the existing regulations; however, with
development rapidly encroaching into this area and the increase in the number of complaints the
City is receiving it is apparent that the need to address this issue is becoming more critical.
Therefore, staff with the City of Evans would like to meet with you and your staff to discuss
possible solutions to help remedy the situation. Please contact us by calling 339-3475 to arrange a
