MENTS IN SUNSET VALLEY SUBDIVISION, A SUBDIVISION OF PART as OF THE EAST HALF OF LOT 3 OF THE NORTHWEST QUARTER OF SECTION 6, TOWNSHIP 5 NORTH, RANGE 65 WEST OF THE 6TH F. M. , .-t WELD COUNTY, COLORADO, 03 N Trat h- WHEREAS, a petition has been presented to the Board of County Com- in missioners, Weld County, Colorado, by Alex Wiegel and Irene W. Wiegel, ask �� ing that all streets and certain utility easements located in Sunset Valley Sub - el I division, Weld County, Colorado, be vacated, abandoned and closed; said sub - N division being wholly owned by the aforesaid petitioners, and said streets and .o utility easements being located within said subdivision and more particularly o described as follows, to -wit: 0 0 22nd Avenue, also known as 22nd Avenue Court; Lew Drive, also known as First Street; Key Road, also known as First Street Road; and ti All utility easements except the utility easement located along the north border of said Sunset Valley Subdivision; and 4. WHEREAS, no objections to said petition for the vabation, abandonment and closing of said streets and utility easements have been received in the of- fice of the Board of County Commissioners, Weld County, Colorado, and WHEREAS, it appears that the necessities of the public do not require said streets and utility easements, and WHEREAS, the Board of County Commissioners, Weld County, Colo- rado, believes it to be in the best interest of the public of Weld County to ap- prove said petition. NOW, THEREFORE, BE IT RESOLVED, BY' THE BOARD OF COUNTY COMMISSIONERS, WELD COUNTY, COLORADO, that the aforesaid roads and utility easements all located in Sunset Valley Subdivision, Weld County, Colo- rado, be, and they are hereby declared vacated, abandoned and closed in ac- cordance with the submitted petition. Jel 680421 PETITION TO VACATE TO: THE HONORABLE BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO Gentlemen: We, the undersigned citizens of your County, respectfully represent as follows: 1. That a certain parcel of land, to -wit: Sunset Valley Subdivision, the legal description of which is set out in Para- graph 5, was heretofore subdivided by its then owner; 2. That by a certain instrument of dedication dated Oct- ober 11, 1955, signed by such owner and entitled "Dedication" to which was attached a plat or map of said subdivision (a true copy of which is attached hereto as Exhibit "A"), the roads and streets thereof were dedicated to the public use together with a perpetual right of way to the use of the roads and streets thereof for the laying of gas and waterpipes, mains, etc., to erect tele- phone poles, and to use the same for public thoroughfares. That certain other utility easements were also reserved as set out on the attached map, Exhibit "A". That subsequent to such subdivi- sion and dedication, Alex Wiegel and Irene W. Wiegel became the joint owners of the above described land; 3. That no streets or roads dedicated by instrument of dedication have been established any way or used by the public, save and except described as Second Street Road, which is also Street; 4. That none of the utility easements reserved by the instru- ment of dedication above described have been used, save and except for the easement along the North border of the subdivision, nor do the utility companies have any need or intention to use such easements except for the easement along the North border of the subdivision; the above described or maintained in the street thereon known as Second 5. That the legal description of Sunset Valley Subdivision is: All that part of the East Half (E 1/2) of Lot Three (3) of the Northwest Quarter of the Northwest Quarter (NWNW) of Section Six (6), Township Five (5) North, Range Sixty-five (65) West of the 6th P.M., Weld County, Colorado, described as follows: Beginning at the NCrtheast Corner of Lot Three (3) in the Northwest Quarter of the Northwest Quarter (NWNW) of Section Six (6), Township Five (5) North, Range Sixty-five (65) West of the 6th P.M., according to the subdivision of lands by the Union Colony of Colo- rado; thence South along the East line of said Lot Three (3), 453 feet; thence South 89° 19' West 208.7 feet; thence South 208.7 feet to the South line of said Lot Three (3); thence South 89°19' West along said South line 119.3 feet; thence North 661.7 feet to the North line of said Lot Three (3); thence North 89°19' East along said North line 328 feet to the point of beginning. 6. That the best interests of the people of Weld County would be served by this petition being granted and approved according to its prayer. WHEREFORE, petitioners pray that the Honorable Board of County Commissioners, for themselves and for the people of Weld County, vacate and divest Weld County of all right, title and interest in the following streets and roads as shown on Exhibit "A" 22nd Avenue, a/k/a 22nd Avenue Court, Lew Drive, a/k/a 1st Street, and Key Road, a/k/a 1st Street Road, and in the utility easements shown thereon except the utility easement along the North border of Sunset Valley Subdivision.
