RE: APPROVAL OF RECORDED EXEMPTION #2211 - GREG REEVES/PATTY
DEPLAZES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), C.R.S., as amended, did determine at a public meeting held in the
Chambers of the Board, that a certain parcel of land, to be divided into three parcels, as shown
on the plat known as Recorded Exemption #2211, does not come within the purview of the
definition of the terms, "subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #2211 was submitted by Greg Reeves
and Patty Deplazes, 16058 Weld County Road 96, Nunn, Colorado 80648, for property which is
located in part of the WY2W% of Section 17, Township 9 North, Range 67 West of the 6th P.M.,
Weld County, Colorado, being more particularly described in the plat which shall be provided by
the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into one parcel estimated to be
approximately 160 acres and two parcels approximately 10 acres each.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is,
exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #2211 submitted
by Greg Reeves and Patty Deplazes be, and hereby is, approved conditional upon the
following:
1. A Weld County septic permit is required for any proposed home. The septic
system shall be installed according to the Weld County Individual Sewage
Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. The applicant shall submit a proposed building envelope for Lot C to the
Department of Planning Services for review. Upon approval by the
Department of Planning Services, the building envelope shall be
delineated on the plat.

B. In accordance with Ordinance #180, Lots A and B shall be granted one
residential/agricultural access. Lot C shall utilize the existing access from
the section line. This access along the section line must be graded and
maintained to provide all-weather access to the parcels. No circle drives
or additional accesses shall be granted. The applicant shall submit to the
Department of Planning Services, a written access agreement for use
between Lots A and B.
C. All approved accesses shall be clearly shown on the plat. The applicant
shall contact the Weld County Public Works Department to determine if a
culvert is necessary at any approved access point.
D. The applicant must submit a deed to the Department of Planning
Services, describing the legal description above.
E. The following notes shall be placed on the plat:
1) All proposed or existing structure will or do meet the minimum
setback and offset requirements for the zone district in which the
property is located.
2) Any future structures on site must obtain the appropriate zoning
and building permits.
3) Prior to the release of building permits on Lots A, B, and C, the
applicant shall submit evidence to the Department of Planning
Services that the lot has an adequate water supply of sufficient
quality, quantity, and dependability.
F. The applicant shall submit to the Department of Public Works, and have
approval by the Board of County Commissioners, a Road Improvements
Agreement for Weld County Road 104.
3. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall
be prepared in accordance with the requirements of Section 11.7 of the Weld
County Subdivision Ordinance. The plat shall be submitted within sixty (60) days
from the date of approval by the Department of Planning Services. The
applicant shall be responsible for paying the recording fees.

The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through
11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according
to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:

Good Morning, Julie Chester, Department of Planning Services
This is Recorded Exemption 2211
This section is in a very rural area located approximately seven
miles from the town of Nunn. This section was an entire 640 acres
less than one year ago, owned by Greg Reeves and Patty Deplazes.
In November, 1997 Recorded Exemption 2119 was approved by
the department of planning services creating three buildable lots.
In April of 1998 another recorded exemption was applied for to
create three more buildable lots, to the west of and adjacent to RE-
2119. The east half of Section 17 was sold to Brunello, LLC and
less than a week later, Recorded exemption RE-2225 was applied
for by the partnership, proposing to create two more lots, east of
and adjacent to RE-2119. The applicants of this proposed
recorded exemption have indicated that the remainder of the
section has been divided into three 80 acre parcels.
The applicant for RE-2211 has not demonstrated that this
application is consistent with efficient and orderly development.
The Weld County Subdivision Ordinance defines urban scale
development as developments exceeding five lots and/or located
in close proximity to existing PUD's, subdivisions, municipal
boundaries, or urban growth corridors and boundaries. All urban
scale developments shall pave the internal road systems of the
development. The Department of Planning Services' staff believes
that the applicant has evaded the intent of the recorded exemption
process by creating multiple lots without utilizing the appropriate
subdivision process.
This section is designated as prime farm ground if irrigated as
defined by the Soil Conservation Service and Colorado State
University Cooperative Extension Service. The Weld County
Comprehensive plan's Agricultural goals and policies preserve
prime farmland for agricultural purposes which foster the
economic health and continuance of agriculture and to discourage
residential development which is not located adjacent to existing
incorporated municipalities. This is intended to minimize
incompatibilities that occur between uses in the agricultural zone
district and districts which allow urban-type uses. This proposal
would hinder the productivity of the agricultural uses in the area.
This area is being farmed, mainly in wheat and alfalfa.
Staff also has concerns regarding eight lots accessing onto a road
not maintained by Weld County. There are concerns for fire
protection, police protection, school buses and maintenance of the
lane during bad weather. These concerns are not inclusive, but just
a few examples of the problems that could be created by the
approval of this recorded exemption.
The Department of Planning Services is recommending denial of
RE-2211 for these reasons.
The applicant is present today and I would be glad to address any

Dear Commissioners:
Greg Reeves and Patty Deplazes have requested a Recorded Exemption to occur on part of the W2/W2 of
Section 17, Township 9N, Range 67W of the 6th P.M., Weld County, Colorado. The 160 acre parcel is
located approximately seven miles from Nunn,Colorado;north of and adjacent to Weld County Road 104,
which is not maintained by the County. The parcel of land under consideration is the total contiguous land
holdings of the applicant.
Based upon submitted information, referral agencies, and the governing mechanism of the County, the
Department of Planning Services' staff recommends this request be denied.
The applicant is requesting to divide this parcel into three parcels. The staff believes the applicant has evaded
the intent of the recorded exemption process by creating multiple lots without utilizing the appropriate
subdivision process. The result is an entire section which has been inundated with piecemeal development.
Staff has the following concerns:
1. The applicant has not demonstrated that this application is consistent with efficient and orderly
development. This is the third request for a Recorded Exemption in the section,two which have been
submitted by this applicant, creating eight lots:
► Recorded Exemption 2119, Greg Reeves and Patty Deplazes, Submitted on October 20, 1997 and
approved on November 25, 1997,created three buildable lots,accessing onto WCR 104,which is not
maintained by the County, utilizing private wells and septic systems.
► Recorded Exemption 2211,Greg Reeves and Patty Deplazes,Submitted on March 30, 1998,applying
to create three lots,directly west of and adjacent to the above referenced Recorded Exemption(RE-
2119),accessing onto WCR 104,which is not maintained by the County,utilizing private wells and
septic systems.
► Recorded Exemption 2225,Brunello LLC, Submitted on April 6, 1998, applying to create two lots,
directly east of and adjacent to the above referenced Recorded Exemptions(RE-2119 &RE-2211),

accessing onto WCR ,which is not maintained by the County, IA"?'zing private wells and septic
systems. This property was owned by Greg Reeves and Patty Deplazes less than one year ago.
2. The conflict between rural and urban activities is evident in this request. When an urban growth
pattern is established without regard to long range comprehensive planning the outcome lacks the
essential elements of long term desirability. Higher costs are incurred by providing many public
services to urban sprawl areas. As urban areas develop and expand they inadvertently influence
surrounding areas. These areas are either converted to urban uses themselves or are in direct conflict
and competition with agricultural areas.
3. The applicant has failed to comply with the A(Agricultural)zone district intent. This parcel is located
outside of an Urban Growth Boundary Area. Continued division of this parcel emphatically opposes
the intent of the A (Agricultural) zone district. The potential to interfere and encroach upon the
agricultural activities of this area is evident. The A(Agricultural)zone district was established to
promote and maintain agriculture as a vital support element for Weld County Citizens,and not to be
continually decreased for residential development. The Agricultural zone policies discourage the
conversion of agricultural land for residential uses within an area located outside of an urban growth
boundary. The intent is to eliminate incompatibilities that exist and minimize costs to Weld County
tax-payers.
Instead of applying for and adhering to the appropriate subdivision regulations the applicant has chosen to
subdivide the land without regard to the long term impacts of the divisions. By doing so,the applicant has not
been required to pay for the cost of public services and improvements that his current proposed divisions are
producing. The Department of Planning Services' staff is concerned with this lack of consistency with the
Comprehensive Plan and Subdivision Ordinance.
Specifically,the Department of Planning Services' staff recommendation of denial for this request is based
upon the application's inconsistency with Section 1.3 of the Weld County Subdivision Ordinance, which
ensures orderly and efficient subdivision development within the county,and conflicts with A.Goals 1,3,4,
6,7,and 9 of the Comprehensive Plan,which define appropriate development goals and policies within the
Agricultural zone district.
Scattered residential development in rural areas necessitates an increased demand for roads and bridges,police
and fire protection,education facilities, utilities and other services. The cost of providing services and the
conflicts between rural and urban land uses can be reduced if development is encouraged within urban growth
boundary areas or are adjacent to existing municipalities.
The Department of Planning Services' staff requests that the Board of County Commissioners consider the
application and determine if the standards of Sections 11.2 through 11.8 of the Weld County Subdivision
Ordinance have been met and adhere to the goals and policies of the Weld County Comprehensive Plan.

• Very hilly, Dryland farming, wheat. Extremely bad access from a lane. It is an apparent road
right-of-way, however it is not maintained by Weld County. It was very difficult to drive
down and eight lots will be accessing on this very narrow lane. There is some concern
regarding school buses and firetrucks getting down this lane in bad weather. This is a very
rural area, located approximately 9 miles from Nunn. The section is vacant land at this time,
with proposed residential sites.

1. Water will be supplied by a private well. A well permit will be obtained prior to start of
construction. Domestic well permits to serve the two smaller lots have been applied for by the
applicant.
2. Each lot will utilize an Individual Sewage Disposal System installed according to Weld County
ISDS Regulations.
3. Property is presently non-prime dry farmland. There are no improvements on the site. The
site is zoned A, and consists of 180 acres, more or less. A deed to separate this parcel from
contiguous land owned by the applicant has been created and submitted for recording. A copy of
the recorded deed will be submitted to Weld County Planning.
4. The exemption is requested in order to create residential building lots.
5. Two building lots of approximately 9.64 acres each will be created along the south side of the
existing site, approximately 700 feet north to south, by approximately 600 feet east to west,
. fronting WCR 102. The remaining 140.72 acres will comprise the third lot, and will remain in dry
farming. The present use of the site Is dry farmland. A 12O foot wide access west of the
westernmost of the smaller lots, to provide access to the larger lot from WCR 102, has been
reserved by the applicant. A shared access to serve the two smaller lots has been requested.
8. There are no existing structures on the site. All new structures will comply with setbacks as
required by the Weld County Zoning Ordinance.
7. The site does not lie within any planning area, and is not affected by any intergovernmental
agreements.
8. The surrounding area consists of A zoning, with a number of rural residences located within
the vicinity of the site.
9. The Weld County Zoning Ordinance allows for the creation of single family residential lots in
the A zone through the Recorded Exemption process. The requested RE will comply with the
Weld County Comprehensive Plan in that this request does not cause any prime farmland to be
taken out of production. The two smaller lots have been created in such a way as to preserve
ease of farming the larger lot, which will remain in dry farming.
10. This proposal is consistent with efficient and orderly development as defined in the Weld
County Subdivision Ordinance in that It will create single family residential lots in the A zone,
without destruction of prime farmland. The two smaller lots have been requested adjacent to
one another in order to provide ready access to utilities, and to provide for ease of farming the
remaining larger lot.
This site will use private wells, and the soils are suitable to support properly intalled Individual
Sewage Disposal Systems. Telephone and electric service are available to the site
The site does not lie in the flood plain, or in any Overlay Districts. There is no danger of loss or
injury from fire in wooded terrain.

COMMENTS:
WCR 104 and WCR 15 are designated on the map as being section line accesses. In researching this with the
Clerk to the Board, there is adequate right-of-way on WCR 104 to access to WCR 17 from the proposed location.
REQUIREMENTS:
Lots A and B, the 9.6-acre parcels, will utilize one access point onto WCR 104. They will access along the section
line going east to WCR 17. This access easement should be graded and maintained to provide all-weather access
to the parcels. If a culvert is required at the shared access point, a 15-inch CMP is the county minimum. If the
applicant chooses to place a larger culvert, please contact our office.
Lot C, the 140-acre parcel, will remain agricultural. The applicant should utilize the existing access from the section
line as no additional accesses will be granted.
