Consultants for Land,Mineral and Water Development August 19, 1998 Tom Schriner, Hydrologist State of Colorado Division of Minerals and Geology 1313 Sherman Street, Room 214 Denver,CO 80203 RE: Kobobel Pit,DMG File No. M-98-043 Dear Mr. Schriner: Our Firm represents Bill Kobobel who is applying for a sand and gravel mining permit with The Division of Minerals and Geology(DMG), which is referenced above. In obtaining the DMG permit, a surrounding property owner, Marvin D. Hopper, has expressed his concern that this operation will effect his well. Currently the well, that Mr. Hopper contends is being effected, is not registered with the State Engineers Office. It is our understanding that he is currently trying to permit the well for domestic use and for one acre of lawn irrigation. Exhibit A is the vicinity map showing the location of the proposed mine and the Hopper well. Between the mine and the well there is a drainage ditch which carries runoff and irrigation waste water. This ditch will recharge the groundwater in the area and act as a buffer between the mine and well. Immediately above the well runs the Godding Ditch. As a result of a dispute between Mr. Hopper and the Ditch Company over water in his basement,the Gadding Ditch was lowered next to Mr. Hoppers house. Therefore we believe leakage from the Godding Ditch recharges Mr. Hoppers well and floods his basement. The attached Cross Section (Exhibit B) depicts the location of the mining operation with relationship to the Hopper well. As you can see on the illustration,the Hopper well is approximately 1,700 feet from the closest point of the proposed mining operation. Additionally, the predicted cone of groundwater depression is 1,000 feet away. The water table in this area is fairly high. As you can see on the illustration, Mr. Hoppers well is approximately 16 feet deep with the water level at 8.5 feet. The proposed mining operation will mine to a depth of 15 feet. I have attached a copy of the mining plan map as it was submitted to the DMG for your use. Attached are copies of correspondence with the Division of Minerals and Geology, State of Colorado Engineers and Weld County Planning a d Zoning. The Hopper well is at present being registered with the state as an existing well which has been active for over 50 years. The division of Minerals and Geology ( attached letter )has indicated that the sub- irrigation for the pasture between the Hopper well and the proposed mining property has a possibility of being effected which could allso effect the well. There is an irrigation ditch about 50 feet from on the upper side of the well and house which has water only during the irrigation season of four months which does raise the water level a few inches during the irrigation cycle. The ditch is 3 feet higher than the land level below the ditch. We are requesting that conditions be incorporated in the mining permit by the Board of Commissioners that if the water level drops below a usable level that the mining operation must supplement the water supply for the well. The Division concludes that there is a fair to moderate potential for the proposed mining operation to adversely affect the 8-acre subirrigated pasture. The operator will be required to perform either option A or option B noted in the memo to demonstrate that impacts to the hydrologic balance of the surrounding area be minimized. There is 8 acres of pasture across the road from the proposed mining site which extends about 600 ft. south. Just south of the pasture is the 12 acre hay field. Our west property line is the same elevation as the proposed pit property. Our property has a gradual increase in elevation as it goes east. We have one other concern not covered in the original letter. The water table for our lawn well in about six ( 6 feet below the surface of the ground with a depth of about five ( 5 ) feet. This level is fairly constant summer and winter. At this level the hay field and the pasture are sub irrigated. If the water table drops, then the fields could be lost from production. Losing the well would require watering the lawn with Left Hand water which would be cost prohibitive. Thank you, M. D. There is a concern for safety with the truck traffic on WCR 20 and 1/2 from the development property to WCR 7. All mining traffic should be required to adhere to the rout specified from the property to road 7. As an alternate rout for the trucks to enter WCR 7 would be to coordinate with the property immediately to the north,which is also mining the gravel,to utilize their entrance onto WCR 7.This would also elevate the traffic at the intersection of WCR's 7&20'/.There is already a truck acceleration lane from the Camenisch mining onto WCR 7. This would save the county from having to develop a turn lane at the intersection of WCR 7&20 h and paving WCR 20 % from WCR 7 to the Kobobel property. Also the bridge just east of WCR 7 be rebuilt to handle the loaded trucks.Using this alternate would be a savings for the county. The residents in the immediate area of the intersection use the dirt road of WCR 20 %x east of WCR 7 for walking,bicycle riding,and horse back riding because the other three legs of that intersection are paved and have heavy and high speed traffic. Since this is a dirt road I was to understand the county would pave it. I also understood that the county'will build a new bridge over the irrigation ditch. I was also told that the hours of operation were Sam to 6 PM Monday through Saturday. However the trucks can travel from sun up to sun down As we speak today on this subject the tracks start around 5am to 5:30am to the other gravel pits because there is no enforcement. flow do you propose to regulate anything in this area and by whom? I oppose this pit because of the extra traffic, the hours they travel, the noise level, the noise level of the proposed batch plank the safety of my two 9 year old children and the ugliness of the site as in the example of the Caminish gravel pit down the road. A suggestion isdwhy don't you route these trucks away from the houses to the frontage mad on the pastureland? Also why don't you require bushes and trees in front of these gravel pits? Lastly how dose to houses do you expect to have batch plants and what is the decibel level going to be?
