RE: APPROVE CONTRACT FOR TITLE II -A AND TITLE III FUNDS BETWEEN HUMAN
SERVICES AREA AGENCY ON AGING AND GOVERNOR'S JOB TRAINING OFFICE
AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Contract for Title II -A and Title III Funds
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Human Services Area Agency on Aging, and the
Governor's Job Training Office, commencing July 1, 1995, and ending June 30, 1996, with further
terms and conditions being as stated in said contract, and
WHEREAS, after review, the Board deems it advisable to approve said contract, a copy of
which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Contract for Title II -A and Title III Funds between the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf
of the Human Services Area Agency on Aging, and the Governor's Job Training Office be, and
hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized
to sign said contract.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 19th day of June, A.D., 1995.

CONTRACT
THIS CONTRACT, made thisOukiday of L €- , 1995, effective 71A. Ly i , 1995, by and
between the State of Colorado, represented by the Governor's Job Training Office, hereinafter
referred to as GJTO, or the State, and Weld County Area Agency on Aging, hereinafter referred to
as the Contractor.
WHEREAS, authority exists in the law and funds have been budgeted, appropriated and otherwise
made available, and a sufficient encumbered balance thereof remains available for payment in Fund
Number 100, Appropriation Number i , Contract Encumbrance NumberWA5a f and
WHEREAS, the required approval, clearance and coordination has been accomplished from and with
appropriate agencies; and
WHEREAS, the Governor has received a grant of federal funds under the Job Training Partnership
Act of 1992 (Public Law 97-300)) as amended, and for these purposes; and
WHEREAS, the Contractor was selected by GJTO in an open and competitive Request for Proposal
(RFP #BF -01495) process to provide GJTO services.
WHEREAS, the participants served under this contract will be either JTPA Title II -A eligible,
(economically disadvantaged) or Title III EDWAA eligible (persons who have lost their
employment due to economic circumstances beyond their control) and
WHEREAS, the Contractor will provide employment and training services with JTPA Title II -A
funds to individuals who are 55 years of age and older, and with Title III, EDWAA funds serve
individuals who are 50 years of age and older.
NOW THEREFORE, in consideration of the mutual promises hereinafter set forth, the parties agree
as follows that:
I. DEFINITIONS
A list of definitions to be used in the interpretation of this Contract is attached hereto as
Attachment 1 and by this reference is incorporated herein.

II. STATEMENT OF WORK
The Contractor agrees to perform, in a professional and workmanlike manner, the obligations
and responsibilities set forth in the "Scope of Services" (Section A.5).
A.1 Area Covered
The Contractor shall serve the following geographic area:
Weld County, Colorado
A.2 Responsible Administrator
The performance of the services required hereunder shall be under the direct
supervision of the Director of Weld County Area Agency on Aging, who is hereby
designated as the administrator in charge of this project.
A.3 Funding and Budget
The Contractor shall receive $34,800 from Program Year 1995, Title II -A JTPA
Older Worker Funds and $10,000 from Program Year 1995 Title III Economic
Dislocation and Worker Adjustment Assistance Act (EDWAA) funds, for a total
amount of $44,800.
A.4 Budget Narrative
A.4.a The $34,800 of Title II -A funds provided under this Contract will be used
for:
ADMINISTRATION
Three Thousand Four Hundred Eighty Dollars ($3480) will be used for the
following administrative costs:
One Thousand Five Hundred Eight Dollars ($1508) will be used to
pay 4% of the salary and fringe benefits of the Director.
Eight Hundred Eleven Dollars ($811) will be used to pay 2% of the
Salary and Fringe benefits for the Fiscal Officer.

Four Hundred Ninety Dollars ($490) will pay 2% of the salary and
fringe benefits for the Client Services Technician.
Six Hundred Seventy One Dollars ($671) will pay for the operating
costs associated with the administrative staff.
DIRECT TRAINING
Twenty Two Thousand Six Hundred Twenty Dollars ($22,620 will be used
for the following Direct Training activities:
Eleven Thousand Six Hundred Two Dollars ($11,602) will be used
for a portion of the salary and fringe benefits of the Client Service
Technician.
Four Thousand Dollars ($4,000) will be used for On -The -Job -
Training.
Five Thousand Three Hundred Forty Dollars ($5,340) will be used for
tuition, books, fees, computer lab training, and work experience.
Six Hundred Dollars ($600) will be used for staff training and travel.
One Thousand Seventy Eight Dollars ($1,078) will be used for
facility costs associated with the training activities.
TRAINING RELATED
Eight Thousand Seven Hundred Dollars ($8,700) will be used for the
following training related activities.
Six Thousand Five Hundred Ninety Dollars ($6,590) will be used to
pay for a portion of the salary and fringe benefits for the Client
Services Technician .
Seven Hundred Fifty Seven Dollars ($757) will be used to pay a
portion of the salary and fringe benefits for the Area Agency on
Aging Assistant for Hispanic Elderly Outreach.
One Thousand Dollars ($1,000) will be used for Initial Assessment
tools, advertising, employer outreach and other needed materials.

Three Hundred Fifty Three Dollars ($353) will be used for mileage
for job development, outreach, dissemination of information and
follow-up of clients.
A.4.b The $10,000 Title III EDWAA funds provided under this Contract will
be used for:
ADMINISTRATION
One Thousand Dollars ($1,000) will be used for the administration of this
program for the following:
Four Hundred Eighty Two Dollars ($482) will be used for 1% of the
salary and fringe benefits for the Director of Area Agency on Aging
for the management of the grant.
Four Hundred Fifty Four Dollars ($454) will be used for 1% of the
salary and fringe benefits for the Fiscal Officer associated with this
contract.
Sixty Four Dollars ($64) will be used for the operating costs
associated with the administrative staff.
RETRAINING SERVICES
Five Thousand Six Hundred Ninety Dollars ($5,690) will be used for the
following Retraining services:
Two Thousand Nine Hundred Dollars ($2.900)will be used for 10%
of the salary and fringe benefits for the Client Services Technician.
Two Thousand Seven Hundred Ninety Dollars ($2,790) will be used
for tuition, books, fees, OJT's, and basic educational computer lab.
BASIC READJUSTMENT SERVICES
Three Thousand Three Hundred Ten Dollars ($3,310) will be used for the
following Basic Readjustment services:
Two Thousand Nine Hundred Dollars ($2,900) will be used to pay
10% of the salary and fringe benefits of the Client Services
Technician.

Two Hundred Sixty Dollars ($260) will be used for the
assessment of the participants.
One Hundred Fifty Dollars ($150) will be used for mileage, outreach,
and follow-up of the program.
SUPPORTIVE SERVICES
No funds will be allocated for this category.
A.5 Scope of Services
In consideration of the Title II -A funds to be received from GJTO, the Contractor
shall do the following:
A.5.a.1. Recruit eligible Older Workers through, Newspaper advertisements, Posters,
Brochures, Church bulletins, South Aims Campus, Recruitment letters, Referrals
from employers seeking opportunities for Older Workers, Presentations, etc..
A.5.a.2. Enroll thirty (30) Title II -A JTPA eligible older worker participants in the
program, and of these place twenty one (21) into unsubsidized employment.
A.5.a.3. Enroll Twenty-two (22) of the participants into hard skills training at Aims
Community College, Front Range Community College or the Weld County Job
Service Learning Center Lab.
A.5.a.4. Enroll five (5) participants in an on-the-job training activity.
A.5.a.5. Coordinate with the Title V Green Thumb Program to enroll three (3)
participants into a short-term subsidized training site.
A.5.a.6. Provide work experience opportunities for three(3) participants.
A.5.a.7. Place twenty one (21) of the participants into no less that 20 hours per week,
unsubsidized employment, at an average placement wage of $5.50 per hour.
A.5.a.8. Assure that a staff member attend all of the Older Worker Network
meetings.

In consideration of the Title III EDWAA funds to be received from GJTO, the Contractor
shall do the following:
A.5.b.1. Recruit eligible participants through: newspaper advertisements; posters;
brochures; church bulletins; south Aims Campus recruitment; recruitment letters to
all 55 plus job service registrants; and presentations.
A.5.b.2. Enroll eight (8) Title III, JTPA-eligible participants into the program.
A.5.b.3. Enroll six (6) participants into basic skills and/or occupational skills
training, utilizing Aims Community College, Front Range Community College, or
the Weld County Job Service Learning Lab for hard skills training.
A.5.b.4. Provide on-the-job training for two (2) participants.
A.5.b.5. Place six (6) participants into, unsubsidized employment, for no less than
20 hours per week, and at an average wage of $5.50 per hour.

A.14 Retention
(a) Of all Title II -A Older Worker placements, 85 percent will have retained
employment 90 days following termination from the program.
(b) Of all Title III EDWAA participants, 85 percent will have retained
employment 90 days following termination from the program.
A.15 Performance Evaluation
The planned participant information and training activities are for evaluation only.
In the eventthat the Contractor'sperformance is not within +/- 15% of these goals,
the State shall, in its sole discretion, retain the right to institute a program of technical
assistance proceeding to, if necessary, corrective action.
The Contractor understands and agrees that failure to achieve the goals as set out in
the contract will -result in a disallowance of reimbursement to the extent of such
failure as provided in JTPA Letter #91-17.
III. REPORTING REOUIREMENTS
A. Compliance
The Contractor agrees to:
A.1 Determine, verify and document the -eligibility of all participants in
compliance with GJTO's eligibility and documentation and verification
policy. For participants required to be -economically-disadvantaged, the
following information should be collected: residency, age, family size,

individual and total income, citizenship, public assistance status, Military
Selective Service Act compliance, and, if appropriate, barriers to
employment. For dislocated workers Economic Dislocation and Worker
Adjustment Assistance Act (EDWAA) programs, the following must be
documented: citizenship or work authorization, Military Selective Service
Act compliance, Job of Dislocation, and documentation of dislocated worker
status.
A.2 Establish and maintain a participant file for each person enrolled in a Title
II -A JTPA program under this Contract. The participant file will, at a
minimum, consist of: a completed JTPA Application, Transaction/
Movement, and Termination forms, Individual Service Strategy (ISS),
grievance procedure, reading and math tests and documentation/ substantia-
tion of eligibility. For Title II, supportive service and ISS must be included
as appropriate.
A.3 Establish and maintain a participant file for each person enrolled in a Title III
JTPA program under this Contract. The participant file will, at a minimum,
consist of: a completed EDWAA Application, Transaction/Movement, and
Termination forms, Individual Reemployment Plan (IRP), grievance
procedure, reading and math tests, along with documentation/ substantiation
of eligibility. A work history must be included as part of the EDWAA
application.
B. Management Information Systems
The Contractor agrees:
B.1
To utilize eligibility systems that assure only JTPA-eligible and enrolled
persons will be served, and participant or applicant data will be maintained
in the VAX system on each enrolled participant or applicant.
B.2 The contractor shall ensure that the codes 05WAA (Title II -A) and D5WAA
(Title III) appear in the CTN field for each training activity directly paid for
-by this contract, when the participant record is viewed through the statewide
Virtual Database. This may be done either by directly entering the above
code in the CTN field, or by entering the code into the appropriate portions
of the Contractor's contract system, and entering locally -defined codes into
CTN, at the discretion of the Contractor.
B.3 That only those participants for whom complete, timely data have been
_provided will be considered in determining whether the terms of this Contract
-have been fulfilled.
C. Financial
C.1 The Contractor shall report and expend the funds in accordance with the
Budget Information Summary attached to exhibits and attached hereto and
-by this reference incorporated herein.

C.2 The Contractor shall record expenditures in its accounting records by contract
and contract Budget Information Summary line item , and shall report
expenditures to GJTO monthly on an Expense Report (ER), inaccordance
with the "GJTO Subrecipient Financial Procedures", which shall be provided
to the Contractor.
C.3 All funds allocated but not expended for the authorized purposes of this
Contract, shall be deobligated by GJTO within 45 days after the Contract
ending date.
C.4 The Contractor shall be reimbursed by GJTO under this Contract by
submitting a signed and dated Cash Request (CR).
C.5 The Contractor shall limit cash to the minimum amounts needed and shall
time cash requests to be in accord only with the actual immediate cash
requirements of the contractor in carrying out the purpose of this contract.
The timing and amount of cash requests shall be as close as is
administratively feasible to actual disbursements by the Contractor.
D. PropertyManagement
To purchase property with JTPA funds, a Property Requisition and Authorization
-Form (PRAF) must be submitted to, and processed by, GJTO. See Paragraph VI,
General Provisions, and Property Policy Guidance Letter PGL 93-10-F4.
E. Sanctions
Failure to comply with eligibility, participant file, management information systems,
financial and/or property reporting requirements will result in delay or denial of
approval of Cash Request (CR) for payment.
IV. CONTRACTOR TRAINING
Disbursement of funds is contingent upon the Contractor participating in Contractor
Training, which relates to Financial and MIS, and is offered by GJTO on a bi-monthly basis.
-Exceptions may be given only with written approval by the Director or Deputy Director of
GJTO.
V. ACKNOWLEDGEMENT OF FUNDING
All public relations materials, press releases and/or news articles related to services provided
under this Contract, will name GJTO and the Governor as a funding source. Failure to
comply with this provision may result in termination of this Contract.
VI. OUARTERLY NARRATIVES
The Contractor agrees to provide a quarterly narrative report within 30 days after the end of

each quarter which describes the status of the project including obstacles and successes and
progress in meeting the goals specified in the "Scope of Services" (Section A.5).
VII. PERIOD OF PERFORMANCE AND OPTION FOR RENEWAL
The period of performance is from July 1, 1995 to June 30, 1996. The Contract may be
renewed annually for One (1) additional years, dependent upon availability of funds to
GJTO, and the satisfactory performance by the Contractor as determined by GJTO. Renewal
of this Contract shall be at the sole discretion of GJTO. The Contractor understands that this
renewal option represents no prior commitment by GJTO to renew this Contract, and any
such renewal shall be accomplished by proper amendment according to State of Colorado
fiscal Rules, specifying the additional funds available. Such amendment shall also provide
for the modification of such other terms and conditions of this Contract as are appropriate.
VIII. GENERAL PROVISIONS
The Contractor agrees to perform in accordance with, and to comply with, the General
Provisions, attached, and by this reference incorporated herein.
IX. SPECIAL PROVISIONS
The Contractor agrees to perform in accordance with, and to comply with, the special
provisions attached hereto, and by this reference, incorporated herein.
EOUAL EMPLOYMENT OPPORTUNITIES/AFFIRMATIVE ACTION
A. Equal Employment Opportunity Requirements
The Contractor shall insure Equal Employment Opportunities (EEO) to all
individuals and shall take Affirmative Action (AA) to insure adequate utilization of
members of protected classes of workers who have been victims of past discrimina-
tion.
EEO shall mean that no individual shall be excluded from participation in, denied the
benefits of, subjected to discrimination under, or denied employment in the
administration of or in any program funded under this section because of race, color,
or national origin, age, disability, or political affiliation or belief.
Contractors shall be governed by the prohibitions against discrimination on the basis
of age under the Age Discrimination Act of 1975, on the basis of disability under
Section 504 of the Rehabilitation Act, on the basis of sex under Title IX of the
Education Amendments of 1972, or on the basis of race, color, or national origin
under -Title VI of the Civil Rights Act of 1976. Programs and activities funded under
this Act are considered to be programs receiving Federal financial assistance and are
all subject to all provisions of EEO.

B. Affirmative Action Requirements
B.1 AA shall mean good faith efforts through specific steps to eliminate the
effects of past discrimination, thereby enhancing the organization's ability to:
B.1.a .a Bring into the workforce, qualified members of protected class groups; and
B.1.b Facilitate the upward mobility of protected
_class groups; and
B.I.c Assure non-discriminatory treatment with respect to compensation, terms,
conditions, or privilege of employment.
B.2 Contractors shall be required to maintain a written AA program which includes as
a minimum:
B.2.a A description of the recruiting, training, or other functions that the Contractor
will be engaged to perform, as well as, the training and the specific steps that will be
undertaken to insure that eligible individuals will:
Be selected for participation in training;
o Be referred for job openings;
in proportion to their representation in the eligible client population.
B.2.b A description of how Contractors will monitor the programs to keep an
accurate accounting of all training including:
A Whether trainees successfully complete the training; and
-0 Whether the trainees are or are not placed into employment.
The Office of Federal Contract Compliance along with GJTO will monitor
compliance and review data necessary to determine whether any violation of
Executive Order 11246 has occurred by any Contractor subjected to those
AA obligations.
B.2.c A description of employee recruitment and hiring which insures adequate
utilization of women, Blacks, Hispanics, disabled persons, veterans, and
persons over the age of 55 in their workforce. AA goals and objectives in
hiring shall be based on either of the following measures:
'a U.S. Census data reflecting the percentage of each ethnic, age and
racial group available in the general labor force in the classifications
of Public Administrators; Counselors -Educational and Vocational;

C. Implementation
C.1 Contractors shall designate -an individual to serve as the EEO/AA
Officer. The EEO/AA Officer will:
C.1.a Conduct an annual availability and utilization analysis to
determine underutilization of any group in any job clas-
sification.
C.1.b Develop, implement, and continuously monitor the
Contractor's AA plan. This will include maintaining relevant
statistics on women, protected classes, minorities, disabled
individuals, veterans, and senior citizens possessing relevant
skills within the local labor market.
C.1.c Provide assistance to employers and subrecipients for the
promotion of -EEO.
C.1.d Advise the administrator in charge of the program regarding
regulations and guidelines of federal, state and local agencies
as they affect EEO and -the AA plan of the Council.
C.1.e Maintain liaison with appropriate federal and state agencies.
C.1.f Provide consultation and assistance on all AA and EEO -
related -personnel matters.
C.1.g Assist in the orientation of new employees, as required, and
counsel employees on equal opportunity matters.
C.l.h Review and approve appointments, promotions, disciplinary
actions, separations, and layoffs for compliance with EEO
standards set forth above.
C.1.i Recommend employment goals and time -tables, to the
Contractor, perform annual analysis of the agency's work-
force, staff utilization of available labor force possessing
requisite skills, prepare quarterly reviews of the agency's per-
formance against established goals, and recommend revisions
to the AA plan.
C.1.j Disseminate EEO/AA information to employers, sub -
recipients, and employees.

SPECIALYROVISIONS
CONTROLLER'S APPROVAL
1. This contract shall not be deemed valid until it shall have been approved by the Controller of the State of Colorado or such assistant as he may designate. this -provision
is applicable to any contract involving the -payment of money by the State.
FUND AVAILABILITY
2. Financial obligations of the State of Colorado payable after the current fiscal year are contingent upon funds for that purpose being appropriated, budgeted, and
otherwise made available.
BOND -REQUIREMENT
3. If this contract involves the payment of more than fifty thousand dollars for the construction, erection, repair, maintenance, or improvement of any building, road,
bridge, viaduct, tunnel, excavation or other public work for this State, the contractor shall, before entering upon the performance of any such work included in this contract,
duly execute and deliver to the State official who will sign the contract, a good and sufficient bond or other_acceptable surety to be approved by said official in a penal sum
not less than one-half of the total amount payable by the terms of this contract. Such bond shall be duly executed by a qualified corporate surety conditioned upon the faithful
performance of the contract and in addition, shall provide that if the contractor or his subcontractors fail to duly pay for any labor, -materials, team hire, sustenance, provisions,
provender or other supplies used or consumed by such contractor or his subcontractor in performance of the work contracted to be done or fails to pay any person who supplies
rental machinery, tools, or equipment in the prosecution of the work the surety will pay the same in an amount not exceeding the sum specified in the bond, together with
interest at the rate of eight per cent per annum. Unless such bond is executed, delivered and filed, no claim in favor of the contractor arising under such contract shall be
audited, allowed or paid. A certified or cashier's check or a bank money order payable to the Treasurer of the State of Colorado may -be accepted in lieu of a bond. This
provision is in compliance withCRS 38-26-106.
INDEMNIFICATION
4. To the extent authorized by law, the contractor shall indemnify, save, and hold -harmless the State, its employees and agents, against any and all claims, damages,
liability and court awards including costs, expenses, andattomey fees incurred as a result of any actor omission by the contractor, or its employees, agents, subcontractors,
or assignees pursuant to the terms of this contract.
DISCRIMINATION AND AFFIRMATIVE ACTION
5. The contractor agrees to comply with the letter_and spirit of the Colorado Antidiscrimination Act of 1957, as amended, and other applicable law respecting
-imination and unfair -employment practices (CRS 24-34-402), and as required by Executive Order, -Equal Opportunity and AffirmativeAction, dated April 16, 1975.
suant thereto, the following provisions shall be contained in all State contracts or sub -contracts.
During the performance of this contract, the contractor agrees as follows:
(a) The contractor will not discriminate against any employee or applicant for employment because of race, creed, color, national origin, sex, marital status, religion,
ancestry, mental or physical handicap, or age. The contractor will take affirmative_action to insure that applicants are employed, and that employees are treated during
employment, without regard to the above mentioned characteristics. such action shall include, but note limited to the following: employment upgrading, demotion,
or transfer, recruitment or recruitment advertisings; lay-offs or terminations; rates of -pay or other forms of compensation; and selection for training, including
apprenticeship. The contractor agrees to post in conspicuous places, available to employees and applicants for employment, notices to be provided by the contracting
officer setting forth -provisions of this non-discrimination clause.
(b) The contractor will, in all solicitations or advertisements for -employees -placed by or on behalf of the contractor, state that_all qualified applicants will receive
consideration for employment without regard to race, creed, color, national origin, sex, marital status, religion, ancestry, mental or physical handicap, or age.
(c) The contractor will send to each labor union or representative of workers with which -he has a collective bargaining agreement or other contract or understanding, notice
to be provided by the contracting officer, advising the labor union or workers' representative of the contractor's commitment under theExecutive Order, Equal Opportunity
and Affirmative Action, dated April 16, 1975, and of the rules, regulations, and relevant Orders of the Governor.
(d) The contractor and labor unions will furnish all information and reports required -by Executive Order, Equal Opportunity and Affirmative Action of April 16, 1975,
and by the rules, regulations and Orders of the Governor, or pursuant thereto, and will permit access to his books, records, and accounts by the contracting agency and
the office of the Governor or hisalesignee for purposes of investigation to ascertain compliance with such rules, regulations and orders.
(e) A labor organization will -not exclude any individual otherwise qualified from full membership rights in such labor organization, or to expel any such individual from
membership in such labor organization or discriminate against any of its members in the full enjoyment of work opportunity -because of race, creed, color, sex, national
origin, orancestry.
(f) A labor organization, or the employees or members thereof will not aid, abet, incite, compel or coerce the doing ofany act defined in this contract to be discriminatory
or obstruct or prevent any person from complying with the provisions of this contractor any order issued thereunder; or attempt, either directly or indirectly, to commit
any act defined in this contract to be discriminatory.

(g) In the event of the contractor's non-compliance with the non-discrimination clauses of this contract or with any such rules, regulations, or orders, this contract may
be cancelled, terminated or suspended in whole or in part and the contractor may be declared ineligible for further State contracts in accordance with procedures, authorized
in Executive Order, Equal Opportunity and Affirmative Action of April 16, 1975 and the rules, regulations, or orders promulgated in accordance therewith, and such other
sanctions as may be imposed and remedies as may be invoked as provided in Executive Order, Equal Opportunity and Affirmative Action of April 16, 1975, or by rules,
regulations, or orders promulgated in accordance therewith, or as otherwise provided by law.
(h) The contractor will include the provisions of paragraphs (a) through (h) in every sub -contract and subcontractor purchase order unless exempted by rules, regulations,
or orders issued pursuant to Executive Order, Equal Opportunity and Affirmative Action of April 16, 1975, so that such provisions will be binding upon each subcontractor
or vendor. The contractor will take such action with respect to any sub -contracting or purchase order as the contracting agency may direct, as a means of enforcing such
provisions, including sanctions for non-compliance; provided, however, that in the event the contractor becomes involved in, or is threatened with, litigation, with the
subcontractor or vendor as a result of such direction by the contracting agency, the contractor may request the State of Colorado to enter into such litigation to protect
the interest of the State of Colorado.
COLORADO LABOR PREFERENCE
6a. Provisions of CRS 8-17-101 & 102 for preference of Colorado labor are applicable to this contract if public works within the State are undertaken hereunder and are
financed in whole or in part by State funds.
b. When a construction contract for a public project is to be awarded to a bidder, a resident bidder shall be allowed a preference against a non-resident bidder from a state
or foreign country equal to the preference given or required by the state or foreign country in which the non-resident bidder is a resident. If it is determined by the officer
responsible for awarding the bid that compliance with this subsection .06 may cause denial of federal funds which would otherwise be available or would otherwise be
inconsistent with requirements of Federal law, this subsection shall be suspended, but only to the extent necessary to prevent denial of the moneys or to eliminate the
inconsistency with Federal requirements (CRS 8-19-101 and 102).
GENERAL
7. The laws of the State of Colorado and rules and regulations issued pursuant thereto shall be applied in the interpretation, execution, and enforcement of this contract.
Any provision of this Contract whether or not incorporated herein by reference which provides for arbitration by any extra -judicial body or person or which is otherwise in
conflict with said laws, rules, and regulations shall be considered null and void. Nothing contained in any provision incorporated herein by reference which purports to negate
this or any other special provision in whole or in part shall be valid or enforceable or available in any action at law whether by way of complaint, defense, or otherwise. Any
provision rendered null and void by the operation of this provision will not invalidate the remainder of this contract to the extent that the contract is capable of execution.
8. At all times during the performance of this contract, the Contractor shall strictly adhere to all applicable federal and state laws, rules, and regulations that have been
or may hereafter be established.
9. The signatories aver that they are familiar with CRS 18-8-301, et. seq., )Bribery and Corrupt Influences) and CRS 18-8-401, et. seq., (Abuse of Public Office), and
'lo violation of such provisions is present.
10. The signatories aver that to their knowledge, no state employee has any personal or beneficial interest whatsoever in the service or property described herein:

DEFINITIONS
1. APPLICANT (an individual) - Person(s) seeking Job Training -Partnership Act (JTPA)
services who have filed a completed application and for whom a formal eligibility
determination has been made.
2. CERTIFICATION Refers to the act of
1) attesting that the information provided by each JTPA individual as
stated on an application form is true and correct;
2) Authorizing verification of this information;
3) stating penalties for falsification; and
4) certifying that grievance procedure has been explained to the
applicant. All applicants must sign and date the application form at
the point of eligibility determination. (Lexicon for the JTPA)
In the case of a minor (except minors who are heads of households),
the signature of a parent, guardian, or other responsible adult is
required.
3. CITIZENSHIP - All participants must be citizens or nationals of the United States, lawfully
admitted permanent resident aliens, lawfully admitted refugees and parolees, or other
individuals authorized by the Attorney General to work in the United States [Section
167(a)(5)].
4. COMPLETION OF TRAINING - The participant has met or achieved the minimum
prescribed period of training, as described in the training agreement in accordance with the
Scope of Work of this Contract, and has attained the minimum level of performance Dr skill
associated with the training activity (GJTO). An activity is completed if the individual
achieves the activity's goal.
5. CONTRACT - a formal legally binding agreement between two principal departments of
the State or one principal department of the State and another party or an amendment to such
agreement.

A procurement instrument by which GJTO, a SDA grant recipient or a subrecipient pays for
property, services, supplies, materials or equipment.
6. CONTRACTOR - Any person, corporation, partnership, public agency, or other entity
which -enters into a contract with the Governor's Job Training Office, an SDA grant recipient
or a subrecipient under the Act. One who contracts to do work for another.
1. ECONOMICALLY DISADVANTAGED - The term' economically disadvantaged means
an individual who:
(A)
(B)
receives, or is a member of a family which receives, cash welfare payments under a
Federal, State or local welfare program;
has, or is a member of a family which has, received a total family income for the six-
month periodprior to application for the program involved (exclusive of unemploy-
ment compensation, child support payments, and welfare payments) which, in
relation to family size, was not in excess of the higher of
(i) the official poverty line (as defined by the Office of Management and
Budget, and revised annually in accordance with section 673(2) of the
Omnibus Budget Reconciliation Act of 1981 (42 U.S.C.
9902(2)), or
(ii) 70 percent of the lower living standard income level;
(C) is receiving (or has been determined within the 6 -month period prior to the
applicationfor the program involved to be eligible to receive) food stampspursuant
to the Food Stamp Act of 1977;
(D) qualifies as a homeless individual under subsections (a) and (c) of section 103 of the
Stewart B. McKinney Homeless Assistance Act (42 U.S.C. Sec 11302);
(E) isa foster child on behalf of whom State or local government payments are made;
This may include youth who have been made a ward of the court, including those in
the following categories:
- Youth in state institutions
- youth in community group homes
- youth in Foster Homes
(F) in cases permitted by regulations of the Secretary, an individual with a disability
whose own income meets the requirements of clause (A) or (B)above, but who is a
member of a family whose income does not meet such requirements. (JTPA §4(g)).

8. EMPLOYED - See Labor Force Status
8A. Employment - Employment for 20 or more hours per week for peiformance
standards (JTPA §106(k)).
9. Initial Enrollment - Date of participation. The date on which the individual began
to receive JTPA-funded program services after initial screening for eligibility and
suitability. Objective assessment to determine service strategy of employment goals
must occur on the date of participation and is considered an initial program service.
10. Family - Two or morepersons related by blood, marriage, or decree of court, who
are living in a single residence, and are included in one or more of the following
categories:
A) A husband, wife, and dependent children.
B) A parent or guardian and dependent children.
C) A husband and wire.

RESIDENCE. (JTPA §4(34))
11. FA1VIILY INCOME - Determininggross family income is one of the most difficult
tasks when determining and individual's eligibility for JTPA. For the purpose of
determining JTPA income eligibility, 20 CI'R 626.5 Definitions, Family Income
means "income" as defined by the Department of Health and Human Services in
connection with the annual poverty guidelines. Section 4(8)(B) excludes unemploy-
ment compensation, child support payments and welfare payments from income.
Therefore, while these items appear as included income in the poverty guidelines,
they are excluded from income for JTPA purposes.
Family income includes total annual cash receipts before taxes from all sources, with
the exceptions listed below.
INCLUDED AS INCOME
Money wages andsalaries before any deductions.
Net receipts from non -farm self-employment (receipts -from a person's own
unincorporated business, professional enterprise, or partnership after deduc-
tions for business expense).
Net receipts from farm self-employment (receipts from _a farm which one
,operates as an owner, renter, or sharecropper, after deductions for farm
operating expenses).

Regular payments from social security, railroad retirement, strike benefits
from union funds, worker's compensation, veteran's payments, and training
stipends.
Alimony.
Military family allotments or other regular support from an absent family
member or someone not living in the household.

Regular insurance or annuity payments.
College or university grants, fellowships, and assistantships.
Dividends, interest, net rental income, net royalties, periodic receipts from
estates or trusts.
Net gambling or lottery winnings.
EXCLUSIONS FROM INCOME
Unemployment compensation
Child support payments
Welfare payments (including AFDC, SSI, RCA, and GA)
Capital$ains
Any assets drawn down as withdrawals from a bank, the sale of property, a
house or a car

12. INDIVIDUAL WITH A DISABILITY
FOR ELIGIBILITY:
Those individuals evaluated and documented as being mentally retarded, hard of
hearing, deaf, speech impaired, blind, visually impaired, seriously emotionally
disturbed, orthopedically impaired, other health impaired, deaf -blind, multiple
disabilities, or as having a developmental disability, chronic mental illness, major
mental illness, organic brain syndrome, specific learning disabilities, who because
of those impairments, need special education and/or related employment andtraining
services.
Adapted from the Education of All Handicapped Children Act (P.L. 94-142; Reg.
300.5.a).
FOR PERFORMANCE STANDARDS:
An individual who has a physical (motion, vision, hearing) or mental (learning or
developmental) impairment whichsubstantiallylimits one or more of such person's
major life activities; has a record of such an impairment; or is regarded as having
such an impairment.
NOTE: This definition will be used for performance standards purposes, but is not
required to be usedfor program eligibility determination. (FederalRegister, Vol. 57,
no. 219)
The term "individuals with disabilities" means more than one individual with a
disability. (JTTA Sec. 4(10)(B))
13. LABOR FORCE STATUS:
EMPLOYED
An employed individual is one who, during the 7 consecutive days prior to
application, did any work at all as a paid employee, in his or ler awn business,
profession or farm, worked 15 hours or -more as an unpaid worker in an enterprise
operated by a member of the family or is one who was not working, but has a job or
business from which he or she was temporarily absent because of illness, bad
weather, vacation, labor --management dispute, or personal reasons, whether or not
paid by the employer for time off, and whether or not seekinganother job.
UNEMPLOYED
An unemployed individual is one who did not work during the 7 _consecutive days
prior to application for a JTPA program, who made specific efforts to find a job

within the past 4 weeks prior to application, and who was available for work during
the 7 consecutive days prior to application. Also included as unemployed are those
who did not work, and
(a) were waiting to be called back to a job from which they had been laid off, or
(b) were waiting to report to a -new wage or salary job scheduled to start within
90 days.
NOT IN LABOR FORCE
A civilian 14 years of age or over who did not work during the 7 consecutive days
prior to application for a JTPA program and is not classified as employed or
unemployed.
NUMBER OF WEEKS UNEMPLOYED DURING THE PRIOR 26 WEEKS
The number of weeks an individual was unemployed during the 26 weeks immedi-
ately prior to eligibility determination (refer to definitions above). It does not matter
if the applicant was employed at the time ofapplication.

14. (a) 'Offender - The Term "offender" means any adult or juvenile who is orms
been subject to any stage of the criminal justice process for whom service
under the JTPA may be beneficial or who requires assistance in overcoming
artificial barriers to employment resulting from a record of arrest or convic-
tion (JTPA, as amended).
(b) Offender - Any adult or youth who requires assistance in overcoming
•barriers to employment resulting from a record of arrest or conviction
(excluding misdemeanors). This definition may be subject to change pending
future regulations.
15. OLDER INDIVIDUAL - An individual age 35 or older. JTPA §204(d)(7)
16. -PARTICIPANT - An individual who has been determined to be eligible to
participate in and who is receiving services (except post -termination services
authorized under Sections204(c)(4) and264(d)(5) and follow-up services authorized
under section 253(d)) under a program authorized by thisact. JTPA Section -4(37)
17. PLACEMENT - The act of securing unsubsidized employment for or by a
participant, as a paid employee of a legally authorized business, industry or enterprise
including non-profit organizations. Paid employee meansDne who is carried on the
employer's payroll/personnel records, is self-employed, is entered into a registered

apprenticeship program or the Armed Forces, and is employed for20 or more hours
per week.
18. SELECTIVE SERVICE REGISTRANT - If the applicant is a male citizen of the
U.S. or other male person residing in the U.S., who was born on or after January 1,
160, and is between the age of 18 and 26, he must register. An applicant who is not
registered will be ineligible for JTPA funded services until he has done so.
EDWAA DEFINITIONS
19. CERTIFICATE OF CONTINUING ELIGIBILITY -EDWAA - A document
provided by a substate grantee to an eligible dislocated worker verifying their status
and authorizing continuing eligibility for a period not to exceed 104 weeks.
20. ELIGIBLE DISLOCATED WORKER - an individual who:
(a)

has been terminated or laid off or who has received a notice of termination
or layoff from employment, is eligible for or has exhausted his/herentitle-
ment to unemployment compensation, and is unlikely to return to his7her
previous industry or occupation;
has been terminated or has received notice of termination of employment, as
a -result of any permanent closure or any substantial layoff at a plant, facility,
or enterprise;
(c) is long-term unemployed andhas limited opportunities for employment or
reemployment in the same or similar occupationin the area in which such
individuals reside, including older individuals who may have substantial
barriers to employment by reason of age;
(d) was self-employed (including farmers and ranchers)andis unemployed as a
result of general economic conditions in the community in which fie/she
resides or because of natural disasters, subject -to regulations prescribed by
the Secretary of Labor.

Job Training Partnership Act, Title II -A & III OW Grant
Subject:
Enclosed for Board approval is a grant contract to the Governor's
Job Training - Office for $44,300 of Title II -A JTPA Older Worker Funds
and $10,000 in Title III Economic Dislocation and Worker Adjustment
Assistance Act (EDWAA) Funds.
Activities to be funded under the grant will include job
development, referral and placement, classroom and an -the -job
training, and skills enhancement. The goal is to provide training
and job placement for 38 low income older adults 55 years of age and
older.
The grant period is from July 1, 1995 through June 3D, 1996.
