RE: ACTION OF THE WELD COUNTY BOARD OF COMMISSIONERS REGARDING
VIOLATION #9900188 AGAINST SHAWN AND JENNIFER LEE FOR VIOLATION OF
THE WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Shawn and Jennifer Lee, VI #9900188, are allegedly in violation of the
Weld County Zoning Ordinance, and
WHEREAS, on the 10th day of August, 1999, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Jennifer Lee, property owner, was present at said hearing, and
WHEREAS, at said hearing of August 10, 1999, the Board of County Commissioners
determined the property is now in compliance, and deemed it advisable to dismiss said matter.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #9900188 against Shawn and Jennifer Lee be, and hereby is,
dismissed.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 10th day of August, A.D., 1999.

CASE SUMMARY
July 6, 1999 Initial complaint received about commercial trucking activity (Roberts Excavating)
occurring on property in the A (Agricultural) zone district.
July 12, 1999 5 day letter sent. (Sierra records reflected Lu O Oram as the owner of the property.)
Further research into the AIMS system reflected the actual current owners as Shawn and
Jennifer Lee.
July 22, 1999 Thirty day notice sent.
July 23, 1999 Conversation between Julie Chester, Lead Planner, and Sharyn Frazer, Code
Compliance Officer. Ms. Chester had a letter dated June 14, 1999, from Shawn and
Jennifer Lee delineating the situation occurring on the property. The letter was an
agenda item at Planning Staff and the Planners agreed they would need more
information before making a determination.
July 26, 1999 Telephone call between Cliff Roberts (Father of Jennifer Lee) and Sharyn Frazer, Code
Compliance Officer, regarding the activity. It was agreed that they would attend the
August 10, 1999,violation hearings and address the Board of County Commissioners.
July 30, 1999 Letter sent to Shawn and Jennifer Lee requesting attendance at the violation hearings
scheduled for August 10, 1999, at 10:00 a.m.
The Department of Planning also recommends that the County Attorney be authorized to proceed with legal
action against any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties.
Copies of the violation materials are available at the Department of Planning Services' office or the Weld County
Attorneys Office.

Dear Mr. and Mrs. Lee:
The property referenced above remains in violation of the Weld County Zoning Ordinance. I have scheduled
a meeting with the Board of County Commissioners on August 10, 1999, at 10:00 a.m.,to consider the violations
occurring on the property. This meeting will take place in the County Commissioners' Hearing Room, First Floor,
Weld County Centennial Center, 915 10th Street, Greeley, Colorado.
In a telephone conversation with Cliff Roberts, on July 26, 1999, the issues occurring on the property were
discussed. The Planning Department is in receipt of your letter dated June 14, 1999, delineating the uses
occurring. At this time, staff does not have the capability to grant the extension of time required to correct the
violation. It is recommended that you or a representative be in attendance to answer any questions the Board
of County Commissioners might have about the violations.

Dear Julie,
My dad, Cliff Roberts, told me that he discussed with you our problem with neighbors Li 5
complaining about truck traffic coming from our property. We recently bought a six acre plot e-e-(
with a run down home which had been the headquarters for a dairy (Orin Dairy). i he
outbuildings were in bad shape and there were several piles of junk and debris and dozens of
tires.
My brother, Gerald Roberts owns and operates the Roberts Excavating Company and we
made a deal with Gerald to store his equipment at our place until he completes construction of
a facility near Mead, Colorado where his offices are currently located. In exchange for
allowing Gerald to park his equipment at our place, Gerald agreed to use his equipment to
clean up the dairy area and remediate the entire site. This working arrangement is currently
in progress after which Gerald will be moving his equipment to Mead.
We have talked to Gerald and his two drivers who operate two 12 yard tandem dump trucks
about watching their speed on the county roads in our area and they have assured us that
they try and hold their speed at or below 35 MPH while passing any residences. They also
report that the roads are also heavily traveled by trucks hauling gravel from the several gravel
pits in the area. We wonder if the complaining neighbors are mistaken about which trucks are
causing the problem.
In any case, we do not wish to cause aggravations to our neighbors and hope they will be as
patient with the activities associated with our place as we are with the activities of our
neighbors. Please pass this letter on to the compliance people in Weld County and give us a
call if there is anything further we can do to keep the peace.

The uses on the above described property are being considered as a zoning violation of Section 31.2 of the Weld
County Zoning Ordinance. The operation of a commercial excavating business (Roberts Excavating) is not a use
allowed by right in the A(Agricultural) zone district. The business will have to cease operation on and from the
property, or you will need to contact our office and meet with a Planner to discuss the possibility of a Use by
Special Review permit.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however, we
have no discretion in this matter if you fail to correct this violation. You have 30(thirty)days from July 22„ 1999,
to correct this zoning violation. Failure to do so will result in this office scheduling the violation before the Board
of County Commissioners to consider whether to refer the vio'!ation to the County Attorney's Office for legal
action.
Any information you have that may help to resolve this matter will be helpful. This office is ready to be of any
