Subj: Domestic Septic Sludge Permit for Property Legal Description: S2, SW4,Township 2 North,Range 67 West. This letter is to inform the Weld County Department Of Health our objections to approval of permit number SS-990001. 1: Our domestic well is a shallow well approximately 40 feet deep with the water rising to above 20 feet. I am concerned that water seepage will contaminate my well. 2: Also this same water seepage could contaminate Sandhill Lake and the water running through the irrigation ditch. Both of the above delivers irrigation water to our farms. 3: Located on our Fann are beehives. These bees will travel some distance looking for nectar before the corn crops are up. The bees could go to where the septic sludge has been dumped and could bring back to the hives any thing in the sludge, and the honey would be contaminate without any one knowing. 5: Rodents eating off of this sludge could cause wild life damage when the rodent becomes part of their diet.Hawks and Eagles are always in this area. 4: I believe that this sludge will be a breeding ground for insects. With no control this will only add to insect population and we don't need that. 6: Last would be the odor coming from this sludge. I know your letter said that this will be laid on the surface with incorporation,but will this stop the odor? A skunk will be long gone but his odor will stay around for a long time. Our neighborhood has grown in the last few years and I am sure these new neighbors made their decision to build here on what the surrounding area presented. They would never have built in this area if they knew that their loved ones and their pets would be exposed to such a hazard. Your letter also stated that this septic sludge was for beneficial purposes. If that is true_then who will benefit? I don't believe the surrounding area would have any thing to benefit, and if anything our property would loose its value. Can this truly be what Well County wants for this part of the county that is suppose to show strong growth in the next few years. We lease J.B Graners farm,less than 1/1 mile east of the proposed dumping site. We operate a very successful horse business at this facility. The success of this business is dependent on our customers enjoying a pleasant day at this farm while they browse through our foal crop and spend some time with the colts in order to select a foal they feel they can bond with. Some of our customers spend several hours a day, three or four days a week, simply enjoying the fresh air and spending time selecting a foal. We are afraid that the odor from his proposed dumping would be a deterrent to the amount of time customers would be willing to spend selecting foals not to mention our own quality of lire. We also feel the proposed dumping will increase the fly population. Flies are the transportation devices for Vesticular Stomitis, a highly infectious disease effecting horses, cattle and other livestock, including some wildlife. Once a farm is infected, the farm will be quarantined by the State,the results of which would he devastating to our horse business. As a large percentage of our foal crop is transported out of state, it is imperative that we reduce as many risk factors as possible to insure the farm remains disease free. We understand Weld County's position on"RIGHT TO FARM", however this permit is about an absentee landowner whose primary business is pumping septic tanks. He has leased this land to other farmers for years and is now merely looking for a less expensive way to dispose of septic sludge. Please help support the rights of the full time residence of this area.We feel if this permit is granted, our quality of life will suffer, property values will be reduced and potentially infectious disease will be brought to this area. We have the following concerns and would ask that they be taken into consideration as reasons for not granting a permit in this instance: 1. This property and the surrounding property is located on nearly pure sand. The percolation rate in this type of soil is rapid and we fear there will not be time for bacteria to neutralize. Water in this area runs through the soil like a sieve. 2. Wells in this area are shallow mostly less than 100 feet, our water level is 60 feet. All property located to the east of this proposed site is down hill sloping toward the Platte River. 3. We have been told that there could be odor as a result of this type of application. The prevailing winds are from the west. The prospect of odor from human sewage is not a pleasant one. 4. There appears to be no standard for how many, how close together, and how extensively such applications could be granted within a particular area. 5. We have very high nitrate levels in our soil. Any possible additional levels of nitrate would be unacceptable. 6. There are too many unkowns about what the long term damage to the surrounding ground water might be. We have the following concerns: 1. The soil in that area is very sandy. If the area perks too fast it could contaminate the groundwater. 2. We understand that the water table must be at least 7' below the surface. Was this measurement taken during the time of year when the water table would normally be high due to return flows from irrigation? 3. This area is in the water shed just above Sand Hill Lake. A rain event could carry the sewage down stream into the lake and contaminate the water. This lake is used for swimming and water skiing and the income derived from this recreational use is a major source of income for the Ditch Company that owns it. 4. Some people in the area depend on the groundwater for their wells. Once the groundwater is contaminated it is virtually impossible to clean it up. Based on these and other concerns we strongly oppose the issuance of a permit for the above use. Lupton, I strongly OPPOSE the Sludge permit based on the following personal health hazards, environmental hazards, and the detrimental impact on the ability to sell my property. As a homeowner with well water for drinking, I OPPOSE the surface with incorporation as you cannot guarantee me that this human feces/treated with toxic chemicals will not have an impact on my health, my family's health, our livestock's health, should it accidentally get into the water supply. Additionally, such human waste carries a potential for disease and no matter how careful the dumping company, there is always potential for human error hazard and I, again, strongly OPPOSE the sludge permit for reasons of potential health hazard to myself, my family and our livestock. It is common knowledge that manure, fertilizer and Human Feces will draw added fly problems therefore creating a potential hazard to farming/ranching livelihood by increasing the risk of Vesticular Stomatitis, which has been a serious problem in our area in the past. A problem we don't want to invite back. The potential for disease/bacteria spread cannot be guaranteed not to impact the wildlife, golden eagles, etc. that feed off the vermin on the ground that will travel through this Human Feces infected field. I strongly OPPOSE putting our native wildlife at risk. lx)H -7 Page 2 of 2 Opposing position for Domestic Septic Sludge permit#SS-990001 It is my experience that if you allow this application to be approved you will be setting yourselves up for potential liability for all hazard related incidents of farming sicknesses and human illnesses attributed to these preventable human health hazards, environmental health hazards to wildlife, water contamination problems, etc. No matter how careful we may scrutinize said applicant's records, set our regulations, and try to enforce them,there is always a potential for human error, so I highly caution you--do not make the mistake of inviting problems where presently there exists no problem. My concerns are as follows: 1. What will this do to our land? 2. It will go down in the ground and pollute the water that goes into people wells and there is Sand Hill Lake near this area,this stuff will kill the fish and birds that live there. 3. What will this do to both our domestic animals and the wildlife that graze in the area? 4.What kind of dieases will this cause not only to the animals but to us humans? 5. 1 also feel this will drop the property value on all our homes who live any where near this property. I strongly advise all the members of the Health Board to veto this, it is too close to other people's property. It is not a healthy situation to have to live in. We have a shallow well and we are concerned about the ground water contamination that will affect our home and our livestock, should this permit be allowed. The odor in the hot weather will be a problem, as well as the possibility of disease and virus that can be carried in the water or insects. The insects could infect the cattle. The Coal Ridge Ditch Company delivers water to the Sand Hill Lake,which runs through this property. The Platte Valley Ditch Company and the Lupton Meadows Ditch Company owns Sand Hill Lake, which is leased to the Fort Lupton Boat Club. The lake is used for recreation and we are concerned the sludge will seep into the Coal Ridge Ditch and contaminate the water. The area is moderately populated with families. There are also a large amount of domestic animals in this area. We are concerned for the health of these families and the animals, should this sludge permit be approved. Please do not allow this permit. It is our understanding that this will be a commercial operation. If this is the case ,will this be for beneficial use or just an inexpensive disposal alternative. The following are some of the questions that we feel need to be answered before this permit can be acted upon. * How much sludge will be permitted to be disposed of, and what is the capacity for this property to assimilate this waste. • Will the amount of sludge allowed affect the groundwater in the area. Will there be an ongoing monitoring program to ensure this will not be a problem • What will be the method of incorporation,and how long will the sludge be on the surface. • Will this operation be an additional source of insects, ie: flys * What provisions are there for the control of surface runoff, as there is a large ditch that feeds Sand Hill Lake below parts of this property 3aH IOU * Will this operation affect nitrate levels in the lake * Will the project produce offensive odors over a significant length of time * Is the product being dumped on this property treated sludge or raw sewage and how will this be monitored. We feel these are some of the questions that need to be answered before a permit can be issued. At this time we feel a commercial sludge disposal operation on this site,is inappropriate. The Fort Lupton Boat Club Leases Sand Hill Lake from the Lupton Meadows Ditch Company for recreation; swimming,boating,water skiing,fishing,and hunting. Sand Hill Lake is in the drainage area that will receive run off water from the property accepting raw sewage. As president of the Fort Lupton Boat Club, speaking for its approximately 40 members,their families,and friends who use Said Hill Lake for recreation,we ardently oppose the dumping of raw sewage on that property. The parcel is not cropland and therefore the only benefit of the application will be applicant' s ability to easily dispose of the waste from his septic pumping business . The property owner does not reside on this parcel so the nuisance factors will be left for the surrounding property owners to contend with. We also worry that conch and offal could be a part of the sludge since it is pumped from tanks and land applied but has no provisions for control in Weld County regulations . Property owners near Briggsdale are having serious problems with application of these materials and it would be a shame to further the problem before the county can address the need to control application of these types of materials. Please consider these problems in your consideration of this application. We have farmed in Weld County for over 16 years and would hate to see this ground become a septic- sludge farm. The property far this project is,directly adjacent to ow property on the Southwest cornet. We do not feel a Domestic Sludge project should be approved in an area that contains a large number of residents living in its proximity. Out concerns are not only for the health risks for the human population,but also,for the domestic animals and wildlife in the area. We are among many residents in this area that raise horses or other livestock as a business and/or hobby,. We show registered Appaloosa and Quarter horses all over the United States. We also have homes brought in from all over the country for breeding,training,boarding,etc. We have mares foaling in early Spring and Summer each year. The health risks to my family,animals,and business(as well as the other residents in this area)are too great to allow such a project to be approved. Listed below please find a list of additional concerns we have regarding this project: 1) The odor that will be caused by the human sludge being deposited on the wound; 2) The diseases that will be carried by insects(mosquitos,flies,etc.)to humans, domestic animals,and wildlife that live here; 3) The effects of this hazardous material to the Bald Eagles and other migrating birds that nest and feed all around this property, 4) The effects of this material seeping into the wells that furnish drinking water for the residents and animals in this area; -6DH t )9 Page 2 of 2 5) Drainage from this hazardous material into irrigation water that runs into Sandhill Lake. The Lake is used by a large number of adults and children for boating,water skiing, fishing and switmning', 6) The effects this hazardous waste material draining into Sandhill Lake will have on the fish,water fowl,and wildlife that live an and around the Lake. The Lake also feeds several irrigation canals and ditches used for irrigating the surrounding fanning area. We strongly oppose the approval of this Domestic Septic Sludge Permit. We have worked for many years to build and improve our property. The value of our property,and the property in this area,will be greatly decreased if thispgoiect is approved. We feel that the health risks that will result noun a project of this type are too great to be in an area that is as populated as we have become in the past few years. The numbers of families moving to this area are rppidly inuring. There are new hones gojng up all around us. Human feces and 'waste material Carry too many diseastbetind the odbr is too great to be dumped in a reiid+ential area. This type operation should be located in an area without people and animals living right next door. Reasons I oppose this permit is as follows: * concerns of contamination to the fields and water in the surrounding areas. Run off water getting into the lake down the road were many families enjoy swimming and boating at Sandbar lake. Not to mention possible contamination to well waters in the shallow sands. *concerns of hazards to the animals living in this area. (eagles, coyotes, cats, dogs, etc...) *concerned about the neighborhood children who play in the run off waters and in neighboring fields *concerns of the smell this may cause if not treated on time or at all. *concerns of the increase in insects this may cause in the area. *concerns of vesticular stomatitis being brought into the area by the flys between this location, the dairies and the turkey farms. *concerns of increase traffic and noise at all times of the day and night. *concerns of this septic sight causing the value of our property to drop, should we ever decide to sell. Along with these reasons, I am disappointed in the lack of information supplied to the families in the surrounding areas. There should have been more of a effort to educate prior to applying for a permit. Once again I oppose this strongly!!!! We are firmly opposed to the proposed land use. It is totally inappropriate to dump human waste in an area so near so many residences and on both sides of a canal which feeds directly into a small reservoir which is used for recreation. We built a home %mile north of the proposed site. We feel the value of our home will dramatically drop if this type of septic waste is deposited on and/or in the land. Our family consist of two adults and three young children, a dog and a cat. We are concerned for our family and animals for the following: 1. Odor: • The smell will be intense during hot summer days. 2. Diseases: • The human waste will seep into the ground, therefore, contaminating our drinking and ground water. • Any wildlife that may consume from this sludge site, will spread the diceace to other animals in the food chain. • Domestic animals will be infected as well, through the flies and insects that will transmit the diseases. 3. Regulations: • During the winter months, when the ground is frozen, how will he be able to incorporate the sludge into the ground. • Once a year inspections are not sufficient enough to ensure proper regulation compliance. We understand Weld county's position of`Right to Farm'. However, because this permit requires your approval, we consider it a `special use' over and above any vested right of a property owner.
